HomeMy WebLinkAboutORDINANCES-1979-049-O-796/4/79 49-0-79 AN ORDINANCE Amending The Evanston Zoning Ordinance I WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings on April 5, 1979, May 3, 1979, and May 12, 1979 on proposed amend- ments to the Evanston Zoning Ordinance, said public hearings having been con- ducted pursuant to notice and publication thereof in .the manner provided by law; and WHEREAS, the Evanston Zoning Amendment Committee has recommended that such amendments be made; • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Sections 6-4-2, 6-11-1, 6-11-1-1(F), 6-11-1-2, 6-12-4(C), 6-12-5(C), 6-13-4(B)3, and 6-13-4(B)4 of the Evanston 'Zoning Ordinance, adopted November 21, 1960, as amended, be further amended' to read as follows: "6-4-2: ZONING MAP: The location and boundaries of the districts established by this Ordinance are shown on the District Map, dated November 14, 1960, which is incorpor- ated herein and hereby made a part of this Ordinance. The said District Map, together with everything shown thereon and all amendments thereto, shall be as much a part of this Ordinance as though fully set forth and described herein. Certified copies of said District Map shall be filed with the office of the City Clerk, the Director of Inspections and Permits and the Director of Amendments and Appeals, and shall.be open to public reference at all • times during which these offices are open for business. No later than March 31 of each year hereafter a,District Map shall be published clearly showing the location and boundaries of the zoning districts for the preceding cal- endar year; except that, if in any calendar year there are no changes in the location and boundaries -of zoning dis- tricts, no map shall be published for such calendar year. 49-0-79 • 116-11-,1: ENFORCEMENT AND ADMINISTRATIVE OFFICERS: The Director of Inspections and Permits and his authorized representatives are hereby designated to enforce this Ordinance. The Director of Amendments and Appeals and his authorized representatives are hereby designated administrative responsibilities regarding the Zoning Amendment Committee and Zoning Board of Appeals. "6-11-1-1(F): Maintain permanent and current records of official actions on all zoning exception certificates, certificates of inspection, special uses, variations, appeals and applications therefor; "6-11-1-2: DIRECTOR OF AMENDMENTS AND APPEALS: In furtherance of the authority conveyed by this Ordinance and in addition to all other duties designated to him, the Director of Amendments and Appeals and his authorized representatives shall: (A) Receive petitions for proposed zoning amendments and provide such clerical and technical assistance as may be required by the Zoning Amendment Com- mittee in the exercise'of its duties; Is(B) Provide such clerical and technical assistance as may be required by the Board of Appeals in the exercise of its duties; and (C) Maintain permanent and current records of 'all functions of the Department of Amendments and Appeals related to the administration of this Or- dinance, including, but not limited to, official actions on all amendments, petitions, appeals, variations, special uses, planned developments and applications therefor. "6-12-4: (C) A variation or special use permit approved,by the City Council by ordinance shall not be valid after a period of one year, except for planned develop- ments as otherwise set forth in the Zoning Ordinance unless during such period such variation or special use shall be established or unless any required building, development or erection permit for an a p- proved variation or special use is obtained within -this period, after which construction shall pro- ceed to completion within a reasonable time. Said one year period may be extended in writing for • good -cause by the Director of Amendments and Ap- peals or, in the event of a vacancy in that office, by the City Manager or his authorized representa- tive for up to an additional one year, if no other zoning changes affecting the property have been made or are formally pending before the City Council or Zoning Amendment Committee, or said period may be extended by the Council for such time as it shall determine, for good cause shown and without further hearing before the Board. -2- 49-0-79 j f "6-12-5: (C) A variation approved by the Board shall not be valid after a period of one year unless during this period such variation shall be established or unless any re- quired building, development or erection permit for an approved variation is obtained within this period, after which construction shall proceed to completion within a reasonable time. Said one year period may be extended in writing for good cause by the Director of Amendments and Appeals or, in the event of a vacancy in that office, by the City Manager or his authorized representative for up to an additional one year, if no other zoning changes affecting the proper- ty have been made or are formally pending before the City Council or the Zoning Amendment Committee; or said period may be extended by the Council for such time as it shall determine, for good cause shown and without further hearing before the Board. "6-13-4(B): it 3. Filing of Petition: A petition proposing an amend- ment shall be presented to the Director of Amendments • and Appeals for filing. Said Director shall accept for filing all such petitions presented, except that: a. A petition shall not be accepted for filing un- less it meets the requirements of Section 6-13; 0 b. A petition, except a petition presented on be- half of a governmental agency, shall not be accepted for filing unless accompanied by pay- ment of a fee as specified in Section 6-13-7; C. A petition proposing the reclassification of any property shall not be accepted for filing within twelve (12) months after the Zoning Amendment Committee shall have held a public hearing on any other proposed amendment that would, if adopted, have resulted in the same re- classification of all or any part of the same property. "6-13-4(B): 4. Disposition of Petitions: The Director of Amendments and Appeals shall transmit all accepted petitions or copies to the Zoning Amendment Committee." SECTION 2: That Section 6-11-1-1 of the Evanston Zoning Ordinance, adopted November 21, 1960, as amended, be and is hereby further amended by deleting subsection (G) therefrom. -3- I 49-0-79 l SECTION 3: All ordinances or parts of ordinances in conflict here- with are hereby repealed. . I SECTION 4: This ordinance shall be in full force and effect from III and after its passage, approval, and publication in the manner provided by law.
