AN ORDINANCE
i
Amending The Provision Of The
Municipal Code Pertaining To The
Evanston Preservation Commission
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the Code of the City of Evanston, 1957, as amended,
be further amended by amending Sections 2-200 through
11 2-207 to read as follows:
112-200. Creation of Commission.
There is hereby created the Evanston Preservation Commission
composed of eleven (11) members including a chairman, each of whom
shall serve without compensation.
"2-201. Appointment and Term of Office.
The chairman and members of the Commission small be appointed
by the Mayor, with the advice and consent of the City Council.
Such appointments shall be for a term of three (3) years, provided
that three (3) of these appointments shall be for an initial term
of one (1) year, four (4) appointments for an initial term of two
(2) years, and four (4) appointments for an initial term of three
(3) years. Commissioners shall not be eligible to serve more
than two (2) consecutive full terms. Regular member's terms
shall commence on January lst. Any vacancy shall be filled in
like manner to an original appointment and shall be for the bal-
ance of the term of the vacated office. Members shall continue
to serve until their successors are appointed and confirmed. Any
member may be removed by the Mayor for failure to regularly
attend meetings or for inattention to duties. All Commissioners

shall .be residents of the City of Evanston. Each Commissioner
• shall have one vote. A Chairman and Vice -Chairman shall be
elected at the December meeting, shall take office January 1st,
and shall serve for a term of one (1) year. Each may be re-
elected.
"2-202. Ex Officio and Associate Members of the Commission.
In addition to the members of the Commission appointed pur-
suant to Article 2-201, the following persons shall be deemed ex
officio members of the Commission, to serve, without compensa-
tion, therefor, as non -voting members: the Mayor, a member of

i the Planning and Development Committee of the City Council, a
�( member of the Evanston Plan Commission, the Director of Planning,
the Director of the Department of Inspections and Permits, and
• the Director of Public Works. In addition to those members who
serve by virtue of their respective offices, the Commission may
from time to time elect associate members to the Commission
jwhose expertise and interest in specific or generalized areas
shall be deemed necessary or desirable to further the work of
the Commission. Said associate members shall serve for a per-
iod of one (1) year, shall be non -voting members, shall be

eligible for re-election, shall be residents of the City, and
shall serve without compensation.
"2-203. Purpose and Goals of the Commission.
i It shall be the purpose of the Commission to identify and
evaluate the historic resources and elements of fine visual and
physical character of the City of Evanston; to propose conser-
vation districts based on such. evaluations and relevant planning
�! consideration; to propose detailed preservation or urban conser-
vation programs for such districts; to review these specific

preservation problems affecting
those buildings
listed in Sched-
ule B, as amended from time to
time, and to make
recommendations
pertaining to them; to conduct the temporary review procedures
established in Section 2-205; and to encourage interest and
understanding of preservation and urban conservation.

"2-204. Duties of the Commission.
The Commission shall:
(a) Carry out for each Intensive Study Area identi-
fied in Schedule A, as amended from time to time,
attached hereto and made a part hereof, a pres-
ervation survey and evaluation process in accor-
dance with the criteria listed herein and report
Evanston Landmark recommendations to the City
Council and the public, as each area is completed;
(b) Identify additional areas of the City for similar
• survey and evaluation;
(c) Prepare field survey and data collection systems,
evaluative criteria, a volunteer training
program, training aids and field materials neces-
sary to carry out the foregoing survey with max-
imum utilization of volunteers;
(d) Create a data base and retrieval system suitable
for use in planning, review, decision -making,
and public information programs;
(e) Utilize the advice of qualified experts (who
need not be members of the Commission) in making
final evaluative judgments and in formulating
program recommendations for the City Council;
(f) Propose conservation districts based on preser-
vation evaluations and relevant planning con-
sideration;
(g) Propose specific preservation programs for City
Council consideration;
(h) Involve departments of City government and in-
terested members of the community as much as
possible in its work and encourage complementary
activity with other agencies and organizations;
• (i) Carry out a public information program including
the preparation of appropriate exhibits and
publications.

"2-205. Review Procedure.
In addition to the duties established in Section 2-204, the
Commission shall establish and conduct an advisory review proce-
dure of all demolition permit applications, building permit ap-
plications, and applications or petitions to administrative or
legislative bodies related to exterior alterations of those
structures enumerated in Schedule B, as amended, attached hereto
and made a part hereof. The Commission shall also conduct an
advisory review of proposed action by the City which would per-
manently alter the existing natural and/or structural elements
of an intensive study area identified in Schedule A, as amended.
The review procedure outlined in this section shall be under-
taken and administered by the Preservation Commission until
terminated or supplanted by action of the City Council.

(a) External Alteration Review - Upon receipt of an
application -for a demolition or building permit
or an application or petition to any administra-
tive or legislative body related to work upon
the exterior of a structure listed in Schedule B,
as amended, the Department of Inspections and
Permits, within five (5) days, shall advise the
applicant of this review and forward a copy of
such application together with plans pertaining
thereto to the Commission.
The Commission shall consider the extent to which
the proposed action may be consistent or inconsis-
tent with preservation of the distinctive physical
characteristics of significant structures or areas
affected, and with the maintenance of external
conditions which affect the long-term viability of
those structures or areas. If the proposed alter-
ations appear to adversly affect the purposes and
goals of the ordinance, the Commission shall re-
quest a conference with the applicant. Any delay
by the applicant in complying with such request
shall be added to the time allowed for comment by
the Commission. The Committee shall determine its
recommendations and transmit them, in writing, to
• the applicant, and attempt to work out a mutually
satisfactory solution. The review shall be com-
pleted within sixty (60) days of receipt by the
City of the application, after which time the
Department of Inspections and Permits shall grant
or deny the application, as originally submitted
or as amended, on its merits. A final report shall

I be sent to the applicant, the City Council, and to
• any legislative or administrative body before which
the application must be considered.

These review procedures shall not prevail over other
laws or regulations regarding structural and fire
safety.
j (b) Intensive Study Area Review - Before any action by
I the City (or any agency thereof) which, if imple-
mented, would permanently alter the existing natural
or structural elements of an intensive study area,
including street lighting poles, lamps or fittings,
the City shall cause a written copy of description
of such proposal, together with relevant supportive
documentation, to be transmitted to the Preservation
Commission. Within sixty (60) days after receipt of
the proposal and related information, the Commission
shall forward its recommendation to the referring
body, which shall give them due consideration before
taking definitive action on the matter. Such com-
ments shall be forwarded to the initiating agency and
the City Council and shall be attached to and accom-
pany any applications, reports, or other documenta-
tion submitted to any legislative or administrative
body in connection with the reviewed application or
proposal.
0 "2-206. Designation of Evanston Landmarks.

The Commission shall review and evaluate potential Evanston
Landmark structures according to the following criteria:
In order to be designated an Evanston Landmark, a structure must
be at least 25 years old and must meet one or more of the following
I criteria:
Criteria of Historical Importance.
(a) Exemplify the cultural, political, economic, or
social heritage of Evanston; or
(b) Be the site of an historic event 25 years in the
past; or
(c) Be associated with a nationally, regionally, or
locally prominent person or organization deceased
25 years.
When a person or event of national or international signi-
ficance, or which has an undeniably important place in
Evanston history becomes associated with a structure or
place which is in clear and present danger of radical al-
teration or demolition, the 25 year limit may be waived.

• Criteria of Architectural Importance
(a) Exhibit a high quality of architectural design
without regard to the time built or historic
associations; or
(b) Exemplify the work of a nationally or interna-
tionally known architect, or major local archi-
tect or master builder; or
(c) Exhibit a high quality of architectural design
that is the result of a change or a series of
changes in an original structure; or
(d) Exemplify an architectural style, consturction
technique, or building type once common in the
City; or
(e) Exhibit an unusual, distinctive or eccentric de-
sign or construction technique which contributes
to the architectural interest of its environs as
an accent or counterpoint.
(f) Selected for inclusion on the 1972 Illinois
Historic Structures Survey.
• In addition, certain places which have long provided an estab-
lished and familiar visual feature in Evanston by virtue of their
unique location, distinctive physical characteristics or historic
association, may be designated Evanston Landmarks.
In making decisions about which sites qualify as Evanston
Landmarks, which do not, and which are eligible for national recog-
nition, the Preservation Commission shall deal with: the age of
structures; verifiable fact; events, people, and structures with
associative value; integrity of the site; and integrity of design.
The Commission shall periodically present to the City Council
recommendations for Evanston Landmark sites. The City Council may
approve or reject such sites either individually or collectively.
(dominations of Evanston Landmarks may be made to the Commis-
sion by individuals or groups. The Commission may recommend to
the City Council that Evanston Landmarks be removed from the list
for inappropriate exterior alterations or through demolition.

• The Commission shall maintain a current list of Evanston
Landmark structures and shall see that this list is forwarded to
appropriate City departments and agencies.
"2-207. Powers.
The Commission shall meet at least once a month and shall have
the following powers:
(a) To establish rules and regulations governing its
operation not inconsistent with the provisions of
this ordinance.
(b). To establish subcommittees to deal with specific
subareas under consideration.
(c) To enlist special assistance in matters requiring
particular expertise.
• (d) To conduct public hearings.
(e) To prepare and issue publications.
(f) To conduct public information programs to increase
public awareness of the Commission's purpose,
goals and work.
(g) To assist officials of special districts and other
units of local government by providing a preserva-
tion evaluation on matters affecting the develop-
ment or redevelopment of the City.
(h) To prepare and administer budgets and to seek and
accept funds from sources private and public to
pursue the goals of the Commission.
(i) To employ such staff and to contract for such
goods and services necessary to its goals as shall
be approved by the City Council.
(j) To perform such other acts as may be appropriate
to the accomplishment of its purposes and goals.
• "2-208. Interagency Cooperation.
Each City department, Board and Commission shall extend its full
cooperation to the Commission. Each is authorized to provide such
professional and other staff services needed by the Commission as
can be arranged without unreasonable interference in its own work."
