AN ORDINANCE
Certifying A Redevelopment Project
For The Clark -Benson Site
WHEREAS, the Business District Redevelopment Commission has been
charged with the responsibility of encouraging the revitalization, redevelop-
ment, and renovation of the business districts of the City; and
WHEREAS, the central business district has been designated a certi-
fied business district as defined in Section 2-218 of the Code of the City of
Evanston, 1957, as amended; and
WHEREAS, the Business District Redevelopment Commission has
solicited development proposals for the parcel of property bounded by Clark
Street, Benson Avenue, Elgin Road and Sherman Avenue; and
WHEREAS, the Business District Redevelopment Commission has pre -
rented to the City Council of the City of Evanston a proposal for the develop-
ment of the parcel herein identified; and
WHEREAS, the Business District Redevelopment Commission has found and
the City Council of the City of Evanston does find, that such development pro-
posal and the materials in support thereof meet the criteria for such proposals
set forth in Section 2-224 of the Code of the City of Evanston,1957, as amended,
and further that the proposal has been presented at public hearings conducted
on October 16, 1978 pursuant to notice and publication thereof in,the manner
provided by law; and

WHEREAS, the Business District Redevelopment Commission recommends
ithat the proposal as described below and containing the elements set forth
herein be certified as a Certified Redevelopment Project pursuant to section
E
2-224 of the Code of the City of Evanston;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That a multi -use development project for Clark Street i
and Benson Avenue recommended by the Business District
I
Redevelopment Commission to consist of an office building, residential units,
shopping arcades, and parking, and as further described in (a) through (g)
below shall be and hereby is designated a Certified Redevelopment Project:
(a) Said project will provide for two (2) primary land
uses: a minimum of 140,000 sq. ft. of office com-
mercial rental space, and a residential building
with a minimum of 85 condominium units;
(b) Supporting uses will include retail shopping space
to cover at least 19,000 sq. ft., a health/sport
facility with at least a pool and racquetball court;
restaurants and a publicly available luncheon/dinner
club;
(c) That the project will cover a building site for the
commercial, retail, and residential components not
more than 67,000 sq. ft.;
(d) That the project will further contain a parking site '
not less than 32,000 sq. ft. containing at least 436 I
parking spaces;
(e) That the privately owned approximately 67,000 sq.
ft. building site shall be sold by the City.
(f) That the project will contain landscaped areas with
clusters of shade trees and will treat outdoor areas
and the public right of way surfaces and street fur-
niture in a manner compatible in design and mater-
ials -to the existing streetscaped standards in the
downtown special service district; and
(g) That the project will be constructed within 18
months from the time of final approval of plans and j
• specifications for construction.

SECTION 2: That the Business District Redevelopment Commission
operating through the City Manager and his designated

staff shall"be and hereby is authorized and directed to:
1.
Initiate, as the City's agent, any and all proceed-
ings for the acquisition of real and personal property
for the purpose of such project, but only as to prop-
erty specifically described in the ordinance or in the
City Council's instrument of direction.
2.
Recommend that the City Council acquire, manage, and
convey real and personal property pursuant to such a
project.
3.
Apply for and accept any funding from public or pri-
vate sources related to the development and construc-
tion of said project.
4.
Enter into contracts with any public or private agency
or person, including contracts for the independent
financial guarantee for the proposal.
5.
Sell, trade, lease or improve acquired property in
conjunction with such project.
6.
Employ all necessary persons for the planning, execu-
tion and implementation of a business redevelopment
project.
7.
Improve, remove, demolish or otherwise alter acquired

structures as part of such a project.
8.
Conduct any and all additional negotiations relating
to the development and construction in conformance with
the guidelines indicated in the redevelopment proposal
of the City of Evanston's Business District Redevelop-
ment Commission for the Clark Street -Benson Avenue site
dated October, 1978.
Any.sale, lease, trade or other conveyance of acquired real or personal prop-
erty pursuant to the directive above shall be in accordance with the provisions
relating to the sale or lease of property of the City Code of the City of
Evanston.
SECTION 3: This ordinance shall be in full force and effect from
