HomeMy WebLinkAboutORDINANCES-1979-008-O-792/2/79 8 8-0-79 All ORDINANCE Extending The Moratorium On Condominium Conversions For A Period Not To Exceed 30 Days Or Until An Evanston Condominium Ordinance Takes Effect, Whichever Comes First I WHEREAS, the City Council of the City o.f Evanston has imposed a moratorium on condominium conversions pursuant to the provisions of ordinance 69-0-78; and WHEREAS, the City Council of the City of Evanston has extended said moratorium on condominium conversions pursuant to the provisions of 92-0-78; and • WHEREAS, the City Council of the City of Evanston has diligently and extensively considered legislation regulating such conversions; and WHEREAS, the City Council finds that the issues involved in such regulation are complex and have a significant impact upon the general welfare of all the residents of the City of Evanston; and ,WHEREAS, the City Council finds that the proposed regulation will benefit from an additional period of consideration; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the moratorium imposed upon all conversions of existing buildings within the City of Evanston to condo- 0 . . miniurn ownership pursuant to the provisions of ordinances 69-0-78 and 92-0-78 be and hereby is extended for a period not to exceed thirty (30) days from the termination of the existing moratorium imposed by the aforesaid ordinance 92-0-78, or until an Evanston condominium ordinance takes effect, whichever comes first. 11 J SECTION 2: That the developers who had sent notice of intent to con- vert prior to the date of August 7, 1978 shall be allowed to convert provided that said developers agree to meet all provisions still feasible at their stage of development as may be set forth in said prospective condominium ordinance when duly enacted. Each such agreement shall be presen- ted to the City Council for their approval prior to conversion proceedings. SECTION 3: That the developers seeking to convert a property to condominium ownership, not covered under Section 2 of this ordinance, can establish that the moratorium imposed hereby would result in the imposition of an undue hardship or burden upon the converter due to circumstances, difficulties, or other factors which makes unreasonable the imposition of an additional period during which conversion may not take place and which would be detrimental to or injurious to the value of the property or property owner, the City Manager, with the concurrence of the City Council, may issue a permit to proceed, with certain limitations set forth in writing in said permit based upon the factors set forth herein and the impact which such conversion may have upon the tenants of the structure sought to be converted. SECTION 4: In all other respects ordinance 69-0-78 shall be deemed to be in full force and effect. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. SECTION 6: All ordinances or parts of ordinances in conflict here- with are hereby repealed.
