North -South Alley and the East-West Alley Both in the Block Bounded by Sheridan Road, Clark Street and Hinman Avenue ;f BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK !.COUNTY, ILLINOIS: �} SECTION 1: That those portions of the north -south and east -west �i public alleys in the block.bounded b p Y Y Sheridan Road, ;;Hinman Avenue and Clark Street, and legally described as: r All of the 20 foot wide public alley running North and South lying between the South line of Sheridan Road and the South line of Lots 5 and 14 in the Resubdivision of Lots 5 to 14 in Block 12 in the Village of Evanston and those portions of a 20 foot wide alley running East and West, adjoining Lot 1 and part of Lot 2 in Block 12 in the Village of Evanston and Lot 14 in Block 12 in said Resub- division of Lots 5 to 14 in Block 12, all in the City of Evanston, i, County of Cook, State of Illinois, bounded and described as follows: (; Beginning at a point in the Southerly line of Sheridan Road 160 feet East of the East line of Hinman Avenue; thence Easterly along said Southerly line 20 feet; thence Southerly along the East line of the j� West 20 feet of the East 38 feet of said Lot 2, 178.39 feet to the South line of said Lot 2; thence Easterly along the South line of said Lot 2 and said Lot 1, 135.74 feet to the Westerly line of Sheridan Road; thence Southerly along the Westerly line of said Sheridan Road 20.95 feet; thence Westerly along the North line of said Lot 14, 141.98 feet; thence Southerly 66.14 feet along the West line of said Lot 14 to the Southwest corner of said Lot 14; thence Westerly 20 feet to the Southeast corner of said Lot 5; thence Northerly along the East line of said Lot 5 and its Northerly extension and along the West line of the West 20 feet of the East 38 feet of said Lot 2 f a distance of 264.55 feet to the point of beginning. !, as.described in a plat of vacation attached hereto and made a part hereof for greater certainty be and the same are hereby vacated and closed, inasmuch as the corporate authorities of the City of Evanston have determined that jj the public interest will be subserved by vacating that portion of the public alleys hereinabove described. • SECTION 2: That the adjoining property owners who receive the benefits of this vacation shall pay to the City of ;j 80-0-80 7/30/80 8/12/80 8/20/80 Evanston the sum of Forty Thousand Three Hundred and Forty-one Dollars ($40,341.00) consideration. Said vacation is further conditioned upon the prior covenant of Northwestern University that any construction of University buildings within the aforesaid block and north of 1818 Sheridan Road and occurring prior to August 18, 2040 shall be substantially in conformance with ,-the NU/Sheridan-Hinman Site Study Scheme B dated July 17, 1980 by Nagle and . i !'Hartrey and in complete conformance with the zoning ordinance in effect at the time of issuance of .the building permit. As additional consideration and condition of said vacation the adjoining property owners shall comply with all terms of the covenant attached to and incorporated by reference into i?this ordinance as Exhibit A. SECTION 3: The City of Evanston hereby reserves to itself and to all public utilities owning public service fa- ;,cilities, such right-of-way, license and easement rights to such equipment ;as remains installed in use and located on those portions of the public right-of-way hereby closed together with the right of ingress and egress ? for the maintenance, renewal and reconstruction thereof. Cost of any re- location of utilities required by subsequent construction of any buildings E on the alleys vacated by this ordinance shall be paid by the alley property owners, who shall also during construction by them take whatever steps are necessary to keep the remaining portion of the sewer located in the public alley functioning and to protect and maintain the manhole located 236' north Of the catch basin in said north -south alley. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. As to those certain parcels now owned by the UNIVERSITY, and legally described as: and and Lot 13 in Block 12 in the Resubdivision of Lots 5-to 14 in Block 12 in the Village of Evanston in the Northeast Quarter of Fractional Section 18, Township 41 North, Range 14 East of the Third Principal Meridian, in the City of Evanston, in Cook County, Illinois, commonly known as 1818 Sheridan Road; Lot 14 in Block 12 in the Resubdivision of Lots 5 to 14 in Block 12 in the Village of Evanston in the Northeast Quarter of Fractional Section 18, Township 41 North, Range 14 East of the Third Principal Meridian, in the City of Evanston, in Cook County, Illinois, commonly known as 1822 Sheridan Road; Lots 10, 11 and 12 in Block 12 in the Resubdivision of Lots 5 to 14 in Block 12 in the Village of Evanston in the Northeast Quarter of Fractional Section 18, Township 41 North, Range 14 East of the Third Principal Meridian, in the City of Evanston, in Cook County, Illinois commonly known as 1800 Sheridan Road; retention or redevelopment by the UNIVERSITY or its successors or assigns in interest shall proceed under the following restrictions: A. The exterior facades of the buildings at 1818 and 1822 Sheridan Road shall be.maintained (except for the rear addition to 1822 Sheridan Road) for a minimum period of twenty years from the date of execution of this document unless the conditions de- scribed in B oe C herein occur prior. B. If either 1818 or 1822 Sheridan Road•("Subject properties") is destroyed by fire, windstorm or other natural phenomenon during the twenty-year period•, NORTHWESTERN UNIVERSITY or its successors and assigns in interest will be relieved of its obligation to retain the remaining building should it survive such an event. Destruction shall be deemed to occur if damage is such that the cost of restoring the building to its condition and use prior to the occurrence exceeds fifty percent of the cost of restoring the entire building new. C. If the present John Evans Alumni Center at 1800 Sheridan Road is destroyed by fire, windstorm or other natural phenomenon and NORTHWESTERN UNIVERSITY or its successors/assigns, as a . result thereof, proposes to construct new facilities on that site, it shall be permitted to remove the subject properties r if such removal is needed to accomodate the new construction. 2. Should the UNIVERSITY or its successors/assigns proceed to redevelop 1800, 1818 and 1822 Sheridan Road other than by precise replace- ment of the facade of the buildings located on the properties at the date of signing of this agreement, said redevelopment shall,prior to the year 2040 as to lot coverage, floor area ratio and building height, be governed either by the provisions of the Evanston Zoning Ordinance then in effect or by the following requirements, whichever is the more restrictive: A. Lot Coverage, Building. The ground floor areas of any buildings or structures shall not exceed 35% of the total area of the lot in question. 1 B. Lot Coverage, Gross. The gross lot coverage shall not exceed 50% of the total area of the lot. C. Floor Area Ratio. The floor area shall be a ratio of one to one to the lot area containing said building. •D. Building Height. The maximum .height of any building constructed shall not exceed 35 feet.., After August 18, 2040, the Zoning Ordinance then in effect shall govern any redevelopment of the parcels herein described. i 3. In the event that requirements 2 A-D are those utilized as k i the more restrictive, the definitions used for those requirements shall be as follows: BUILDING Anything constructed for the shelter or enclosure j� of persons, animals, chattels or movable property of any kind and which is permanently affixed to the land. BUILDING HEIGHT The perpendicular distance at the center of a i building's principal front measured from the { i established grade to the high point of the roof { for a flat roof, and to the mean height level for E gable, hip or gambrel roofs. Chimneys and spires shall not be included in calculating the height. FLOOR AREA The numerical value obtained by dividing the gross RATIO floor area of a building or buildings by the lot area.on which such building or buildingsare lo- cated. LOT AREA The area of a horizontal plane bounded by the vertical planes through front, side and rear lot lines. LOT COVERAGE, The ratio between the ground floor areas of all BUILDING buildings or structures on a lot and the total ' area of the lot. LOT COVERAGE, The ratio between the ground floor area of all GROSS buildings and structures plus all area used for • off-street parking facilities, loading areas, vehicular accessways or driveways, and the total i area of the lot. ;'In all other matters, the zoning ordinance in effect at the time of re - 'development shall govern. 4. In any redevelopment of 1800, 1818 and 1822 Sheridan Road, i' ;individually or as a consolidated parcel, the final exterior design and place- . ,. i;ment of the buildings and the landscaping of the redevelopment shall be ,japproved by the majority of members of a design review committee comprised of ,two architects, residents of Evanston, appointed by the Mayor., the Chairman ;;of the Plan Commission or its successor body, the Chairman of the Preserva- '!tion Commission or its successor body and an architect selected by the ;!developer. The approval provided herein shall not be unreasonably withheld. 5. It J s further covenanted and agreed by the UNIVERSITY that :;all the agreements, conditions and undertakings to which it binds itself in • f;this document shall extend to and be binding upon the respective successors -3- and assigns of its interests and that this Covenant shall run with the land, to be released only by agreement and consent of the City of Evanston, until August 18, 2040 after which it shall terminate automatically.
