AN ORDINANCE
Amending The Zoning Ordinance Of The
City Of Evanston To Deal With Roof
Mounted Mechanical Equipment And
Off -Street Parking Areas As They
Relate To Floor Area Requirements
WHEREAS, on October 2, 1975 and continuing on June 9,
July 7, August 4., and November 3, 1977 the Zoning Amendment Com-
mittee considered amendments to the Zoning Ordinance of the City
of Evanston, 1960, to clarify the definition and application of
the term Floor Area (Gross Floor Area) as it is applied in the
various sections of the Zoning Ordinance and as it relates to
roof mounted mechanical equipment and off-street parking areas,
• all of which consideration was conducted at public hearings pur-
suant to notice and publications thereof in the manner provided
by law; and
WHEREAS, the Zoning Amendment Committee has recommended
certain amendments to Section III "Definitions" and Section IV.N.3
of the Z.oning Ordinance as a result of the aforesaid public deli-
beration:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS AS FOLLOWS:
. Section 1: That Article III of the Zoning Ordinance of
1960 as amended be further amended by amend-

ing the definitions of Floor Area (Gross Floor Area); Basement;
• Cellar; Floor Area for determining off-street parking and loading

requirements; Building, Height of; and Story, Half; which defini-
tions shall read as follows:
"Basement. A portion of a building located partly
underground but having less than half its clear floor -
to -joist height below the average grade of the adjoin-
ing ground. (See Cellar).
"Building, Height Of. The perpendicular distance
at the center of a building's principal front mea-
sured from the established grade to the high point
of the roof for a flat roof, and to the mean height
level for gable, hip, or gambrel roofs. Chimneys
and spires shall not be included in calculating the
height. The height of any story of a building shall
be excluded from the calculation of building height
when 75% or more of the gross floor area of said
story consists of parking required for the building.
"Cellar. The portion of a building located partly
or wholly underground and having half or more than
half of its clear floor -to -joist height below the

average grade of the adjoining ground.
"Floor Area (Gross Floor Area) - for the purpose
of determining the floor area ratio and conversions
of existing structures. The sum of the gross hori-
zontal areas of the several floors of a building,
except a cellar floor, measured from the exterior
faces of the exterior walls or.from the centerline
of walls separating two buildings. The "floor
area" of a building shall also include, but not be
limited to, basements, elevator shafts and stair-
wells at each floor; floor space used for mechanical,
electrical, heating or air conditioning equipment,
including equipment open or enclosed, located on
the roof; penthouses; all attic space, finished or
unfinished, having 5 feet or more space from floor
to rafters; interior balconies and mezzanines; en-
closed porches or porches covered by a roof suitable
for covering a habitable room; and floor space de-
voted to accessory uses, provided, however, that
any space devoted to required off-street parking
or loading for the building shall not be included
in "floor area".

"Floor Area for determining o.ff-street parking and
• loading requirements. The sum of the gross horizon-
tal area of the several floors of a building. This
area shall exclude such floor area used for required
off-street parking and loading facilities for the
building in which they are located, and such basement
and cellar floor areas that are devoted exclusively
to uses accessory to the building itself, not those
accessory to the uses of occupants. All horizontal
dimensions shall be measured from the exterior faces
of the exterior walls or from center line of walls
separating two buildings.
"Story, Half. A space under a sloping roof which
has the line of intersection for roof decking and
wall not more than three feet above the top floor
level, and in which space not more than 60% of the
gross horizontal floor area is five feet or more in
height, measured from floor to rafters."
SECTION ?: That Section IV.N.3 of the Zoning Ordinance,
1960 as amended, be further amended to read
• as follows:
"IV.N3. Where a building is non -conforming in
respect to height, bulk, lot area per dwelling unit,
required yards of off-street parking, no conversion
shall be permitted, unless said building is brought
into conformity with all applicable requirements of
this ordinance, provided that changing accessory resi-
dential space to principal residential space without
adding a dwelling unit shall not be deemed such a
conversion. Unfinished attic space may be finished
without being deemed to create or increase a non-
conforming condition, provided the space is not used
to create an additional dwelling unit."
SECTION 3: All ordinances or parts of ordinance in
conflict herewith are hereby repealed.
• SECTION 4: This ordinance shall be in full force and

effect from and after its passage, approval,
• and publication in the manner provided by law.
