HomeMy WebLinkAboutORDINANCES-1980-090-O-80• • 8/12/80 9/16/80 •1 1 AN ORDINANCE Providing for the Making of a Local Improvement in and for the City of Evanston, Cook County, Illinois Evanston Special Assessment #1343 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK ';COUNTY, ILLINOIS: f1 SECTION 1: That a local improvement shall be made in the CITY OF EVANSTON, Cook County, Illinois, the nature, `,character, locality and description of which improvement is as follows: That the unpaved portions of the following streets and the unpaved intersections within their right-of-ways, in the City of Evanston, County of Cook, State of Illinois, be improved by grading, con- structing the necessary drainage system, with concrete curb and gutter, and paving with flexible base and asphalt surface: Cleveland Street, from the east line of Hartrey Avenue to the west line of Dodge Avenue Cleveland Street, from the east line of Dodge Avenue to the east line of Wesley Avenue Pitner Avenue, from 300 ft. south of the south line of Cleveland Street to the south line of Washington Street Washington Street, from the west line of Pitner Avenue to the west line of Dodge Avenue Hartrey Avenue, from the north line of Oakton Street to the south line of Washington Street Madison Place, as it exists 10 ft. east of the east line of Pitner Avenue to the west line of Grey Avenue Grey Avenue, from the north line of Oakton Street to the south line of Cleveland Street Mulford Street, from the east line of Dodge Avenue to the west line of Asbury Avenue Wesley Avenue, from 300 ft. south of Mulford Street to the south line of Mulford Street Kirk Street, from the east line of Dodge Avenue to the West line of Florence Avenue Darrow Avenue, from the north line of Mulford Street to the south line of Oakton Street Dewey Avenue, from the north line of Mulford Street to the south line of Oakton Street 0 • 90-0-80 I Madison Avenue, from the east line of Florence Avenue to the west line i of Wesley Avenue Dewey Avenue, from the north line of Oakton Street to the south line ! of Main Street { Florence Avenue, from the north line of Oakton Street to the south line of Main Street i' Wesley Avenue, from the north line of Oakton Street to the south line of Main Street and furthermore that the alley in the block bounded on the north by Main Street, on the south by Washington Street, on the east by Hartrey Avenue, { and on the west by Chicago and Northwestern Transportation Company (Mayfair Division) right-of-way in'the City of Evanston, County of Cook, State of Illinois, be improved by grading, paving with Portland Cement Concrete and constructing the necessary drainage and appurtenances. i i� !i SECTION 2: That the recommendation of the Board of Local Improve- l ments of the CITY OF EVANSTON, providing for the improve- meet, and the estimate of the cost thereof made by the Engineer of the Board ! of Local Improvements, both hereto attached and made part hereof, be and the same are hereby approved. ' SECTION 3: That said improvement shall be made and the whole cost i thereof, together with an amount not exceeding six per cent (6%) of the estimated cost, to -wit: EIGHT MILLION ONE HUNDRED EIGHT THOUSAND SEVEN HUNDRED THIRTY-EIGHT DOLLARS AND SIXTY-FOUR CENTS ($8,108,738.64), which 6% is hereby provided for to apply towards the cost and expense of making, levying and collecting said special assessment and all ,i other expenses allowed by law, being the amount included in the estimate there- of, shall be paid by special assessment in accordance with the Illinois Muni- cipal Code, Article 9, Division 2, and amendments thereto. i i SECTION 4: That the aggregate amount herein ordered to be assessed to pay the cost of sa.id improvement against the property and against the municipality, if any, and also the assessment on each lot and parcel of land herein assessed, shall be divided as follows: I� So much of the aggregate amount of the assessment as represents the cost of the construction and making of the improvements herein provided for shall be divided into ten (10) installments in the manner provided by -2- I 90-0-80 statute in such case made and provided. So much of the aggregate amount of the assessment as represents • ;;the compensation for property taken or damaged, easements acquired, together ,with the cost of making and collecting the special assessment and all ex - I. ;penses allowed by law, shall be apportioned to the first installment of the I said special assessment. The first installment shall be due and payable upon ii 11delivery of the warrant by the Clerk of.the Court in which this proceeding is filed. The second installment of the said assessment shall be due and payable on the second (2nd) day of January next after the date of the first ';voucher issued on account of work done if the uncollected portion of the first installment shall have been returned delinquent to the authorized county officer as provided by law, but if the same shall not have been returned delinquent, then the second installment shall become due and payable one (1) i year after said second (2nd) day of January. The third and subsequent in- stallments shall be due and payable respectively at successive annual periods " after the second installment becomes due and payable. • All installments shall bear interest until paid at the rate of seven per cent (7%) per annum, being the rate now permitted by law. Interest shall begin to run in accordance with the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. Interest on such first installment shall be due and payable and shall be collected at the same time as such first installment. Interest on the second and succeeding installments shall be due and payable and shall be collected with the installments respectively as in said Code relating to special assessments provided. IT IS HEREBY made the duty of the Board of Local Improvements of � f the CITY OF EVANSTON, to file in the Office of the Clerk of the Court in which such assessment was confirmed, a certificate signed by the Secretary of the t. Board of Local Improvements of the CITY OF EVA14STON of the date of the first f voucher and the amount of the said voucher, within thirty (30) days after the issuance of the said voucher. • P SECTION 5: That for the purpose of anticipating the collection of �I the second and succeeding installments of said assessment! E -3- 41 1 :1 for the cost of said improvements, the CITY OF EVANSTON shall issue bonds payable out of said installments, bearing interest at the rate of seven per • cent (7%) per annum, being the amount now permitted by lava, signed by the Mayor of the CITY OF EVANSTON, and attested to by the City Clerk of said City. Said bonds shall be issued in accordance with and shall in all respects con- form to the provisions of the Illinois Municipal Code, Article 9, Division 2, and amendments thereto. SECTION 6: That for the purpose of this improvement, and in the municipal interest, the following described property shall be obtained by condemnation: That part of Lot 2 of General Dynamics -Evanston Industrial Park (re- corded May 16, 1969 in book 791 at pages 47 and 48 as document number 20843500) described as follows: Beginning at the north east corner of said Lot 2; thence due west 622.56 feet on the north line of the said Lot 2 to a point 14.02 feet due east of the north west corner of the said Lot 2; thence south 2 degrees 28 minutes 13 seconds west 975.60 feet on a line parallel with the west line of the said Lot 2; thence north 87 degrees 31 minutes 47 seconds west 14.00 feet to the west line of Lot 2; thence south 2 degrees 28 minutes 13 seconds west • 348.60 feet on the west line of the said Lot 2 to the south west corner of the said Lot 2; thence south 87 degrees 26 minutes 17 seconds east 254.23 feet on the south line of the said Lot 2 to the southeasterly line of the said Lot 2; thence north 24 degrees 29 minutes 53 seconds east 1000.35 feet on the southeasterly line of the said Lot 2; thence north 39 degrees 03 minutes 08 seconds east 38.92 feet on the south- easterly line of the said Lot 2 to the east line of the said Lot 2; thence due north 393.39 feet on the east line of the said Lot 2 to the point of beginning, and all being situated in the south west 1/4 of Section 24, Township 41 North, Range 13 East of the Third Principal Meridian, in Cook County, Illinois and also That part of the south west 1/4 of Section 24, Township 41 North, Range 13 East of the Third Principal Meridian, described as follows: Beginning at a point on the west line of the said Section 24 a distance of 1363.60 feet south of the north west corner of the south west 1/4 of the said Section 24; thence south 87 degrees 26 minutes 17 seconds east 254.23 feet; thence south 66 degrees 13 minutes 02 seconds west 200.00 feet; thence south 24 degrees 29 minutes 53 seconds west 100 feet; thence south 66 degrees 13 minutes 02 seconds west 41.65 feet to the west line of the said Section 24; thence north 2 degrees 28 minutes 13 seconds j east 200 feet on the west line of the said Section 24 to the point of j beginning in Cook County, Illinois , and also • That part of the west 1/3 of the north 1/2 of the south west 1/4 of Section 24, Township 41 North, Range 13 east of the Third Principal Meridian, (Taylors addition to Evanston now vacated) lying east of the right of way of Chicago and Northwestern Railroad described as follows: Beginning at a point in the easterly line of said right of way 517.92 i feet southwesterly of the center line of Washington Street measured along said right of way line; thence southwesterly along said right of way 213.08 feet; thence east at an angle of 65 degrees 19 minutes 300.32 feet to the west line of Pitner Avenue; thence north 179.7 feet to a point 485 feet south of the center line of Washington Street; thence west parallel to the center line of Washington Street, 100 feet; thence north 4- parallel to the west line of Pitner Avenue, 76 feet; thence southwesterly 137.55 feet to the point of beginning in Cook County, Illinois and also • ;j That part of the west 1/3 of the north 1/2 of the south west 1/4 of Section 24, Township 41 North, Range 13 East of the Third Principal Meridian (Taylors addition to Evanston now vacated) lying east of the right of way of Chicago and Northwestern Railroad described as follows: Beginning at a point in the easterly line of said right of way 517.92 ! feet southwesterly of the center line of Washington Street measured " along said right of way line; thence northeasterly along said right of way line 517.92 feet; thence east along the center line of Washington Street 26.4 feet to the west line of Pitner Avenue; thence south along ! the west line of Pitner Avenue 485 feet; thence west parallel to the center line of Washington Street 100 feet; thence north parallel to the west line of Pitner Avenue 76 feet; thence southwesterly 137.55 feet to ? SECTION 7: That the President of the Board of Local Improvements of the CITY OF EVANSTON be and he is hereby directed ito file a Petition in the Circuit Court of Cook County, Illinois, praying that steps may be taken to ascertain the just compensation to be made for private property taken or damaged and easements to be acquired for the said improvement and to ascertain what property will be benefited by said improve- ment and the amount of such benefit, and also that steps be taken to levy a ,special assessment for said improvement, in accordance with the provisions of this Ordinance, and in the manner prescribed by law. The undersigned hereby recommend the making of said im- provement, the extent, nature, character, locality and description of which is set forth in said draft of ordinance herewith transmitted,' and also recommend to you the passage of said ordinance.
