Basic Plumbing Code Fourth Edition, 1978, by Reference and j further Amending Article III of Chapter 10 of the Code of the City of Evanston, 1957. WHEREAS, The City Council of the City of Evanston considers it in i iithe public interest to adopt as its standard for construction, alteration, ;i !and installation of plumbing work the B.O.C.A. Basic Plumbing Code, Fourth ilEdition, 1978; and WHEREAS, the City Council of the City of Evanston has caused 50 jI !1copies of the aforesaid Code to be kept on file in the office of the City j (!Clerk for public inspection for a period of more than thirty days prior to �ithe adoption of this ordinance; II NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,, COOK COUNTY, ILLINOIS: SECTION 1: That Article III of Chapter 10 of the Code of j I the City of Evanston, 1957, as amended be 1, further amended to read as follows: �i "ARTICLE III PLUMBING CODE �j 10.20. Adoption of the B.O.C.A. Basic Plumbing Code. I I� a) Pursuant to the authority granted by Chapter 24, Section 1-2-4 of the Illinois Revised Statutes and pursuant to its home -1; I� rule powers, the City of Evanston hereby adopts by reference I the B.O.C.A. Basic Plumbing Code, Fourth Edition, 1978, which I� code shall with the below stated additions and amendments !! govern the issuance of permits and the standards of perform- I; ance and materials for the construction, alteration, and I installation of plumbing work in the City of Evanston. I; b) Any reference to "administrative authority," or "building I official" shall mean.,,Ue Director of Inspections and Permits j of the City of Evanston. Any reference to "municipality" i� shall mean the City of Evanston. Fees for the issuance of 1' ,I I' I, I -2- • • I permits to conduct work pursuant to the ordinance shall be in accordance with the schedule of fees established by ordinance of the City Council c) Additions to the B.O.C.A. Basic Plumbing Code P-306.6 Floor drains: The floor of every public water closet or urinal compartment shall be of concrete or other non -absorbent I material and shall be graded to drain into any floor type i urinal, waste opening, or into a floor drain. j P-313 Footing drains: Footing drains shall be connected to sump pumps and discharge shall be made through storm sewers, combination sewers or drainage ditches. No footing drain or drainage tile shall be connected to the sanitary sewer. After December 31, 1970, all construction in new buildings shall conform to the requirements of this paragraph. No building I permit application will be accepted nor any permits issued for construction of any structure in new buildings unless plans and specifications therefore provide for footing drains in j accordance with the requirements of this subparagraph. P-313.1 Window wells: All window wells shall be provided with drains. Window well drains may be connected to the drain tile and drain into the sump pump. P-314 Overhead plumbing: All new buildings erected after December 31, 1970, with basements, floors, rooms or occupancy areas below ground level at the building site and served by a public or private system shall have overhead plumbing. No building permit application will be accepted nor any permits issued for construction of any structure in a new building unless plans and specifications therefore provide for overhead plumbing inaccordance with this section. P-315 Sill cocks: All buildings except accessory buildings shall be provided with two sill cocks. P-702.2 Washing machines: A pan, receptor, or floor drain shall be required for all automatic washing machines. P-1219 Unused or abandoned fixtures: Plumbing fixtures not maintained or used shall be disconnected, removed, and sealed. d) Amendments The following sections of the B.O.C.A. Basic Plumbing Code, 1978 Edition, are amended to read as follows: P-303.2 Public.s,ystems available: A public water supply system and or public sewer system shall be deemed available to premises used for human occupancy if such premises are within 1000 feet, measured along a street, alley, or basement, of the public water supply or sewer systems and a connection conforming with the standards set forth in this code may be made thereto. P-308.3 Freezing: Water service piping and sewers shall be installed below recorded frost penetration, but not less below grade than five (5) feet for water piping and four (4) feet below grade for sewers. Plumbing piping in exterior building walls shall"be adequately protected against freezing by insulation or heat or both. -3- • V ft P-405.1.2 Water service pipe: Water service pipe shall be made of ductile iron pipe, cast iron pipe, copper pipe, or copper tube. Copper tube when used underground shall be "type V and shall be put together with cast bronze flared fittings. P-405.1.3 Water distribution pipe: The water distribution system shall be brass or copper pipe, copper tube, galvanized open hearth iron pipe or galvanized steel pipe. Copper tube shall have a weight of not less than copper water tube 'hype L. P-405.2.3 Building sewer: a. In a trench separate from water service: If the building sewer is installed in a trench separate from the water service, the sewer pipe shall be oaf cast iron, concrete, vitrified clay tile, truss pipe or ductile iron pipe. Joints shall be watertight and root proof. Metropolitan Sanitary District standards shall be followed. b. In trench with water service: If the building sewer is installed in .the same trench as the water service, the conditions of Section P-1602.2.1 shall be met. Metropolitan Sanitary District standards shall be followed. P-1205.5 Rate of flush: All flushometer and/or tank -type urinals shall be of a water conserving nature and operate at a rate not to exceed 3.0 gallons maximum per flush. P-1206.2 Flushometer valves: Flushometers shall be installed so that they will be readily accessible for repair. Flushometer valves shall not be used where the water pressure is insufficient to properly operate them. When the valve is operated, it shall complete the cycle of operation automatically, opening fully and closing positively under the water line pressure. Each flushometer shall be provided with a means for regulating the flow through it at a,rate not to exceed 3.0 gallons per flush. P-1206.3.1 Water for flushing: An adequate quantity of water shall be provided to flush and clean the fixture served. Water supply to flush tanks shall be made in accordance with Section P-1605:0. Pipes, connections and fittings between tanks and water closets or urinals shall be of adequate size to provide sufficient flow for proper flushing and cleaning of the fixtures. Where flush tanks are equipped for manual flushing, they shall be controlled by a float valve or other automatic device designed to refill the tank after each discharge, and to completely shut off the water flow to the tank when the tank is filled to the operational capacity. Provision shall be made to automatically supply water to the fixture so as to refill the trap seal after each flushing. The water supply to flush tanks equipped for automatic flushing shall be controlled by a suitable timi!ng•: device to thus act as a water conserving device and prohibit the valve from remaining in an open position. P-1206.3.2 Flush valves in flush tanks: Flush valve seats in tanks for flushing water closets shall be at least one (1) inch above the flood level rim of the bowl connected thereto, except in approved water closet and flush tank combinations designed so that when the bank is flushed and the fixture is clogged or partially clogged, the flush valve will close tightly so thatthe water will not spill continuously over the rim of the bowl or backflow from the bowl to the tank. Water closets with flush tanks shall be of a water conserving nature and operate at a rate not to exceed 3.5 gallons maximum per flush. P1207.3 Lavatories: The water supply to sinks in public facilities shall be equipped with self -closing faucets which will not permit the unattended faucet to be left in the open position. -4- P-1209.1.1 Shower: Every shower shall be equipped with a �! limited flow shower head of water conserving nature, and operate at a rate not to exceed 3.0 gallons per minute. P-1210.2 Sinks: The water supply to sinks shall be equipped with water saving devices that use aerators plus restrictors to operate at a rate not to exceed 3.0 gallons per minute. • �� e) Application The provisions of the B.O.C.A. Basic Plumbing. Code and the • provisions of this ordinance shall be deemed to apply to all matters concerning the design, installation, alteration, addition, repair, removal, construction, use, location, and maintenance of plumbing systems, sanitary and storm and sewage disposal in servicing existing and proposed buildings or structures in the City. SECTION 2: That Article III of Chapter 10 shall be further amended to add the following iI sections: Section 10.21 Car wash facility: All car wash facilities constructed in the City of Evanston and all replacements of existing fixtures in car wash facilities shall be equipped. with water recycling systems. �i i Section 10.22 Non-metallic pipe materials in water service - Prohibited. Notwithstanding any of the provisions of the I� B.O.C.A. Basic Plumbing Code, 1978 to the contrary, the use it of non-metallic pipe materials in water distribution services I+ is hereby prohibited. I� Section 10.23 Licensed plumbers. No plumbing work of any �kind shall be done in the City of Evanston except in ii compliance with the Illinois Plumbing License Law, Ch. 11-112 ij Section 116.36 to 116.75, 111 Rev. Stats., 1969. j� Section 10.24 Licensed plumber -bond. No licensed plumber shall perform plumbing work in the City of Evanston except for i minor repairs unless prior thereto he shall have on file in the office of the City Clerk, a bond in the sum of $10.000 with I' sureties conditioned upon, among other things, the applicant indemnifying and saving harmless the City of Evanston from all !i claims or damages arising from any negligence and unskillfulness in the execution or protection of his work and from any unfaithful or inadequate work done by virtue of any permit that may be issued to him.by the Department of Inspections and �i Permits, and also if required by the City of Evanston, restoring streets; sidewalks, and pavements over any piping he may lay, anc. �j filling all excavations made by him, so as to leave said streets, sidewalks and pavements in as good state and condition as he found them, and keeping and maintaining the same in �j good order for a reasonable time hereafter, to the satisfaction of the Street Department of the City of Evanston, and further conditioned upon the aforesaid plumber paying all fines that may !` be imposed upon him for any violation of any ordinance, rule �+ or regulation adopted by the municipality, and conforming to all the lawful regulations of the municipality. l j� Section 10.25 Drain layer -certification. No person shall hold himself out to do or engage in the work of drain laying within the City unless prior thereto he shall have applied for and been issued a Drain Layers Certificate by the Director of Inspections and Permits. -5- i Section 10.26 Drain layer -examination prior to certification. The Building Official shall cause an examination to determine I the applicant's qualifications to be conducted by the Plumbing Inspector and the Superintendant of the Sewer Department.from time to time as the demand for certificates may require. Said examiners shall determine from a written examination and an actual demonstration of workmanship each candidate's knowledge and ability to qualify as a certified drain layer. Upon • satisfactory completion of said examination, the Building Official shall authorize the issuance of a drain layer's certificate to successful candidates. Said certificates shall + expire December 31 of the year of issuance. The certificate �{ of qualified drain layers who have performed work satisfactory in character to the Plumbing Inspector and Superintendent of Sewers shall be renewed upon application to the Building Official. Should an applicant fail to pass the examination he may apply for a re-examination upon payment of a second I examination fee of five dollars. Said examination shall not be held sooner than six months following the date of the previous examination and shall be similar in character and Ij thoroughness. Section 10.27 Application and renewal -fees. Applicants shall pay the sum $25 to the City Collector as a certification fee for issuance or renewal of drain layers certificates. Section 10.28 Drain layer -bond. No certified drain layer shall perform work within the City unless prior thereto he shall have filed in the office of the City Clerk a bond in the sum of $10,000 in a form approved by the City Attorney upon sureties approved by the City Clerk conditioned upon the applicant's indemnification of the City from all claims arising out of work performed in the City by virtue of any permit issued, and conditioned upon the restoration of any portion of the public way or excavations made by him to a safe and • presentable condition; and such restorations to be maintained in good order for a reasonable period thereafter, and further conditioned upon the prompt payment of all fines which may be imposed upon him for violating any ordinance of the City; and futher upon the faithful conformance by the drain layer to the regulations of the municipality of the business of drain laying. I� Section 10.29 Penalty. Any person who shall install, extend, alternate, repair or maintain plumbing systems in or j adjacent to buildings except in conformity with the provisions t; of the B.O.C.A. Basic Plumbing Code Fourth Edition, 1978, as adopted shall be guilty of a violation punishable by a fine of not less than twenty-five dollars nor more than five hundred dollars for each offense. Each day that an offense continues shall be deemed a separate offense. I; Section 10.30 Severability. It is the intention of the City (� Council that the provisions of this ordinance and the B.O.C.A. lj Basic Plumbing Code are severable and the invalidity of any section or part of any section of this ordinance and the i code hereby adopted shall not affect any other section or portion of the said ordinance or code. SECTION 3: This ordinance shall be in full force and effect from and after -its passage, approval and publication in the manner provided by law. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
