AN ORDINANCE
Rezoning The Block Bounded By
Brown Avenue, Brummel Street,
Dodge Avenue And The Skokie
Swift Right Of Way
WHEREAS, the petition of Lee Siegel, Care Weilding, and Gerald S.
Grobman, who are the beneficiaries of the Pain Bank of Chicago's Trust No.
77-1262, to rezone certain property was presented to the Zoning Amendment Com-
mittee; and
WHEREAS, the City Council of the City of Evanston raised the issue
with the Zoning Amendment Committee of rezoning the property fronting on Brown
• Avenue on the block lying north of Brummel Street and south of the property
forming the corpus of Main Bank of Chicago's Trust No. 77-1262 from R5 to R2; an)

WHEREAS, the first public hearing on the petition was held by the
Evanston Zoning Amendment Committee on September 8, 1977 and both matters were
considered at hearings on October 6, 1977, November 3, 1977, December 1, 1977,
January b, 1978, February 2, 1978, and March 2, 1978, pursuant to notice and
publication as required by law; and
WHEREAS, the Evanston Zoning Amendment Committee rendered a report
under date of March 2, 1978 recommending a change in zoning of said property
and the simultaneous resubdivision and public dedication of an extension of the
public right of way existing adjacent to the Skokie Swift tracks; and
• I WHEREAS, it is the desire of the City Council of the City of
Evanston to approve the subdivision and accept the extension of the public
right of way as legally described hereafter; and

WHEREAS, the owners of the property constituting the proposed exten-
sion of the right of way have indicated a willingness to quit claim any in-
terest in said property; and
WHEREAS, the City Council of the City of Evanston has deemed that the
best interests of the City of Evanston will be served by tine acceptance of the
j proposed dedication;
NOW, THEREFORE, BE IT ORDAI14ED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
1 SECTION 1: That the zoning ordinance of the City of Evanston

adopted November 21, 1960, as amended, be further amended
by reclassifying from B1 Business to R5 General Residence District, the follow-
ing described property to wit:
Parcel 1: Rezone from Bl Business to R5 General Residence
District the property commonly known as 234 Dodge Avenue
and described as "That part of the East 330 feet of the
South 198 feet of the North 404.25 feet of the South East
` 1/4 of the North West 1/4 of Section 25, Township 41 North,
Range 13, East of the Third Principal Meridian described as
follows: Commencing at a part in the North line of said
Tract, 40 feet West of the North East corner thereof;
thence South on a line parallel with the East line of said
Tract 34 feet; thence West on a line parallel with the
North line of said Tract 128 feet; thence South on a line
i parallel with the East line of said Tract 11 feet; thence
West on a line parallel with the North line of said Tract
162 feet to a point on the West line of said Tract 45 feet
South of the North West corner thereof; thence North on
the West line of said Tract 45 feet to the North West cor-
ner thereof; thence East on the north line of said Tract
290 feet to the place of beginning."
SECTION 2: That the zoning ordinance of the City of Evanston
adopted November 21, 1960, as amended, be further amended

by the reclassifying from R5 General Residence to R2 Single Family Residence
District the following property, to wit:

• Lots 1 through 6, inclusive, of A. F. Johnson's Resubdi-
vision of Lots 1 through 7, inclusive, in George F. Nixon
& Co.'s Dodge Avenue Rapid Transit Subdivision in the
S.E. 1/4 of the N.W. 1/4 of Section 25-41-13 of Cook
County, Illinois; and
That part of the S.E. 1/4 of the N.W. 1/4 of Section
25-41-13 lying South of the South line of Lot 3 of the
Able Subdivision and North of the North line of Lot 6 of
the A. F. Johnson Resubdivision and East of a line drawn
parallel to and 128 feet West of the West line of Dodge
Avenue, all in Cook County, Illinois.
SECTION 3: That the resubdivision of Lot 3 of the Able Subdivision
disclosed and described in the plat attached hereto and
made a part hereof is hereby approved.
SECTION 4: That the property legally described as:
That tract of land commencing at the N.E. corner of said
• Tract; thence Westerly along the North line of said
Tract 286.65 feet to the place of beginning; thence con-
tinuing Westerly to the N.W. corner of said Tract a dis-
tance of 43.35 feet; thence Southerly along the Westerly
line of said Tract a distance of 45.00 feet; thence East-
erly parallel with the North line of said Tract a distance
of 43.33 feet; thence Northerly a distance of 45.00 feet
to the place of beginning, in Cook County, Illinois,
be and is hereby accepted as an extension of a public right of way by the City
Council of the City of Evanston.
SECTION 5: The official district map of the zoning ordinance of the
City of Evanston, as amended, shall be further amended
in accordance with the reclassification provisions of this ordinance.
SECTION 6: That a certified copy of said ordinance, together with a

tion be recorded at the Office
of the
Recorder
of Deeds in Cook County,
Illinois.

SECTION 7: All
ordinances
or parts of ordinances in conflict here-
with
are hereby
repealed.
SECTION 8: This ordinance shall be in full force and effect from
and after its passage, approval, and publication in the
manner provided by law.
