HomeMy WebLinkAboutORDINANCES-1978-007-O-78:v • 1/5/78, 1/31/78, 2/3/78 7-0-78 AN ORDINANCE Amending Section XII Of The Evanston Zoning Ordinance Regarding The Responsibilities Of The Director WHEREAS, on December 4, 1975 the Zoning Amendment Committee of the City of Evanston conducted a public hearing on the question of advising appli- cants for building permits of the existence of the applicability of housing and licensing requirements, which public hearing was conducted pursuant to notice and publication thereof as required by law and continued from time to time thereafter; and • WHEREAS, the Zoning Amendment Committee finds it advisable to amend the sections of the Zoning Ordinance relative to the responsibilities of the director to advise applicants of the existing ordinances and regulations affecting the matter for which a permit is sought: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section XII A.l.a of the Zoning Ordinance of the City of Evanston, 1960, as amended, be further amended to read as follows: "a. receive applications for building or erection permits for the construction, erection, alteration, enlargement, and re- moval of buildings, structures, and signs; receive applications is or permits of any premises for a.parking lot, open sales lot, or other purposes where a building permit is not required; notify applicants of all City ordinances pertaining to said ap- plications, and advise applicants that there may be regulations of other governmental authorities with which they must comply (failure to provide said notification shall not relieve the applicant of the responsibility of complying with the law, nor prejudice the rights of the City to enforce the law); issue 7-0-78 • permits applied for as soon as practicable where the plans p are found to comply with the provisions of this ordinance and all other City (laws and) ordinances applicable thereto; make and maintain records thereon;" SECTION 2: That Section XII A.l.b of the Zoning Ordinance of the City of Evanston, 1960, as amended, be further amended to read as follows: "b. receive applications for certificates of use and occu- pancy for buildings, structures, and signs, for which build- ing or erection permits have been issued, and which have been constructed, erected, altered, enlarged, or moved in accor- dance with such permits and are ready for use and occupancy; receive applications for certificates of use and occupancy for any premises developed or improved as a parking lot, open sales lot, or other purposes where a building permit is not required; notify applicants of City ordinances pertaining to said applications, and advise applicants that there may be • regulations of other governmental authorities with which they must comply (failure to provide said notification shall not relieve the applicant of the responsibility of complying with the law, nor prejudice the rights of the City to enforce its laws); issue certificates of use and occupancy applied for as soon as possible after verification of each written applica- tion;" • SECTION 3: That Section XII B.1 of the Zoning Ordinance of the City of Evanston, 1960, as amended, be further amended so as to substitute the following for the parenthetical note at the end of the Section: "Note --Other City ordinances which are applicable to building, erection development and removal permits include,but are not limited to, the building codes, fire codes, sign ordinance, and air pollution code. There may also be regulations of other governmental authorities which apply to a proposal." SECTION 4: All ordinances or parts of ordinances in conflict here- with are hereby repealed. -2- • 7-0-78 SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
