HomeMy WebLinkAboutORDINANCES-1981-073-O-81• • • 7/13/81 8/4/81 73-0-81 AN ORDINANCE i� Amending Sections 6-3-4 of the Evanston City Code concerning the size of parking spaces and accessory buildings and uses WHEREAS, the Evanston Zoning Amendment Committe conducted public hearings on February 6, February 12, March 12, April 2, May 7, June 4, and July 9, 1981 upon reference by the Evanston City Council to . review parking requirements as they relate to: (1) The size of parking i spaces and (2) The creation of requirements for compact cars, said public �! hearings having been conducted pursuant to notice and publication thereof I in the manner prescribed by law; and WHEREAS, in May,,1980 the City Council upon the recommendation of the CBD Parking Committee assigned the above reference a high priority and the Zoning Amendment Committee in order to meet this high priority objective considered this reference as two separate parts: (1) The size of parking spaces and (2) The creation of requirements for compact cars; and WHEREAS, the Evanston City Council on June 15, 1981 upon the recommendation of the Zoning Amendment Committee adopted Ordinance 34-0-31 which in part amended Section 6-9-2-8 of the City Code concerning the size of parking spaces; and 14HEREAS, -('-.he Zoning Amendment Committee conducted further public hearings on May 2, June 4, and July 9, 1981 on the aforementioned reference; and WHEREAS, based upon evidence presented at said hearings, findings of fact, consideration of existing conditions, conservation of property j values and the direction of building development to the best advantage of the entire city, the Evanston Zoning Amendment Committee has recommended that the following amendments of the Zoning Ordinance are required for the public good. I • • NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That section 6-3-4 of the Evanston City Code, 1979, as amended be and hereby is further.amended to read as follows: (A) Accessory uses shall be compatible with the principal use and shall.not be established prior to the es- tablishment of the principal use; accessory uses shall_ not include a dog kennel or an accessory building for the keeping or the propagation of birds, poultry or livestock. , (B) No accessory building, unless it is structurally a part of the principal buildi.ng or unless it conforms with the required conditions for accessory building for authorized special uses, shall be erected or altered at, nor be moved to, a location within ten feet (10') of the nearest wall of the principal building, nor within the required front or side yards on the lot. In residence districts, an accessory building in a rear or side yard shall be not less than three feet (3') from any property line. In any dis- trict, accessory buildings used for required off- street parking purposes shall be both: a) not less than five feet (5') from the alley lot line, across which access is provided, and b) shall also comply with the minimum standard stall aisle width (module) dimensions contained in section 6-9-2(A). (C) No accessory building shall encroach upon the required side yard of a corner lot which is adjacent to the street, including the required side yard of a re- versed corner lot which is adjacent to the street. (D) No accessory building located in the rear yard of a corner lot shall be nearer to a street lot line than the minimum width required for a side yard abutting a street in the district where the lot is located. When the rear lot line of a reversed corner lot is con. tiguous to a lot in a residence or university district;, any accessory building located within twenty five feet (25') of the rear lot line shall be no nearer to the street lot line than the required depth of the front yard on such contiguous lot; provided that, on lots less than fifty two feet (52') in width, such accessory building may extend beyond the required depth of the front yard one foot (P) for each foot of lot width less than fifty two feet (52'). (E) No accessory building shall exceed fourteen and one- half feet (142') in height for a flat roof or mansard roof, or seventeen and one-half feet (1712') for all other roofs, unless either (1) authorized (in the manner required for a special use) or (2) accessory to and located on the same lot as a use permitted and located in a university, business, commercial or manufacturing district. (F) Nursery schools and child day care facilities shall be considered accessory uses in churches whether or not they are operated by the church in which they are located. - 2 - • 0 7/13/81 73-0-81 SECTION 2: That section 6-9-2-8 of the Evanston City Code,- 1979, as amended be and hereby is further amended to read'as follows: i 6-9-2-8: PARKING AREA SIZE AND ACCESS: (A) Each required parking space shall be open directly upon an aisle, a driveway or public alley of such width and design as to provide safe and efficient means of vehicular access to such parking space at all times, as shown in the Stall and Aisle (Module) Dimensions tables contained in this section. i STALL AND AISLE (MODULE) DIMENSIONS 1.. In R1, R2 and R3 District, aisles (which may be partially comprised of driveways or public alleys) serving off-street parking spaces which are required for listed permitted uses and which are located in the rear yard, are not required to exceed twenty-one feet (21'). 2. Small Car Stalls (Spaces): Small car stalls may be used to satisfy a percentage of the required number of off-street parking spaces mandated by Section 6-9-2-10 in accordance with the following: a. The number of small car stalls shall not exceed the following: • If the Total Parking Requirement is 1 to 9 spaces 10 to 30 spaces 31 to 100 spaces 101 or more spaces I 73-0-81 7/13/81 8/4/81 8/21/81 8/26/81 The Maximum Number of Small Car Stalls is None 10% of all spaces 3 spaces plus 30% to 40% of all spaces in excess of 30 25 spaces plus 30% of all spaces in excess of 100 to 35 spaces plus 40% of all spaces in excess of 100 Initially the allowable number of small car stalls shall be the lesser of the numbers set forth in the table above. The City Council may, by ordinance without public hearing jor recourse to any other committee or commission, modify the allowable number within the ranges set forth above. Before any such modifications are made by the City Council, a study shall be conducted evaluating the effect of such f modifications. b. Whenever the determination of small car spaces allowed by this ordinance results in a fractional space, any fractional space less than .51 shall be rounded down to the next lower whole number, and any fractional space of .51 or greater shall be rounded up to the next higher whole number. C. Small car stalls must be identified by signage or other designa- tion and must be differentiated from standard car stalls. d. No driveway to such parking spaces, across public property shall have a width exceeding twenty five feet (25') exclusive to curb returns. (C) Required parking for stall angles other than those contained in the above tables may be interpolated from said tables. (D) All required parking spaces shall be marked to provide a delineation between parking stalls and aisles. j • 73-0-81 7/13/81 8/4/81 8/20/81 (E) Parking spaces for the physically handicapped shall be designed and provided in accordance with application stand- ards. (F) Minimum parking module dimensions for modules in which both standard car stalls and small car stalls are provided may be interpolated from_the above tables, provided that all stalls in said module are served by the required aisle widths applicable to standard stalls and the provided angle or the required aisle width applicable to small car stalls at the provided angle, whichever aisle width is greater. SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publi- cation in the manner provided by law. Introduced 3 1981.
