AN ORDINANCE
Amending Section 27-9.5 Of The
Code Of The City Of Evanston
Concerning Parade Permits
WHEREAS, it is the intention of the City Council of the City of
Evanston to preserve the right of free speech and the right of assembly as
guaranteed by the First and Fourteenth Amendments to the United States
Constitution;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Section 27-9.5 of the Code of the City of Evanston,
1957, as amended, providing for the issuance of permits
for processions and parades as amended,be further amended as follows:
"Sec. 27-9.5(a) When permits are required for funerals and
processions.
No procession or parade, excepting a funeral procession,
forces of the U.S. Army and Navy, the military forces of the
State, and forces of the Department of Police and the Fire De-
partment of the City shall occupy, march or proceed along any,
street except in accordance with a permit issued by the City
Manager or his designee in conformity with such other regula-
tions as are set forth in this chapter. Nothing in this ordi-
nance shall apply to processions or parades which utilize the
sidewalks rather than the street.
A person seeking issuance of a parade permit shall file
an application with the City Manager on forms provided by the
City Manager for such purpose. Such application shall be filed
not less than 10 days nor more than 365 days before the date on
which it is proposed to conduct the parade. The application
for a parade permit shall set forth the following information:
(a) the name, address and telephone number of the
person seeking to conduct such parade;
(b) if the parade is proposed to be conducted for,
on behalf of, or by an organization, the name,
address and telephone number of the headquarters
of the organization, and of the authorized and
responsible heads of such organization;
(c) the name, address and telephone number of the
person who will be the parade chairman and who
• will be responsible for its conduct;
(d) the date when the parade is to be conducted;
• (e) the route to be traveled, the starting point and
the termination point;
(f) the approximate number of persons who, and ani-
mals and vehicles which, will constitute such
parade; the type of animals, and description of
the vehicles;

(g) the hours when such parade will start and ter-
minate;
(h) a statement as to whether the parade will occupy
all or only a portion of the width of the streets
proposed to be traversed;
(i) the location by streets of any assembly areas for
such parade;
(j) the time at which units of the parade will begin
to assemble at any such assembly area or areas;
(k) the interval of space to be maintained between
units of such parade;
(1) if the application for a parade permit is made by
an agent rather than the individual responsible
for the parade, the applicant shall file with the
City Manager a written statement authorizing the
agent to act on behalf of the applicant. This
provision shall not apply to a duly authorized of-
ficer of an organization which complies with sub-
paragraph (b) of this section;
(m) any additional information which the City Manager
shall find reasonably necessary to fairly evaluate
as to whether a permit should issue.
"Sec. 27-9.5(b)
The City Manager or his designee shall approve or disapprove
all applications for parade permits in writing. A parade permit
shall be issued if it is found that:
(1) the conduct of the parade will not substantially inter-
rupt the safe and orderly movement of pedestrian and vehicular
traffic on and contiguous to its route or unreasonably interfere
with the rights of other persons who utilize the public ways;
(2) the conduct of the parade will not tend to cause or pro-
mote a breach of the peace, cause injury to persons or property,
provoke disorderly conduct or create a public nuisance;
(3) the purpose of the parade is not unlawful;
(4) the conduct of the parade will not unreasonably affect or
interrupt business and commerce within the area to be traversed;

"The City
Manager will report to the City Council on the deci-
sion
as to each
application for a parade permit. A denial of an
application
for
a parade permit may be appealed in writing to the
Human
Services
Committee of the City Council within a reasonable
time
after its
denial.
"Incident to the conduct of a parade for which a permit has
been issued, the City shall provide such services, and only such
services, as are deemed necessary by the City Manager to promote
public safety and order."
SECTION 2: All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
SECTION 3: This ordinance shall be in full force and effect from
and after its passage, approval, and publication in
the manner provided by law.
