AN ORDINANCE
Amending Sections 4=2-5 and 4-9-4
of the Evanston City Code, 1979, relating
to Building Contractors and Heating, Air
Conditioning and Refrigeration Contractors,
Respectively
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,
COOK COUNTY, ILLINOIS:
SECTION 1: That Section 4-2-5 of the Evanston City Code,
1979, as amended, be and hereby is further
amended as follows:
4-2-5: BUILDING CONTRACTORS:
(A) Definition: The term "building contractor" means any person,
individual, company, or corporation engaged in the business of
constructing, enlarging, altering, removing or remodeling any
structure by furnishing of labor, material and methods necessary
to accomplish a given result, and who retains for himself the
control of the means, method and manner of accomplishing this
desired result. The term•"building contractor" shall not be
construed to include any person, individual, company or cor-
poration currently licensed as a plumbing contractor, electrical
contractor or a heating, air conditioning and refrigeration
contractor.
(B) License Required: No person shall engage in the business of
building contractor within the City without first having secured
a.license in the manner provided herein.
(C) Application for License: Application for license shall be made
in the manner provided in Title 3, Chapter 1 of this Code. All
licenses shall be subject to the provisions of this Code, other
ordinances of the City and the Statutes of the State of Illinois.
If any person shall violate any of these provisions, he shall
be liable to be proceeded against for any fine or penalty im-
posed thereby and 'his license may be revoked at the discretion
of the City Manager.
(D) License Fee: The amount of the annual license for persons en-
gaged in the business of building contractor shall be fifty
dollars ($50.00).
(E) Examination Required: No person shall receive such a license
until he has passed a standardized examination administered
and designed by the.Department of Building and Zoning. Said
examination shall be for the purpose of determining that all
licensees are knowledgeable in the business of building con-
tracting and financially capable of performing such work. Said

(E) Examination Required (con't): examination shall be administered
to all applicants for license as herein provided at least once
a year at a time and place to be established by the Department
of Building and Zoning. Notice in writing shall be given to all
applicants of the time and place at which an examination shall
be given. The Department may issue temporary licenses to appli-
cants prior to the examination, but no such temporary license
shall be valid if the applicant shall subsequently fail
said examination.
(F) Exemptions: Any building contractor properly licensed in the
Municipality of his principal place of business in the State of
.Illinois may, with the approval of the Director of Building and
Zoning,be classified as a building contractor in the City, and
after notification to the proper officials designated in Title 3,
Chapter 1 of this Code, may be issued an Evanston license without
additional license fee, provided that such contractor complies
with the ordinances and regulations of the City.
SECTION 2: That Section 4-9-4 of the Evanston City Code; 1979,
as amended, be and hereby is further amended as
follows:
4-9-4: HEATING, AIR CONDITIONING AND REFRIGERATION CONTRACTORS:
(A) License Required: No person shall engage in the business of
heating,air conditioning and refrigeration contractor within the
City without having first secured a license in the manner pro-
vided herein.
(B) Application for License: 'Application for license shall be made
in the manner provided by Title 3, Chapter 1 of this Code. All
licenses shall be subject to the provisions of this Code, other
ordinances of the City and the Statutes of the State of Illinois.
If any person shall violate any of these provisions, he shall be
liable to be proceeded against for any fine or penalty imposed
thereby and his license may be revoked at the discretion of the
City Manager.

SECTION 3: That all ordinances in conflict herewith, specifi-
cally sections 4-2-6 and 4-9-5 of the Evanston
City Code, 1979, be and are hereby repealed.
SECTION 4: That this ordinance shall be in full force and
effect from and after its passage and approval
in the manner provided by law.
