AN ORDINANCE ,
Amending Sections 22-24b, 22-24F,
and 22-24g of the Code of the City
of Evanston, 1957, as amended,
Relating to the Evanston Mental
Health Program.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,
COOK COUNTY, ILLINOIS :
SECTION 1: That the Code of the City of Evanston, 1957,
as amended, be further amended by amending
sections 22-24b, 22-24f, and 22-24g.to read _as follows:
"Sec. 22-24b. Appointments.
The members of the Board shall be appointed by the Mayor
with the advice and consent of the City Council. Members
shall be residents of the City of Evanston. Membership
of the Board shall, as nearly as possible, be representa-
tive of interested groups in the community, such as the
Health Department, medical societies, local welfare
agencies, hospital boards, school boards, local compre-
hensive health -planning agencies, lay.associations con-
cerned with mental health, alcoholism, controlled
substances addiction or use of cannabis, or mental're-
tardation, as well as labor, business and civic groups,
and the general public. One member shall be an Alderman
of the City of Evanston. No member of the Mental Health

Board may be a full-time or part-time employee of the
Illinois Department of Mental Health or any facility or
service operating under contract to the Board.
"Sec. 22-24f. Powers of the Board.
Subject to the provisions of the Community Mental Health
Act, the Evanston Mental Health Board shall:
(a) Review and evaluate community mental health
:services and facilities in Evanston, including services
and facilities for the treatment of -alcoholism, drug
• addition and mental retardation;.
(b) Submit to the Mayor and City Council a program
of community mental health services and facilities,
including programs for alcoholism, drug addiction
and mental retardation;
(c) Within amounts appropriated therefor, execute
such programs and maintain such services and facilities
as.may be authorized under such appropriations,
including amounts appropriated under bond issues, if
any;
(d) Consult with all other local private and public.
agencies and the Illinois Department of Mental Health
in the development of local plans for the most effi-
cient delivery of mental health services;

• ."(e) Review and comment on applications for Department
of Mental Health grants to any person, corporation or
governmental unit located in Evanston. A copy of such
review and comment shall be sent to the grant appli-
cant and the Department of Mental Health;
"(f) Perform such other acts as may be necessary or
proper to carry out the purposes of this Ordinance, if
not inconsistent with the regulations of the Illinois
Department of Mental Health.
"Evanston Mental Health Board may;
"(a) Enter into contract for rendition or operation
of services and facilities on a per capita basis or
otherwise;
"(b) Arrange for the rendition of services and opera-
tion of facilities by other agencies of the City of
Evanston or the County of Cook with the approval of
the City Council;
"(c) Employ such personnel as may be necessary to
carry out the purposes of this Ordinance and prescribe
the duties of such personnel;
"(d) Enter into joint arrangements with other con-
tiguous mental health -boards to provide jointly
agreed upon community mental health facilities and

"services and to pool such funds as they may be deemed
necessary and available for this purpose;
"(e) Enter into joint agreements with other govern-
mental units located in Evanston to provide for the
rendering of services to the residents of Evanston.
For this purpose, the Board is authorized to accept
local tax funds, including funds made available through
the Federal, State and Local Fiscal Assistance Act of
.1972;
"(f) Enter into joint agreements with the Department
of Mental Health whereby the Board shall.make provision
for certain services, other than services for the
• mentally retarded, the costs of which shall be segotiated between the Department and the Board;
"(g) Receive gifts from private sources for purposes
not inconsistent with the provisions of the Community
Mental Health Act;
"(h) Receive Federal, State and local funds for pur-
poses not inconsistent with the provisions of the
Community Mental Health Act;
"(i) Establish scholarship programs, requiring
equivalent service or reimbursement pursuant to
regulations of the Board;

"(j) Operate direct patient services; provided,
however, that such operation shall not extend beyond
a two-year period, and provided further that the
Board shall not operate any direct patient services
when such services are being provided in Evanston,
but shall encourage, by financial support, the develop -
went of private agencies to deliver such needed services,
pursuant to regulations of the Board.
"Sec. 22-24g. Annual Budget and Levy.
Annually, on or before October 15, the Aoard shall prepare
and submit to the Mayor, City Council, and City Manager
its annual budget showing the estimated receipts and
intended disbursements for the fiscal year beginning the
next January 1. The Mental Health Board may recommend
an annual tax levy of not to exceed .1% upon all of the
taxable property of the City of Evanston at the assessed
value thereof, as equalized by the Department of Local
Government Affairs. The City Manager shall incorporate
the Board's revenue estimates and appropriation requests
in the proposed budget to be submitted on or before
December 1 in each year to the City Council for its review,
revision and adoption. The Board's annual budget shall
be filed with the City Clerk on or before October 15 in
each year and shall be available for public inspection."

SECTION 2: All ordinances or parts of ordinances in
conflict with the provisions of this ordinance
are hereby repealed.
SECTION 3: This ordinance shall be in full force and
effect from and after its passage, approval
and publication in the manner provided by law.
