HomeMy WebLinkAboutORDINANCES-1980-079-O-80!, • 7/29/80 7/30/80 7/31/80 AN ORDINANCE Granting a Special Use to Allow the Establishment of (1) An Accessory Parking Structure over 14-1/2 feet in height; (2) use of the Accessory Parking Structure in Part as a Storage Garage; and (3) a Private Health Club and Private Dining Club on the Property Located at 801-25 Clark Street WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on May 20, 1980, June 17, 1980 and July 15, 1980 upon the application of the City of Evanston (owner) and Irvine -Buck Associates, Inc. (contract buyer) for variation from the off-street parking regulations to permit 92 parking spaces of 112 square feet in area, and 157 parking spaces located in bays with an overall width of 57 feet; and for the following special uses to allow establishment of: (1) an accessory parking structure; (2) use of the accessory parking structure in part as a storage garage; and (3) a pri- vate health club and private dining 'club, at 801-25 Clark Street, property • located in a B-4 Business District; said public hearings having been con- ducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said variation be denied and said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the application of the City of Evanston and Irvine -Buck Associates, Inc. for special uses to allow the establishment of: (1) an accessory parking structure over 14-1/2 i feet in height; (2) use of the accessory parking structure in part as a storage garage in order to provide 100 public parking spaces not accessory to the development; and (3) a private health club and a private dining club on • the property located at 801-25 Clark Street, and legally described as follows: • • • Lots 2 through 10, inclusive, in Block 8, lying South of a line drawn from a point 44.16 feet East of the Northwest corner of Lot 4, in Village of Evanston, in Section 13, Township 41 North, Range 13 and Sections 7, 18, and 19, Township 41 North, Range 14, East of the Third Principal Meridian, in Cook County, Illinois. (In the Northwest quarter of Section 18). is granted, in accordance with the plans identified as Zoning Board of Ap- peals exhibit 1 and the Zoning Analysis dated April 11, 1980, except for those modifications necessary to make the proposed parking structure conform with the other requirements of the Zoning Ordinance and subject to compliance with all other provisions of the Zoning Ordinance, other applicable laws and the condition that the property owner shall execute a covenant in recordable form, stipulating that the private health club and private dining club to be established on the premises will not discriminate on the basis of race, religion or sex and that any contract for the operation of these facilities shall contain this stipulation. SECTION 2: The Director of Inspections and Permits is hereby directed to issue such permit pursuant to the terms of this ordinance. SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
