AN ORDINANCE

Granting a special use permit and variation from the
use regulation to permit the establishment of a not -
for -profit museum and business offices on property
11 located at 1704 Hinman Avenue, Evanston, Illinois

WHEREAS, the Evanston Zoning Board of Appeals, conducted a

�I public hearing on September 15, 1981 and September 26, 1981 upon the
application of Stephen B. Byer for a special use permit and a variation

from the use regulations of the Evanston Zoning Ordinance to permit the
establishment of a private not -for -profit museum, including an accessory
! caretaker rooming unit, and the installation of business offices upon
the property commonly known as 1704 Hinman Avenue, Evanston, Illinois in
an R=5A general residence district pursuant to notice and publication
thereof in the manner provided by law; and
WHEREAS, the Zoning Board of Appeals recommended that the
special use permit and the use variation be granted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the application of Stephen B. Byer for a
special use permit and a variation from the use
regulations of the Evanston Zoning Ordinance to permit the establishment
of a not -for -profit museum, open to the public including an accessory
caretaker rooming unit, and the installation of business offices on the
property located at 1704 Hinman Avenue and legally described as:
Lots 11 and 12 and the Southwesterly 18.0 feet of
Lot 13 in Block 14 in the Village of Evanston, in
the West 1/2 of the Southeast 1/4 of Section 18,
Township 41 North, Range 14 East of the Third
Principal Meridian in the City of Evanston, Cook
County, Illinois; commonly known and numbered as
1704 Hinman Avenue, Evanston, Illinois;
be and hereby is granted subject to compliance with all other provisions
Zoning Ordinance, other applicable law and the following terms and
conditions:

1. The use variation granted herein shall not allow establishment

of business offices prior to establishment of the not -for -profit museum,
and said variation shall terminate if the not -for -profit museum is either
'f not established or, after establishment, if said museum vacates the pre -

mises. Use of said offices shall be limited to either business offices

h to be used solely by Stephen Byer and Associates or the use of said offices
in conjunction with the museum on the premises;
2. That said offices not exceed approximately 800 square feet of

floor area, located on the third floor of the building, in conformance
with the application; and
3. That the applicant proceed with the restoration of the property
and the exterior of the structure in accordance with the program of re-
storation as outl.ined in the applicant's August 7, 1981 letter, submitted �
i
as part of his written application, and as orally presented by the appli-
cant and his counsel to the Board at its September 15, 1981 Public Hearing,
�! and that such restoration work be completed within 24 months from the date
j this variation and special use permit takes effect.

SECTION 2: The Director of Inspections and Permits is hereby

i ordered and directed to grant such permits, if any,
�i as shall be required to effectuate the provisions of this ordinance.

SECTION 3: This ordinance shall be in full force and effect

from and after its passage, approval, and publi-
cation in the manner provided by law.
