AN ORDINANCE
Granting Variations from the Use and
Off -Street Parking Regulations of the
Evanston Zoning Ordinance at 1829
Dempster Street
WHEREAS, the Evanston .Zoning Board of Appeals conducted public
hearings on May 19, 1981 and June 16, 1981, upon the application of Glen-
view Drumsticks, Limited, for variations from the use and off-street
parking regulations at 1829 Dempster Street, Evanston, Illinois to permit
the construction of a drive-in restaurant and installation of 31 off-street j
parking spaces 162 square feet in area, property located in a C2 Commercial
District; said hearings having been conducted pursuant to notice and publi-
cation thereof in the manner prescribed by law; and
WHEREAS, the ,Zoning Board of Appeals has recommended that the
application for said variations be granted
�I NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY

ti OF EVANSTON, COOK COUNTY, ILLINOIS:

SECTION 1: That the application of Glenview Drumsticks, Limited
{j for a variation from the use regulations of the
Zoning Ordinance to permit the construction of a drive-in restaurant and
Ii installation of 31 off-street parking spaces on the property located at
�I 1829 Dempster Street, and legally described as follows:�r•

Lot A in PLAT of CONSOLIDATION of Lots 1 to 5, inclusive, in
N.P. and W.S. Williams Subdivision of Block 3 of Chase and
Pitner's Addition to Evanston, being a subdivision of the
Northwest 1/4 of the Northeast 1/4 of Section 24 of the
South 1/2 of the Southwest 1/4 of the Southeast 1/4 of Section
13 (except the North 71.50 feet thereof), Township 41 North,
Range 13 East of the Third Principal Meridian, in Cook County,

!f is granted, subject to compliance with all other provisions of the Zoning
II Ordinance, other applicable laws and the following conditions:

a. that it be constructed in accordance with the plans submitted
and identified as Board's Exhibit 1.
b. the applicant shall take all necessary steps to prevent vehicles
(� entering or leaving the facility's premises from stacking,
• double parking, or obstructing the public right-of-way (street,
parkway, or sidewalk) including, but not limited to, the hiring
II of a security guard, an off -duty policeman or reimbursing the
�! City, for the costs of stationing a police officer at the
�Ipremises to direct traffic. If traffic problems persist the
I applicant agrees to permit the installation of traffic signs
prohibiting left turns to vehicles entering or leaving the pre-
mises.
C. within five (5).days of receipt of written notice of violation
of the provisions of this ordinance applicant shall initiate
whatever steps it deems effective to alleviate promptly any
traffic problem and to that end applicant agrees to consult
with the City's Traffic Engineer; and
d. a covenant in recordable form shall be executed by the appli-
cant subscribing to the terms and conditions of this ordinance,
prior to the issuance of any permits.

SECTION 2: The variation granted hereunder shall be limited to

operation and occupancy of the property by the
j applicant.
• SECTION 3: The Director of Building & Zoning is hereby directed
to issue such permits pursuant to the terms of this
;I ordinance.

SECTION 4: This ordinance shall be in full force and effect
i
from and after its passage, approval and publi-
cation in the manner provided by law.
