AN ORDINANCE
It Adopting the Nursing Home Care Reform
Act of 1979 and Related State Standards;
and Revising Section 8-15-7 of the
Evanston City Code, 1980
WHEREAS, the General Assembly of the State of Illinois h.as
;!adopted, effective March 1, 1980, the Nursing Home Care Reform Act of 1979,

which Act repeals the "Nursing Homes, Sheltered Care Homes, and Homes for .
the Aged Act" approved July 17, 1945,as amended; and

WHEREAS, said Nursing Home Care Reform Act provides for licensing
;land regulation of long term care facilities by municipalities whose
i;ordinances comply with the minimum requirements established under the

Act and the minimum standards established by the Department of Public Health
under the Act; and
WHEREAS, the City of Evanston has previously and by its own
ordinances met or exceeded state requirements and standards considering it
to be in the best interests of the citizens of the City of Evanston to
maintain or exceed standards promulgated by the state;
' NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE

SECTION 1: That Title 8, Chapter 15, Section 8-15-7 of the City
Code of the City of Evanston 1980 "ADOPTION OF RULES AND REGULATIONS" be and
,hereby is amended to read:
8-15-7 ADOPTION OF NURSING HOME CARE REFORM ACT OF 1979 AND
MINIMUM STATE STANDARDS: The licensing and regulation
of homes for the maintenance, care, or nursing of persons who
are ill, aged or physically infirm shall be in accordance with
the Nursing Home Care Reform Act of 1979, effective March 1,
1980, Chapter 111 1/2 Section 1-101 et. seq. as thereafter
amended, Said Act is attached to and incorporated into this
ordinance.

j, The City further adopts, by reference, the minimum standards
ji established by the Department of Public Health under this Act
as may from time to time be amended. Violation of any of
said minimum standards or of any provision of the Act as adopted
by this Chapter shall be considered a violation of the pro-
visions of this Chapter, provided that:
• A. Any. reference in said minimum standards to "Depa`rtment"
shall mean the Evanston-Northshore Health Department.
B. Any reference in said minimum standards to "Director"
shall mean the Director of the Evanston-Northshore Health
Department.
C. Any reference in said minimum standards to the "Fire Chief"
shall mean the Fire Chief of the Evanston Fire Department.
Three copies of said minimum standards adopted by reference shall
be filed in the office of the City Clerk no less than 15 days
prior to the effective date of this ordinance and shall be kept
available there for public use, inspection and examination. At
,i least five copies of the Nursing Home Care Reform Act of 1979
and of the minimum standard promulgated thereunder shall be kept
on file in the office of the Director for public inspection.
SECTION 2: All ordinances or parts of ordinances in conflict
!�!) herewith are hereby repealed.

I SECTION 3: This ordinance shall be in full force and effect on
• Ii March 1, 1980, after its passage, approval and publication in the manner
provided by law.
