HomeMy WebLinkAboutORDINANCES-1980-051-O-805/1/80 51-0-80 • AN ORDINANCE Amending Title 10 Chapter 9 of the Evanston City Code on Bicycle Regulations NQW, THEREFORE, BE IT ORDAINED BY TIME CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Title 10, Chapter 9 of the Evanston City Code, as amended, be and hererby is further amend- ed by adding thereto the following: 10-9-12: Bicycle Patrol Officers: The Chief of Police, with the approval of the City ilanader may appoint Bicycle Patrol Officers to carry out the enforcement of this chapter. . These Bicycle Patrol Officers small operate under the direction and supervision of the Evanston Chief of Police or his designee. These Bicycle Patrol Officers shall be private persons who are high school graduates at least 18 and no more than 25 years of age. 10-9-12-1: Authority of Bicycle Patrol Officers: Nothwithstanding the general authority of the officers of the Evanston Police Department to en- force the provisions of this chapter, the Bicycle Patrol Officers shall have the authority -to enforce all provisions of this chapter to issue notice of violation to any violator and to issue a notice to appear before the Bicycle Safety Compliance Board to any juvenile violating any provision of this chapter. 10-9-13: Bicycle Safety Compliance Board: There is hereby established the Evanston Bicycle Safety Compliance Board which shall consist of one (1) or more adult compliance officers and three ( 3 ) or more juvenile compliance officer; appointed by the Chief of Police. This adult compliance officer shall have authority to establish rules of procedure for the Bicycle Safety Compliance • Board. 10-9-13-1: Authority of the Bicycle Safety Compliance Board: The Bicycle Safety Compliance Board shall have authority to hear all citations issued to juveniles by the Bicycle Patrol Officers, to assess penalties not to exceed one dollar ($1.00) for each violation and to request parental cooperation in the suspen- sion of a juvenile offender's riding privileges. 51 -00 • 1079-14: Penalties: (A) Any adult violator may avoid prosecution for violating this chapter by surrendering the notice of violation and paying to the Clerk of the Circuit Court of Cook County, Second t•lunicipal District, ,:jithin ten (10) days from the date appearing on said violation notice, the sum of five dollars ($5.00) or if not paid within the period of ten (10) days from the date appearing upon the viola- tion notice, then the suill of ten (S10.00) before legal action has been brought against said violator. Any person making such payment shall receive a re- ceipt therefrom from the Clerk of the Circuit Court of Cook County, Second tlunicipal District. ( B ) Any adult violator of the provisions of this chapter shall be pr.rnishable by a fine not to ex- ceed twenty-five dollars ($25.00) for each offense. SECTION 2: All ordinances or parts of ordinance in conflict herewith are hereby repealed. • SECTION! 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided b,, 1 aw.
