Basic Energy Conservation Code 4/6/78 WHEREAS, the City Council of the City of Evanston is 1 desirous of adopting certain criteria which will promote the con- servation of energy in building design and construction said criteria being those published by the Building Officials and Code Administrators International, Inc., known as B.O.C.A. Basic Energy Conservation Code, Second Edition, 1978; and WHEREAS, the City Council of the City of Evanston has caused three copies of such energy conservation code to be kept I on file in the office of the City Clerk for public inspection for a period of fifteen (15) days prior to the adoption of this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS AS FOLLOWS: SECTION 1: That Chapter 10 of the Code of the City of I Evanston, 1957, as amended be further amended by adding thereto Article VI, Section 10-50 and 10-51 I which shall read as follows: I "4 .7 • • "Article VI Basic Energy Conservation Code "Section 10-50. Adoption of the B.O.C.A vation Code. 41-0-78 Energy Conser- Pursuant to the authority granted by Chapter 24, Sections 1-2-4 of the Illinois Revised Statutes and the powers granted home rule units of government by the Constitution of the State of Illinois, the City of Evanston hereby adopts by reference as criteria for the conservation of energy in building design and construction the B.O.C.A. Basic Energy Conservation Code, Second Edition, 1978. "Section 10-51. Penalty for Violations. Any person who shall violate any provision of the Basic Energy Conservation Code pertaining to design and con- struction, or who shall fail to comply with any of the requirements thereof shall be guilty of an offense pun- ishable by a fine of not less than FIFTY DOLLARS ($50.00) nor more than FIVE HUNDRED DOLLARS ($500.00) for each and every offense. Each day that an offense continues shall be deemed a separate offense." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval; and publication in the manner provided by law.
