HomeMy WebLinkAboutORDINANCES-1978-088-O-787 I, - 10/13/78 AN ORDINANCE Granting A Special Use To Amend And Alter A Planned Development Permit Construction Of A Pedestrian Bridge At The State Bank Plaza WHEREAS, the Zoning Board of Appeals on August 15, 1978 and September 19, 1978 conducted a public hearing upon the application of Washington National Insurance Company seeking to amend a planned development granted and constructed pursuant to Ordinance 50-0-67 to permit the alteration of the exterior of such development by the construction of a pedestrian bridge between the planned development property known as State Bank Plaza and 1630 Chicago Avenue, which is not a part of said planned development, pursuant to notice and publication thereof, all in accordance with,law; and WHEREAS, the Zoning Board of Appeals recommended the grant of such amendment to the planned development; and WHEREAS, the Zoning Board of Appeals has found, and the City Council of the City of Evanston finds, the facts to be as follows: The proposed alteration and amendment: (a) is a special use in the B-4 and B-5 Districts in which the existing planned development is found; (b) is compatible with the development allowed under the basic provisions of the Zoning Ordinance in the area in which it is proposed and is not of such a nature in height, bulk, or scale as to exercise any influence contrary to the purpose and intent of the Zoning Ordi- nance as specifically set forth in Section II based on the fact that it will contribute to the public safety and welfare and avoid or lessen tire congestion on the public streets; (c) is compatible with, and implements the planning goals and objectives of the City, as contained in the com- prehensive plan and other pertinent policy resolutions as follows: 1 17 1. the proposal will implement one policy from the comprehensive general plan which is to "separate pedestrian and vehicular traffic wherever possible in order.to enhance the movement of each." 2. the proposed amendment would add only 356 square feet of floor area which in our opin- ion is not inconsistent with land use inten- sity objectives. 3. the proposed neither advances nor detracts from the housing goals of the City since there is no housing element involved. 4. because no housing element is involved in the proposal there will be no impact on popula- tion policies. 5. the proposed amendment will not create addi- tional traffic or parking demand, and by separating pedestrian traffic on the proposed walkway from vehicular traffic in the alley, the circulation of both should be improved. 6. the proposal should have no adverse impact on schools. 7. the proposal will not alter the essential character of the neighborhood since it is not of sufficient size to significantly effect the character of the area. 8. the proposal neither advances nor detracts from neighborhood planning goals. 9. the proposal will not reduce the present tax base. d be completed within two 2 ( ) p ( ) years of granting the per- mit. The applicant has indicated in his submittal that only approximately ninety (90) days would be necessary for completion of this proposal. (e) will have no adverse effect with respect to traffic on the public streets. (f) can be adequately served by the existing utility service. (g) is proposed by an applicant which demonstrates more than adequate financial resources to assure completion there- of. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: -2- SECTION 1: That based upon the findings of fact recited herein the application of Washington National Insurance Company for a special use permit to amend a special use permit granted by Ordinance 50-0-67, in order to construct a pedestrian bridge joining the existing structure constructed as a planned development commonly known as State Bank Plaza upon the property legally described as follows: Parcel 1: Lots 2, 3, 4, and 5 in Subdivision of Lots 8 and 9 in Block 19 in Evanston in Section 18, Town- ship 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois, together with all of the 16 foot vacated alley lying northerly of and adjoining said Lots 2, 3, 4, and �_ (except for the northerly 15 feet of said Lot 5) in Block 19.in Evan- ston in Section 18, Township 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois. Parcel 2: Lots 6 and 7 in Block 19 in Evanston in Section 18, Township 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois and Lot 1 in the Subdivision of Lots 8 and 9 in Block 19 in Evanston in Section 18, Townsip 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois, together with all of the 16 foot vacated al- ley lying northerly.of and adjoining said Lot 1. Parcel 3: Lot 4 and the northerly 15 feet of Lot 5 in Block 19 in Evanston in Section 18, Township 41 North, Range 14 East of the Third Principal Meridian in Cook County, Illinois. 615-35 Davis Street: The West 90 feet of Lots 10 and 11 in Block 19 in the Village (now City) of Evanston in Section 18, Township 41 North, Range 14, East of the Third Principal Meridian, in Cook County, Illinois. be and is granted subject to the following conditions: (a) that the proposed structure substantially conform to the plans submitted to the Zoning Board of Appeals and identified as Exhibit 4. (b) that the applicant conform to the requirements of law regulating the use of space above a public way. (c) that the plan conform to all other conditions of the Zoning Ordinance and all other applicable laws. -3- SECTION 2: The Director of Inspections and Permits is hereby Directed to issue the special use permits required to implement the provisions of this Ordinance subject only to the conditions hereby imposed. SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
