HomeMy WebLinkAboutORDINANCES-1979-069-O-79• 5 8/20/79 69-0-79 AN ORDINANCE An Ordinance Authorizing The Sale By Public Auction Of Personal Property Owned By The City Of Evanston WHEREAS, in the opinion of the corporate authorities of the City of Evanston, it is no longer necessary or useful to or for the best interest of the City of Evanston to retain ownership of the personal property herein- after described; and WHEREAS, it has been determined by the Mayor and City Council of the City of Evanston to sell said personal property at a public auction to be t held on Saturday, October 6, 1979, at 12:00 Noon; and WHEREAS, said lot of personal property is of a value in excess of One Thousand Dollars ($1,000.00); NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL 0r *THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: Pursuant to Section 11-76-4 of the Illinois Municipal Code, Illinois Revised Statutes, Chapter 24, Section 11-76-4, the Mayor and City Council of the City of Evanston find that the following described personal property: I.D. Wagon 331 FD110573G 1965 International Squad Fire Truck now owned by the City of Evanston, is no longer necessary or useful to the I i City of Evanston and the best interests of the City of Evanston will be served by its sale. • SECTION 2: Pursuant to said Section 11-76-4 and Section 2-243 of the Municipal Code of the City of Evanston, as amended, the City Manager is hereby authorized and directed to sell the aforementioned personal property now owned by the City of Evanston at public auction on Saturday, October 6, 1979 at 12:00 Noon at the Public Works Center, 222 North Ridge Avenue, Arlington Heights, Illinois through the auspices of the North- west Municipal Conference. SECTION 3: The City Manager is further authorized and may direct the Northwest Municipal Conference to advertise the sale of the aforementioned personal property in a newspaper published within I the community before the date of said public auction. SECTION 4: Said property shall be sold to the highest bidder • except that no bid which'is less than the minimum price set forth in the list of property to be sold shall be accepted. -2- e • • • SECTION 5: The City Manager is hereby authorized and may direct the Northwest Municipal Conference to enter into an agreement for the sale of said personal property at or above the prices specified. The auction shall be conducted and the auctioneer shall be com- pensated in the manner set forth in the Auction Instructions and Specifica- tions attached hereto and made part of this ordinance. SECTION 6: Upon payment of the full auction price, the City Manager is hereby authorized and directed to convey and transfer title to the aforesaid personal property, to the successful bidder. SECTION 7: This ordinance shall be in full force and effect from and after its passage, by a vote of at least three - fourths (3/4) of the corporate authorities, and approval in the manner pro- vided by law. May 12, 1979 1) There are two Information Sheets (labeled "A" and "B"). Complete any missing information on the cards (excluding the -sale information) and return card "B" in the brown envelope. Place card "A" on the driver's side front window. 2) Complete any missing information on the Sales Agreement. Insure that the sales agreements are in the brown envelope along with the titles. 3) All equipment and vehicles should be delivered by 3:30 P.M. to the Arlington Heights Public Works Center on Friday, May 11, 1979. 4) P1'ease place all keys in the brown envelope and leave in the automobile or with the local staff. 5) One representative from each municipality MUST be present to assist in driving vehicles and for security purposes. 6) A supervisor/director should also be present to autharize sale on the sales agreement and on title transfer. 7) Clean and polished cars make a very favorable impression and increase sales potential. Insure that interiors are swept and presentable. Some hints: • a) Steam clean engines if possible. b) Spray paint air cleaner and certain under -hood areas. c) Clean ashtrays. d) Hubcaps and chrome should be polished if possible. e) Tires should be cleaned and blackened for better contrast. f) Trunks should be clear of debris. g) Under "Remarks" section on the Information Sheets, be honest. The purchasers frequently are local people and we have to live with these people. 8) All expenses will be divided by the number of units proposed for sale. The amount will be deducted from the total per municipality and a check will be forthcoming from the Conference. 9) Review the "General Information Sheet" for auction information. This will be distributed to all parties at the auction. 10) Village amployees may bid on any auction item. 11) Refreshments will be available at the auction site. 12) Advertising will appear Tuesday, Wednesday, Thursday and Friday in all 10 Paddock Papers and all of the Lerner Newspapers for all municipalities. Notices have been sent to all of the used car dealers in the Northwest suburban and Chicago area and to those individuals on our mailing list. 013) Place the flyers in supermarkets, city/village hall or any place where the public will see them. "GET THE CROWD THERE:::" kk 11 SPECIFICATIONS FOR THE SALE OF VEHICLES OWNED BY THE 19UNICIPALITIES OF THE NORTHWEST MUNICIPAL CONFERENCE 1. ORAL BIDS: Oral bids wilt be solicited through public auction commencing at 12:d0 NOGN, Saturday, May 12, 1979. 2. MINIMUM PRICE: Minimum prices shall be established for all vehicles by the rticipating instrumentality prior to the opening of bids. Minimum pricing shall not made public. The amount of any acceptable bid must be equal to or higher than the minimum price established. 3. BIO AWARD AND TRANSFER OF TITLE: Award will be made to the highest bidder, provided his bid is equal to or higher than the minimum price which will be set by the respective municipality prior to bidding. All bid awards and sales by the auctioneer will be binding and final upon both the buyer and seller. Ownership shall transfer to the pur- chaser upon the signing of the Purchase -Sales Agreement which shall be completed after payment for said vehicle. 4.. INSPECTION OF VEHICLES: Vehicles may be inspected .at the Arlington Heights Public Works Center, 222 Ridge Avenue, Arlington Heights, Illinois 60005, from 10:00 A.M. - 12:00 NOON on the day of the auction. Vehicles can not be driven. Engines. can be started up until no later than 11:30 A.M. on the day of the auction. Since bidders dan- not be given the opportunity to drive these vehicles, bidders shall agree that the inspection afforded them is sufficient for them to offer a bid and that any defect discoy ered subsequent to the sale, whether or not known by the seller and whether or not this defect was communicated to the buyer, shall be the sole responsibility of the buyer. 5. WARRANTY: These vehicles have been used for governmental activities, which include police patrol and administrative use, and vary in. age, condition, and mileage. No warranty is therefore made, expressed, or implied, oral or written, as to the ,condition of these vehicles. As such, the vehicles will be sold on an "as is," "where is" basis. 6. MANNER OF PAYMENT: Cash, check, or money order may be used and full payment must be made during or immediately.following the auction activity. All vehicles must be removed Irom the Arlington Heights Public Works Center not later than Tuesday following the icti'on. All vehicles become the sole responsibility of the buyer upon the signing df the Purchase -Sales Agreement (Paragraph 5 above) and the Village of Arlington Heights wit assume no liability whatsoever for any vehicle parked or left on Village Property after the Purchase -Sales Agreement has been signed. 7. PURCHASE AND SALES AGREEMENT: Since both the buyers and the sellers will be regdirec to execute Purchase and Sales Agreements, all buyers must be at least 18 years of age. The Conference reserves the right to reject any bid if Conference deems it is in the bes,, interest of the participants to do so. 8. LICENSE PLATES: It is unlawful to drive a vehicle without license plates. PurcHasev shall be responsible for the cost of license plates as well as the cost of transferring title. Most of these vehicles do not now have license plates. License plates will riot be available for sale on the premises. 9. LIST'OF EQUIPMENT TO BE SOLD: A list of the vehicles to be sold is available at the auction site. Northwest Municipal Conference reserves the right to make changes to or - add additional vehicles to or delete from the list without notice. 10. METHOD OF AWARD: The auctioneer used by the Conference shall have authority to declare a vehicle sold and to designate the party to whom the vehicle has been sold. Such designation shall be made by him to the highest bidder following auctioning of that vehicle. A bid made after the auctioneer has declared that item sold shall be rejected. Any successful bidder failing to pay for a vehicle sold to him or her shall be responsible for any additional expense of reselling that item including the diffei- �n ce between the agreed sale price and the amount realized through resale of that hicle.
