HomeMy WebLinkAboutORDINANCES-1981-040-O-81t i 4/27/81 (, 6/10/81 �i 40-0-81 AN ORDINANCE i Amending Sections 7-12-9-1 �j and Section 7-12-9(C) I ' WHEREAS, the Illinois Department of Transportation, Division of VWater Resources has granted the City of Evanston Lake Michigan Allocation i {; Permit No. 059 which sets forth the allocation of water to be withdrawn i j! from Lake Michigan until and including the year 2020; and i WHEREAS, as condition 2(b) of said permit the City is to require the installation of closed system air.conditioning on all new construction and in all new remodeling. i� it NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY 'I j OF EVANSTON, COOK COUNTY, ILLINOIS: • �� SECTION 1: That section 7-12-9-1 of the Evanston City Code, i; I� 1979, as amended, be and hereby is further amended I, j by adding as follows: I Water conserving device - a cooling tower, spray i{ pond, evaporation condenser, or other equipment j by which water is cooled and recirculated, there- by limiting the use of water from the mains to that amount lost through evaporation. - j SECTION 2: That section 7-12-9(C) of the Evanston City Code, 11 1979, as amended be and hereby is further amended ii { to read as follows: - ' Limit on Amount of Water to be Used: Regulating Devices; �j Demand Charges; Water Conserving Devices: Any air con- { ditioning system of over five (5) tons of capacity in- stalled prior to July 1, 1956 shall be equipped with a water regulating device and may use water from the City if mains at a rate not to exceed two (2) gallons per minute i{ per ton of capacity. The owner of such system shall pay an annual demand charge of twenty dollars ($20.00) per i ton of capacity per season for the total tons of capacity { over and above five (5) tons, unless equipped with a water conserving device. This demand charge shall be in addition .i (i I' i° .pf u 40-0-81 4/27/81 5/28/81 i to the regular charges provided in subsection (B) hereof. Demand charges shall be charged for each season for any air conditioning system not equipped and operating a water conserving device prior to September 1 falling within such season. Any air conditioning system or additions thereto, result- ing in a total capacity in excess of three (3) tons installed after July 1, 1956, shall 'be equipped with a water conserving device. Any air conditioning system or additions to existing systems { installed after July 1, 1981, shall be designed and oper- ated with a water conserving device so that water from the City mains shall be used for make-up and flushing purposes yl only. SECTION 3: That section,7-12-9-2(E) of the Evanston City Code, 1979, as amended be and hereby is amended to read i as follows: f{ Superintendent of Water and Sewer to have Access to Premises; �I Installation of Meters: The Superintendent of Water and Sewer, and/or his duly authorized agent shall, at all reason- able hours, have free access to premises supplied with water for air conditioning purposes, to examine the equipment and to ascertain if there is more water being used than allowed by this Section. He shall have the power and authority to require the installation of a meter furnished by the City to determine the amount of water used by any air conditioning system. SECTION 4: All crdinances or parts of ordinances in conflict s� herewith are hereby repealed. II SECTION 5: This ordinance shall be in full force and effect I from and after its passage, approval and publi'- ' cation in the manner provided by law. I Introduced.
