HomeMy WebLinkAboutORDINANCES-1978-006-O-78• 1/9/78 . • : AN ORDINANCE Restricting Parkway Plantings WHEREAS, the residents of the City of Evanston frequently wish to improve their neighborhoods by contributing and maintaining plantings in parkway areas; and WHEREAS, vehicular and pedestrian safety requires cer- tain prohibitions as to trees and restrictions as to height of other plantings so that motorists' view is not obstructed: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVA NSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 45-16 of the Municipal Code of the City of Evanston be and hereby is amender to read as follows - "Section 45-16.1. Plantings Prohibited in Certain Places. No tree shall be planted in parkways or streets unless at a distance of at least eight (8) feet from any cross or intersecting street or alley. It shall be unlawful to plant, install or maintain any shrub in the parkway of any street that is not on the list of approved shrubs developed by the municipal arbor- ist. It shall be unlawful to plant or install any shrub without first obtaining a permit from the di- rector of public works. r "Section 45-16.2. Arborist - Approved Shrub List. The municipal arborist is hereby authorized and empowered to develop a list of shrubs approved for planting in the parkways of any street in Evanston and for which permits provided for in Section 45-16.1 shall be issued. Said list shall be limited to shrubs that do not exceed a maximum overall growth height of three (3) feet and that in addition do not require profes- sional maintenance by City parks or forestry person- nel. Said list shall be published once each week for three (3) consecutive weeks and permits, once issued, shall not be subject to subsequent deletions of any species then planted from lists valid at the time of issuance of those permits. "Section 45-16.3. Planting Permits Required. Permits issued under this Section shall contain a description of the proposed location of the plant- ing, type of planting, nature of maintenance required and a statement of intent by applicant to maintain said plantings, for a minimum of three (3) yeacs. Permits shall be issued without a fee therefor." SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This.ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
