HomeMy WebLinkAboutORDINANCES-1980-048-O-804 • 5/1/80 Amending the Applicability Provision and the Definition of Multiple -Family Dwelling of the Evanston Condominium Ordinance WHEREAS, the City Council of the City of Evanston desires to clarify its policy that the Evanston Residential Condominium Ordinance does riot apply to group, row, or townhouse buildings not electing to convert to the condominium format, and further desires to make consistent with the definitions of the Evanston zoning ordinances the definitions within th-e condominium ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 5-4-1-5, "APPLICABILITY OF PROVISIONS" of the Evanston City Code, 1979, as amended, shall be further amended to • read as follows: 5-4-1-5: APPLICABILITY OF PROVISIONS: This Chapter applies to all multiple -family dwellings located within the City which are to be developed as new or conversion condominiums except for group, row or townhouses not electing to convert to condo- miniums and not specifically covered by the State of Illinois Condominium Property Act. Sections 5-4-1-6; Section 5-4-1; 5-4-3-5 and 5-4-3-6 of Section 3; and 5-4-6-1, 5-4--6-2(B) and 5-4-6-3 of Section 5-4-6 alone shall apply to resale of their units by individual unit owners even -if such units were created prior to adoption of these provisions. Declarants who issued a notice of intent prior to August 19, 1978 and who cannot reasonably comply with the notice provisions of Sections 5-4-2-1, 5-4-4-1 and 5-4-4-2, may apply to the City Council for consideration of a hard- ship waiver of these provisions. and that Section 5-4-1-7: DEFINITIONS, "MULTIPLE -FAMILY DWELLING", shall be amended to read as follows: MULTIPLE -FAMILY DWELLING: A building containing three (3) or more dwelling units, except for group, row or townhouses. is SECTION 2: All ordinances or parts of ordinances in conflict herewith are -hereby repealed. 1 • U Ll 48-0-80 SECTION 3: This ordinance shall be in full force and effect. from and after its passage, approval, and publication in the manner provided by law.
