HomeMy WebLinkAboutORDINANCES-1980-062-O-80T i 7/15/80 62-0-80 • AN ORDINANCE I Granting a Variation from the Side Yard and Lot Provisions ; at 2233 Dodge WHEREAS, the Evanston Zoning Board of Appeals conducted a hearing on April 15, 1980 and again on May 20, 1980 upon the application of Thomas Mason, Karen Mason, Scott Oppliger and Claire Oppliger as beneficiaries of the First National Bank & Trust Co. of Evanston, Trust R-2386 for variations from the side yard and lot area provisions of the Zoning Ordinance, for property located at 2233 Dodge Avenue in an R3 Two -Family Residence District, said hearings having been conducted pursuant to notice and publication thereof in the manner prescribed by law, and t WHEREAS, the Zoning Board of Appeals has recommended that the appli- • cation for said variation be granted, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the applications of Thomas Mason, Karen Mason, Scott Oppliger and Claire Oppliger for variations from the side yard and lot area provisions of the Zoning Ordinance to permit: (1) a south side yard of 4.86 feet instead of the 5 feet required for the premises;; and (2) installation'of a second dwelling unit on a lot with 6,106 square feet of area instead of the 7,000 square feet required, on the property ' located at 2233 Dodge Avenue, and legally described as follows: Lot 1 in McCormick Square Resubdivision of Lots 12, 13 & 14 in Block 3 in Payne's Addition to Evanston, in the Southwest 1/4 of the Southeast 1/4 of Section 12, Township 41 North, Range 13, East of the Third Principal Meridian, together with the North • 1/2 of vacated Noyes Street lying South of and adjoining said lots, all in Cook County, Illinois is granted, subject to the conditions hereinafter set forth. • • AN111WO SECTION 2: That the grant of variations to Thomas Mason, Karep Mason, Scott Oppliger and Claire Oppliger is granted I' i subject to compliance with all other provisions of Zoning Ordinance, other I, applicable laws, and the following conditions: 1. That the second dwelling unit shall be eliminated five years from the date of adoption of this ordinance, provided, however, that should any of said applicants sell or vacate subject property, the second dwelling unit shall be eliminated immediately. 2. That the.existing open, off-street parking area be surfaced with asphaltic concrete or a comparable all-weather dustless material. SECTION 3: That a covenant in recordable form be executed and i delivered to the office of Corporation Counsel by the applicants reciting agreement to such conditions. SECTION 4: The Director of Inspections and Permits is hereby directed to issue such permit pursuant to the terms I1 of this ordinance. j� j SECTION 5: This ordinance shall be in full force and effect from I! and after its passage, approval, and publication in the manner provided by law. That the second dwelling unit shall be eliminated five (5) years from July 21, 1980, provided, however, that should any of the under- signed sell or vacate subject property, the second dwelling unit shall be eliminated immediately. 2. That the existing open, off-street parking area be surfaced with asphaltic concrete or a comparable all-weather dustless material. i This covenant shall run with the land and shall be binding not only upon the owners, but upon their heirs, successors and assigns unless released upon i' agreement with the City of Evanston.
