HomeMy WebLinkAboutORDINANCES-1981-028-O-81U • 4/8/81 28-0-81 AN ORDINANCE Authorizing the City Manager to Execute a Release of Covenant for Property at 1624 Darrow Avenue WHEREAS, the City Council of the City of Evanston in Ordinance 62-0-67 granted a variation from the use regulations of the Evanston Zoning Ordinance for property commonly known as 1624 Darrow Avenue, i' Evanston, Illinois; and WHEREAS, pursuant to Ordinance 62-0-67 a covenant of agreement to the conditions in said ordinance running with the land was duly executed i' on November 17, 1967, and recorded with the Cook County Recorder of Deeds on December 4, 1967, as document 20344045; and WHEREAS, the structure referenced therein was in fact demolished on or by December 2, 1980 in accordance with the conditions of said ordinance and covenant; and WHEREAS, the City Council of the City of Evanston has determined it is no longer necessary, appropriate, or in the best interest of the City of Evanston to retain the restrictions set forth in said covenant; and , WHEREAS, the 1967 covenant provides that it may be released upon agreement of the City of Evanston; and WHEREAS, the City Council of the City of.EVanston has determined,,. that the best interest of the City of Evanston would be served by the release of said covenant. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager be and hereby is authorized and directed to execute a release of covenant re- corded December 4, 1967 as document 20 344 045 for the property legally described as follows: • • r� U 4/8/81 28-0-81 The blest 60 feet of Lot 5 in Wilson's Subdivision of Lots 1, 2, 3, 4, and 5 in Block 4 in Hinman's Addition to Evanston, said addition being a sub- division of the Northwest Quarter of the Southeast Quarter of Section 13, Township 41 North;, Range 13, East of the Third Principal Meridian, in Cook { County, Illinois. I and commonly known as 1624 Darrow Avenue, Evanston, Illinois. If SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval in the manner !I provided by the law.
