! AN ORDINANCE
'! Adopting The B.O.C.A. Basic Mechanical Code,
�i Third Edition, 1978, By Reference And Amending
Article IV Of Chapter 10 Of The Code Of The
City Of Evanston, 1957.
WHEREAS, the City Council of the City of Evanston is desirous
of adopting as the criteria for materials, construction, alteration, and

installation of mechanical work the B.O.C.A. Basic Mechanical Code,

!� WHEREAS, the City Council of the City of Evanston has caused

50 copies of the aforesaid Code to be kept on file in the office of the
!i City Clerk for public inspection for more than 30 days prior to the
I� adoption of this ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
I CITY OF EVANSTON, COOK COUNTY, ILLINOIS:

1� SECTION 1: That Article IV of Chapter 10 of the Code of the
City of Evanston, 1957, as amended be further amended to read as follows:
"ARTICLE IV - MECHANICAL CODE
10-40 Adoption of B.O.C.A. Basic Plumbinq Code: Pursuant to
the authority granted by Chapter 24, Section 1-2-4 of the
Illinois Revised Statutes and home rule powers, the City of
Evanston hereby adopts by reference as criteria for the materials,
construction, alteration, and installation of mechanical work
the B.O.C.A. Basic Mechancial,Code; Thi rd Edition, 1978. Any said
reference to said code to "administrative authority" or
"building official" shall mean the Director of Inspection and
Permits of the City of Evanston and any reference to "municipality"
shall mean the City of Evanston.

SECTION 2: That Section 10-41 through 10-42 shall be added
to Article IV of Chapter 10 of the Code of the City of Evanston, 1957,
as amended and shall read as follows:
"10-41 Penalty: Any person who shall install, extend, alter,
repair or maintain mechanical systems in or adjacent to buildings
except in conformity with the provisions of the B.O.C.A. Mechanical
Code, 1978, Third Edition as adopted shall be guilty of a violation
punishable by a fine of not less than fifty dollars nor more than
five hundred dollars for each and every offense. Each day that
said violation continues shall be deemed a separate offense."
"10-42 Severability: It is the intention of the City Council
that the provisions of this ordinance and the B.O.C.A. Basic
Mechanical Code are severable and that the invalidity of any
section or part of any section of this ordinance and the Code
hereby adopted shall not affect any other section or portion
of this ordinance or code.
SECTION 3: This ordinance shall be in full force and effect
from and after its passage, approval and publication in the manner
provided by law.
SECTION 4: All ordinancesor parts of ordinances in conflict
I herewith are hereby repealed.
