HomeMy WebLinkAboutORDINANCES-1978-020-O-78i i 2/2/78 4/20/78 4/26/78 j 5/25/78 I 20-0-78 i • AN ORDINANCE • Establishing A Board Of Ethics WHEREAS, the City Council of the City of Evanston recog- nizes that government functions best when there is public trust; and WHEREAS, the City Council of the City of Evanston deems I It appropriate and useful to establish a Board of Ethics to con- sider and recommend guidelines for conduct by public officials; i -and j WHEREAS, the development of a code of Ethical Conduct is F considered desirable and useful to the conduct of municipal i business; i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the Code of the City of Evanston, 1957 i I as amended, be further amended by adding to Chapter 2 thereof Section 2-250, Section 2-251, and Section 2-252 i which shall read as follows: "Section 2-250. Board of Ethics - Creation. i There is hereby established the Evanston Board f i • • 20-0-78 of Ethics which shall consist of three (3) members appointed by the Mayor with the advice and consent of the City Council to terms of three (3) years pro- vided, however, that one member shall be initially appointed for a one (1) year term, one member shall be initially appointed for a two (2) year term, and one member shall be initially appointed for a three (3) year term. The mayor shall designate the Chair- man. No member shall serve more than two (2) consec- utive full three (3) year terms. "Section 2-251. Board of Ethics - Purpose. The purpose of the Board of Ethics shall be as follows: (a) To secure and maintain financial disclosure and affiliation statements from those persons re- quired to file such a statement; (b) To develop and recommend to the City Coucil a Code of Conduct applicable to public officials; (c) To evaluate, make findings of fact, and issue advisory opinions for the City Council on questions of possible unethical conduct or con- flict of interest. Such deliberations may be initiated by the Board or upon request, given due cause; (d) To consider related issues in additon to ref- erences from the City Council; and (e) To develop rules and procedures to govern its own conduct of business. The Board of Ethics shall report to the Committee on Committees of the City Council as needed, or at least, ' annually. "Section 2-252. Financial Disclosure and Affiliation Statement. I (a) All elected officials, the City Manager, the Deputy City Manager, Department Heads, and mem- bers and executive staff of all boards, commis- sions, special committees, and those persons i holding other positions designated by the City Council or the City Manager shall submit annually j a signed and notarized financial disclosure and I affiliation statement. Except that, any current- ly serving member of any board, commission or I; special committee shall be exempt from provisions j of this ordinance.until his or her reappointment. -2- 20-0-78 Said statement shall be submitted to the City Clerk by those required to submit same prior to their taking office or being seated as a mem- ber of the pertinent boards or commissions, and • thereafter annually on May 1 during their ten- ` ure with the City of Evanston. Disclosure state- ments shall be destroyed annually upon receipt of a newly filed statement or no later than the j May 1st following the completion of a term of service. (b) Persons required to submit a disclosure and af- filiation statement shall answer the following questions on a form to be supplied by the City Clerk: 1) The addresses of all Evanston real estate (other than your residence) or the title of land trusts, of which you and/or your spouse have a financial ownership or interest. 2) The name(s) of any entities doing business with the City of Evanston or the Township of the City of Evanston in which you and/or your spouse have an element of ownership. 3) The name(s) and address(es) of business own- ership, (partnership or interest, in Illinois) in which you and/or your spouse have an in- vestment having a value in excess of $1,000, which are located in Evanston or do business with the City of Evanston or the Township of j the City of Evanston. 4) The name(s) of those organizations and and/or institutions that receive funds or direct ser- vices from the City in which you are an Of- ficer, Board Member or Trustee. + 5) The name and address of the employer of you and/or your spouse. (c) The disclosure statements of elected officials I and the City Manager will be maintained "on file 1 with the City Clerk and the Board of Ethics. Statements are available for review by the general i public upon specific request to the City Clerk dur- ing regular business hours. When a request for viewing of an ethics statement is made, the person whose ethics statement is requested shall be no- tified and the person viewing his or her statement named. • (d) The disclosure statements of all members of boards, commission, and committees shall be filed, reviewed, and maintained in confidence by the Board of Ethics. (e) The disclosure statements of the Deputy City Mana- ger, Department Heads, executive staff of boards, I -3- 20-0-78 • • commissions, and committees shall be filed, re- viewed, and maintained in confidence by the City Manager. Upon request, the Board of Ethics may review in confidence these statements." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
