AN ORDINANCE
Amending Section 32-25 And Adding
Section 32-26(b) To The Evanston
City Code, Commonly Known As
The Farmer's Market Ordinance

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK
:AUNTY, ILLI140IS:
i SECTION 1: That Chapter 32 of the Code of the City of Evanston,
1957, as amended, be further amended by amending section
32-25 to read as follows:
• i "32-25. Definitions.
I A farmer's market is a designated area where on
designated days and times, growers and producers may
sell directly to the public in accordance with City
regulations. The City of Evanston shall have the
right to relocate or discontinue the market, to spe-
cify the days and times of its use and to stipulate
what goods may be sold. The Farmer's Market Commis-
sion may allow during the season one different
Evanston charitable organization per market day to
maintain a refreshment stand which could sell non-
alcoholic beverages and home baked products not re-
quiring refrigeration at a designated location within
the Farmer's Market."
SECTION 2: That Chapter 32 of the Code of the City of Evanston, 1957,
as amended, be further amended by renumbering section
32-26 to 32-26(a) and by adding section 32-26(b), Evanston Charitable Organiza-
tions, which sections shall read as follows:
• 1 "32-26(a). Growers and Producers.
A grower or producer is any person offering for
sale articles for human consumption, such as fruits or
their.juices, vegetables, edible grains, nuts and
I berries, apiary products, maple sugars, syrups, refrig-

• erated eggs, and baked products not requiring refrig-
eration or nonedible articles, such as cut or potted
flowers, which articles have been raised or prepared
by the grower or producer, members of his family or

of any other article may be prohibited by the Evanston
Director of Public Health by notice posted prominently
at said market eight (8) days in advance of the effec-
tive date of said prohibition."
"32-26(b). Evanston Charitable Organizations.
Any organization located in Evanston and which has
qualified to be exempt from federal income tax under
I.R.S. Code Section 501c3."
SECTIO14 3: All ordinances or parts of ordinances in conflict here-
with are hereby repealed.
• SECTION 4: This ordinance shall be in full force and effect from
and after its passage, approval, and publication in the
manner provided by law.
