HomeMy WebLinkAboutORDINANCES-1979-057-O-79• • • 8/20/79 57-0-79 AN ORDINANCE Providing For The Adoption Of An Annual Municipal Budget And For The Appointment Of A Budget Officer WHEREAS, the City of Evanston is a home rule municipality and may, under its home rule powers, legislate independently of state statutory re- quirements in those areas that pertain to its government and affairs, which areas include municipal finance; and WHEREAS, the City Council of the City of Evanston deems it to be in the best interests of the City of Evanston to change its fiscal year, estab- lish a municipal budget officer, and provide for an annual budget procedure; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: Chapter 2 of the Code of the City of Evanston, 1957, as amended, be and hereby is further amended by adding thereto Article XVIII entitled "Budget Policy" which shall be composed of sections 2-248 through 2-555, which sections shall read as follows: "Sec. 2-248. . Fiscal Year. Beginning on March 1, 1980 the fiscal year of the City of Evanston shall commence on March 1 of each year and close on the last day of February of each year. "Sec. 2-249. Passage of the Annual Budget. The annual budget shall be adopted by the City Council of the City of Evanston before the beginning of the fiscal year to which it applies. Passage of the annual budget shall be in lieu of passage of the appropriation ordinance heretofore en- acted annually. The annual budget shall be published in the manner provided for in section 2-254 below. It i 57-0-79 "Sec. 2-250. Budget Officer. There is hereby created the office of Budget Officer. The Budget Officer shall be appointed by the City Manager and shall perform such duties as are assigned by the City Manager. "Sec. 2-251. Compilation and Contents of the Budget. On or before the last day of December of each year, the City Manager shall submit to the City Council an annual municipal bud- get, such budget to contain estimates of revenues available to the municipality for the fiscal year for which the budget is drafted, together with recommended expenditures for the municipal- ity and all of the municipality's departments, commissions, and boards. Revenue estimates and expenditure recommendations shall be presented in a manner which is in conformity with good fiscal management practice. Each budget shall show the specific fund from which each anticipated expenditure shall be made. "Sec. 2-252. Funds for Contingency Purposes. The annual budget may contain money set aside for contin- gency purposes not to exceed ten percent (10%) of the total budget. "Sec. 2-253. Revision of Annual Budget. The municipal Budget Officer, subject to approval by the City Manager, shall have the power to revise the budget within any separate fund as may be required. The corporate authorities, by a vote of two-thirds (2/3) of the members then holding office, shall have the authority to revise the budget by transferring monies from one fund to another or adding to any fund. No revi- sion of the annual budget shall be made increasing the budget in the event monies are not available to do so. "Sec. 2-254. Public Hearing, Notice and Inspection of Budget. At least one (1) public hearing shall be held by the City Council on the tentative annual budget prior to final action by the City Council. Notice of this hearing shall be given by pub- lication in a newspaper having a general circulation in the City at least ten (10) days prior to the time of the public hearing. Copies of the tentative annual budget shall be made available for public inspection in printed or typewritten form in the office of the City Clerk for at least ten (10) days prior to the hearing. After said hearing the tentative budget may be further revised and passed without further notice, inspection or hearing. "Sec. 2-255. Abandonment. This Article may be abandoned only by a vote of two-thirds (2/3) of the corporate authorities then holding office." -2- I 57-0-79 �1 I SECTION 2: All ordinances or parts of ordinances in -conflict here- with are hereby repealed.
