AN ORDINANCE
Amending
Sections 1-17-1 through 1-17-3
(Purchase and Sale
of Personal Property)
WHEREAS, the City Council of the City of Evanston finds it to be
Iin the best interest of the City of Evanston to expedite and simplify its
property purchase and sale procedure;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF,,,
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Chapter 17, Sections 1-17-1 through 1-17-3
of the Evanston City Code, 1979, as amended, be and
;'hereby are further amended to read as follows:
"1-17-1: PURCHASES OF GOODS OR SERVICES: All contracts for the purchase
of goods or services costing in excess of five thousand dollars
($5,000) to be utilized in the conduct of the affairs of the City,
shall be let by the City Manager or his designee, with the approval of
the City Council, to a reliable, responsible and acceptable bidder,
after advertising for the same, and bonds to be approved by the City
Council. may be taken for the faithful performance thereof. The City
Manager or his designee may reject all bids and shall subsequently
advise the City Council of his/her action or, with the approval of the
City Council, may award the contract including to a bidder other than
the lowest bidder if it should be determined that such action would be in
the best interest of the City. Any such contract may also be entered
into by the proper officers without advertising for bids upon the
authorization of the City Council by a vote of two-thirds (2/3) of
all Aldermen then holding office. Notwithstanding the above, the City
Manager or his designee shall have the authority to make purchases in
excess of five thousand dollars ($5,000) without prior Council approval
when there is an imminent threat to the property of the City or its
citizens or the health and welfare of its citizens; or when there is
a substantial economic benefit to the City not otherwise obtainable,
j providing, however, that a report of said purchase shall be promptly
i made to the City Council.
j All other contracts for the provision of goods or services to be utilized
in the conduct of the affairs of the City shall be let by the City
! Manager or his designee to a reliable, responsible person, firm or
agency without the necessity of advertising for bids, or of obtaining
! prior City Council approval. Bonds may be taken for faithful performance
of such contracts. This provision shall not apply to contracts for work,
material or supplies to be paid in whole or in part by special assess-

1-17-2: LEASE OF EQUIPMENT: All contracts for the lease of equipment
to be utilized in the conduct of affairs of the City requiring.
an expenditure in excess of five thousand dollars ($5,00MO) per annvm,

wherein the City shall be the lessee, shall be submitted for approval

by the City Council upon the application of the City Manager.

1-17-3 SALE OR DISPOSITION OF PERSONAL PROPERTY:
'
(A) Items of Personalty Less Than One Thousand Five Hundred Dollars:
Whenever there exists in the Municipal inventory an item or lot

of similar items of personal property, determined to have a
value of less than one thousand five hundred dollars ($1,500.00)
which shall be determined by the City Manager to be no longer
I�
necessary, practical or economical to be retained by the City or
which shall be determined__to be without trade-in value on new
equipment, the City Manager shall report such finding to the
City Council and shall proceed to dispose of such property by
sale in accordance with the following:

1. Upon the findings and submission of the report hereinbefore
required, the City Manager or his designee shall cause to be ad-
vertised in a prominent place within the City a written notice of

intent to take bids for the sale of or auction of specifically
identified items or lots of similar items of property to be offered
for sale upon a date certain.. The City Manager, or his designee,
it
shall receive proposals for the purchase of such property and small
sell such items to the highest acceptable bidder, except that
a bid other than the highest bid may be accepted if said bid
is on terms otherwise in the best interests of the City. Any or all
bids received may be rejected in the event such bid is deemed to be

less than the fair market value for such item or contrary to the
best interests of the City. Delivery of such items and removal of

said property shall be on terms specified in the notice of sale/
• i
request for bids.

2. In the event property thus offered is not sold, the City Manager
or designee shall cause such property to be disposed of for such
salvage or conversion value as can be obtained, or failing dis-
position for salvage value in the manner most convenient, expedient
and in the best interest of the City.

3. Upon final disposition of such property, the proceeds, if any,
shall be deposited to the General Fund of the City and a report of

the transaction thereof submitted to the City Council.

(B) Items of Personalty Exceeding One Thousand Five Hundred Dollars:
The disposition of personal property valued in excess of one
ji
thousand five hundred dollars ($1,500.00) by singular item or lots
of similar items shall be by ordinance authorizing the City Manager

or designee to sell such goods, upon terms and conditions deemed
I;
reasonable, necessary and in the best interests of the City.
The actual sales price of any item shall not be deemed to control
the method of disposition and the determination of the City Manager
shall be deemed controlling. The City Manager shall use the best

available information in assessing the value of any,item proposed
to be sold."

SECTION 2: All ordinances or parts of ordinances in conflict

herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force and effect from
and after its passage, approval and publication in the
�I manner provided by law.
