HomeMy WebLinkAboutORDINANCES-1981-023-O-81f 3/23/81 4/9/81 4/10/81 23-0-81 4/21/81 AN ORDINANCE Amending Title 6, Chapter 6 • of the Evanston City Code, 1979, relating to Zoning of University Districts WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings beginning on October 3, 1974 with continuances through October 7, 1976 and recommenced on June 7, 1979 with continuances through November 1, :.1979 and resumed hearings on July 3, 1980 with continuances through October 2, 1980, upon three separate references, subsequently consolidated, from the Evanston City Council to consider amending Section 6-6 of the Evanston Zoning Ordinance pertaining to university districts, said public hearings ` having been conducted pursuant to Notice and publication thereof in the manner prescribed by law; and WHEREAS, based upon evidence presented at those hearings, findings of fact, consideration of existing conditions, conservation of property • values and the direction of building development to the best advantage of the entire City, the Zoning Amendment Committee has recommended that certain amendments are clearly favored by a preponderance of the evidence and are .required for the public good. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION l: That Title 6, Chapter 6 of the Evanston City Code, to read as follows: 0 1979, as amended, be and hereby is further amended 23-0-81 SECTION 6-6 UNIVERSITY DISTRICTS • SECTION: 6-6-1: Statement of Purpose 6-6-2: General Requirements 6-6-2-1: Home Occupations 6-6-2-2: Signs 6-6-2-3: Conversions; Existing Structures 6-6-2-4: Principal Building on a Lot 6-6-2-5: Curb Cuts on Sheridan Road 6-6-2-6: Applicability to Existing Improvements 6-6-3: U1, U2 & U3 University Districts '6-6-4: U4 University Housing District 6-6-5: U5 University Athletic Facilities District 6-6-6: U6 University Lakefront Campus District 6-6-1: STATEMENT OF PURPOSE: The University Districts are intended to accommodate university uses, which include, but are not limited to, premises owned, leased or operated by a university, college or -theo- logical institution for the purpose of education, athletics, recrea- tion, research, administration and housing of students, faculty and staff and their respective families. University District uses, in- cluding institutional housing, are not permitted outside of University. Districts unless specifically listed as a permitted or special use. 6-6-2: GENERAL REQUIREMENTS: 6-6-2-1 HOME OCCUPATIONS: Home occupations shall be governed by the regula- tions for home occupations set forth in Section 6-5-1-2, Residence Districts. 6-6-2-2: SIGNS: Signs shall be governed by the following regulations, and signs not specifically permitted are prohibited: -2- 23-0-81 • • • (A) Unilluminated nameplates are permitted subject to the following regulations: 1. For a single-family dwelling or a two-family dwelling, a nameplate shall not.exceed thirty six (36) square inches in area and shall indicate only the names .or names and addresses of the occupants; there shall not be more than one such nameplate for each dwelling unit and it shall be affixed flat against a door or on the wall adjacent thereto or may be located in a yard. 2. For a multiple -family dwelling, college, university or theological school building, fraternity or sorority, a nameplate shall not exceed twelve (12) square feet in area and shall indicate only the name or name and address of the building; such a nameplate shall be located not less than ten feet (10') from a street lot line and shall not be higher than one story or fifteen feet (15') above curb level, whichever is lower. A college, university or theological school building may have one name- plate not exceeding twelve (12) square feet in area affixed flat against I a door or on the wall adjacent thereto at each entrance. 3. For a college or university campus or principal campus area, a sign designating only the name of the institution or campus area shall not ex- ceed thirty (30) square feet in area if only one side faces a street, or sixty (60) square feet in total area if both sides are visible from a street; such sign shall be located not less than ten feet (10') from a street lot line. For a parking lot or structure accessory to a permitted college, university or theological school, a sign shall not exceed twelve (12) square feet in area and there shall be not more than two (2) signs for each parking lot or structure. (B) Unilluminated "For Sale" or "For Rent" signs are permitted subject to the requirements for such signs set forth in Section 6-5-1-3(B), Residence Districts. (C) Illuminated, n:on-flashing bulletin signs are permitted subject to the following regulations: there shall be not more than one bulletin sign for each college, university, or theological school ouilding.containing classrooms, chapel, auditorium, lecture hall or athletic facility. No -3- 23-0-81 bulletin sign shall exceed thirty (30) square feet in area nor be closer • than ten feet (10') to any street lot line. No bulletin sign shall pro- ject higher than one story or twenty feet (20') above the curb level, whichever is lower. 6-6-2-3: CONVERSIONS; EXISTING STRUCTURES: The conversion of existing struc- tures shall be governed by the requirements for conversion of exist- !. ing structures set forth in Section 6-3-9, general provisions. 6-6-2-4: PRINCIPAL BUILDING ON A LOT: In University Districts there may be i more than one principal college, university or theological school ' building, fraternity or sorority on a lot, as defined in this Ordinance, provided that all other requirements of this Ordinance applicable to each new or enlarged building on such lot are met. i • I 6-6-2-5: CURB CUTS ON SHERIDAPJ ROAD: In University Districts, the crea- tion of additional curb cuts or the relocation of existing curb cuts on Sheridan Road shall be allowed only as a special use. 6-6-2-6: APPLICABILITY TO EXISTING IMPROVEMENTS: It is the purpose of this Ordinance to permit the retention of all existing lawful structures and uses within the University Districts, while regulating new con- struction and uses therein, but not to authorize the continuation or expansion of present uses which are not otherwise lawful. Any parking lot or parking structure lawfully existing as of the effective date of this Ordinance which would otherwise be subject to amortization or elimination under the provisions of this Ordinance is hereby declared to be a lawful special use and approval for the continuation of such uses is hereby granted • without further proceedings. -4- 4/21/81 23-0-81 Amendments to the U2 University District regulations contained in Ordinance 23-0-81 regarding yards and lot coverage shall not apply to any existing residential buildings, but said properties • shall remain subject to the requirements prior to said amendment, which include the following yard requirements and include no lot coverage requirements: (A) FRONT YARD: U2 DISTRICT: Not less than twenty seven feet (271) in depth, except as provided in Section 6-3-6-2(C). (B) SIDE YARDS: U2 DISTRICT: ' 1. Two (2) side yards, each not to be less than fire feet (5') in width. 2. On a lot to be improved with a non-residential building, a side yard shall be provided along each side lot line not less than fifteen feet (15') in width. In lieu of such side yards where there is more than one ' principal building on a lot, as defined in this Ordinance, there shall I be a minimum distance of twenty feet (20') between principal buildings, • provided that the required side yard is maintained adjacent to or across a street or alley from a residence district. 3. A side yard abutting a street, not to be less than twenty feet (20') in width. If a corner lot, subdivided and duly recorded prior to December 2, 1960, has insufficient width to provide a side yard twenty feet (20') in width and still maintain a buildable width of twenty seven feet (27'), then the side yard abutting a street may be reduced in width by the distance necessary to maintain a buildable width of twenty seven feet (27') provided such yard is not less than five feet (5') in width. (C) REAR YARD; U2 DISTRICT: Not less than thirty feet (30') in depth, or in lieu of such a rear yard, where there is more than one principal building on a lot, as defined in this Ordinance, there shall be a minimum distance of twenty feet (20') between principal buildings, provided that the required rear yard is maintained adjacent to or across a street or • alley from a residence district. -5- 4/21/81 23-0-81 • • • Amendments to the University District regulations contained in Ordinance 23-0-81 shall not apply to any proposed construction for which applications for zoning analyses and/or building permits were submitted prior to April 13, 1981; said proposed construction shall be subject to the Zoning Ordinance in effect at the time said applications were submitted. ;.6-6-3: U1, U2 and U3 UNIVERSITY DISTRICTS: ;'(A) STATEMENTS OF PURPOSE: 1. U1 University Districts are intended to be the most restrictive Uni- versity District because of their close proximity to existing residential development. 2. The U2 University District is designed and intended to minimize the adverse effects that such uses may have on the predominant residentially zoned neighborhoods surrounding the U2 District. Therefore, the U2 University District has been designed to buffer the broad range of intense uses permitted in the major central campus area from the in- compatible and vulnerable residential land uses in the surrounding resi- dentially zoned districts. 3. The U3 University District is a general University District intended to permit a broad range of university uses except those uses and events that attract significant crowds. Uses and events that attract significant crowds have been excluded from the U3 University District because of its close proximity to existing residential development. (B) PERMITTED USES: Ul, U2 and U3 DISTRICTS: 1. Single-family dwellings. 2. Child day care homes and night time homes, as defined herein. (Ord. 23-0-74) 3. Home occupations, as regulated in Section 6-6-2-1. 4. Parks and playgrounds. 5. Signs, as regulated in Section 6-6-2-2. 6. Tennis courts. 7. Accessory uses to the above permitted uses. 8. University playfields accessory to uses permitted in U2 and U3 Districts. 9. Off-street parking for hospital employees, but only in a 10 23-0-81 Ul district contiguous to U5. (Ord. 103-0-79) 10. In the Ul District contiguous to U5, only: off-street parking j accessory to U5 uses and for university students and employees. (C) ADDITIONAL PERMITTED USES; U2 and U3 DISTRICTS: i 1. Colleges, universities and theological schools including their buildings owned or leased for administrative and faculty offices; class- rooms; laboratories; chapels; auditoriums; lecture halls; libraries; student and faculty centers; athletic facilities, but not stadiums and field houses; dormitories; fraternities and sororities. Permitted uses shall include the customary use of such facilities for educational pur- poses, musical and theatrical events carried on by a university, but shall include neither colleges or trade schools operated for profit nor the use of any building, stadium or other facility for professional athletics, sports or games, or other commercial purposes. (Ord. 100-0-71) 2. Attached and two-family dwellings. 3. Multiple -family dwellings owned or operated by a college, uni- versity or theological school for housing students or staff members. ' { (Ord. 7-0-62) i 4. Accessory uses to the above permitted uses, including parking spaces and lots for passenger automobiles, but not including parking structures and, in the U2 District, not including any parking not required for buildings permitted in that district. (D) SPECIAL USES: (Ord. 7-0-62) 1. In the Ul District: a. Child care institutions, as defined herein. (Ord. 23-0-74) 2. In the U2 and U3 Districts: (Ord. 7-0-62) a. Art galleries, libraries and museums which are not part of an institution permitted in this District. ;Ord. 7-0-62) b. Boarding and rooming houses owned by a col':ege, university or theological school. (Ord. 7-0-62) c. Child care institutions, as defined herein.` 1See also Section 6-6-4(C)l . -7- 23-0-81 d. Churches. (Ord. 7-0-62) e. Curb cuts on Sheridan Road, provided that the City Council shall find that, in addition to compliance with existing standards for special uses, said curb cuts shall not create a traffic hazard, unduly • interfere with vehicular traffic, create dangerous traffic conflicts or otherwise impair the public safety. f. Food cooperatives in legally established churches, not -for - profit recreational buildings and community center, schools, and private clubs. (Ord. 3-0-77) g. Institutional headquarters for educational, fraternal, professional or religious non-profit organizations. (Ord. 7-0-62) h. Multiple -family dwellings other than those -owned or operated by a college, university or theological school. (Ord. 7-0-62). i. Private clubs. (Ord. 7-0-62) j. Public utility uses, including outside telephone pay booths and public transportation facilities such as shelters, termi- nals, parking areas, service buildings and turn-arounds. (Ord. 74-62) • k. Schools -nursery, elementary and high. (Ord. 7-0-62) 1. Planned developments, provided that no additional height allowances shall be permitted in the U2 District.l (Ord. 31-0-73) (E) LOT AREA: 1. In a Ul District, not less than seven thousand two hundred (7,200) square feet per dwelling unit. 2. In U2 and U3 Districts, not less than six hundred.(600) square feet per dwelling unit, except there shall be provided not less than five thousand (5,000) square feet of lot area for each single-family dwelling and not less than two thousand five hundred (2,500) square feet per dwelling unit for each two-family or attached dwelling. (F) FLOOR AREA RATIO: 1. In a U1 District, not to exceed 0.5. • 2. In a U2 District, not to exceed 1.5. 3. In a U3 District, not to exceed 2.5. 1See also Section 6-12-8-2 in 4/ 21 /81 23-0-81 (G) HEIGHT OF BUILDI14GS OR STRUCTURES: 1. In a U1 District, not to exceed two and one-half (2-112) stories above a basement story or thirty five feet (351), whichever is lower. 2. In a U2 District, not to exceed thirty six feet (361) except that a college, university or theological school building or structure may be erected to a height of forty five feet (45'), provided that any required front, side or rear yards adjacent to or across a street or alley from any zoning district other than U1, UZ, U3, U6 and R7 shall be increased by two feet (2') for each additional foot or building height above thirty six feet (36') and provided further that no additional height allowances shall be permitted under planned develop- ment.1 3. In a U3 District, not to exceed eighty five feet (85'). ' (H) LOT COVERAGE, BUILDING & GROSS, U2 DISTRICT: In the U2 District, building lot coverage shall not exceed forty five percent (45%) and gross j lot coverage shall not exceed sixty percent (60%). The applicant for a building permit or zoning analysis with respect to lot coverage need. not, for purposes of obtaining additional construction permits, prepare a new plat of survey following each physical improvement or change in order to calculate the change in lot coverage, but may calculate lot coverage from the changes to the initial plat of survey which are depicted on subsequent plot or site plans. (I) YARDS: 1. Front Yard: Not less than twenty seven feet (27') in depth, except as provided in Section 6-3-6-2(C) and provided further that any lot contiguous to or abutting Sheridan Road and located within a U2 District shall be deemed to front on Sheridan, and a front'" yard depth of no less than fifty feet (50') shall be provided. 1See also Section 6-6-3(D)2 • 23-0-81 2. Side Yards: a.. Two (2) side yards, each not to be less than five feet (5') in width, except that in a U2 District, for lots to be improved • . with three or more dwelling units, a side yard shall be provided along each side lot line equal to not less than ten percent (10%) of the width of said lot, or five feet (5'), whichever requirement ' 1 is greater. b. On a lot to be improved with a non-residential building, a �. side yard shall be provided along each side 'ot line not less than fifteen feet (15') in width, except that for lots within a U2 ! District, a side yard shall be provided along each side lot line, equal to not less than ten percent (10%) of :he width of said lot, of fifteen feet (15'), whichever requirement is greater or more restrictive. Where there is more than one principal building on i� I a iot, as defined in this Ordinance, there shall be a minimum ! distance of twenty feet (20') between principal buildings. C. A side yard abutting a street, not to be less than twenty i feet (20') in width. For lots in -a U2 District, a side yard abutting a street shall be provided equal to not less than ten percent (10%) of the width of said lot, or twenty feet (20'), i s whichever requirement is greater or more restrictive. If a corner lot, subdivided and duly recorded prior to December 2, 1960, has insufficient width to provide a side yard twenty feet (20') in width and still maintain a buildable width of twenty seven feet (27'), then the side yard abutting a street may be reduced in width by the distance necessary to maintain a buildable width of twenty seven feet (27') provided su:h yard is not less than five feet (5') in width. 3. Rear Yard: Not less than thirty feet (30') in depth, except that a minimum twenty foot (20') rear yard shall be provided for a lot i within a U2 District that is located across an alley from property within a U2 District and is not abutting or directly across a street or alley from any residence district. Where them is more than one principal building on a lot, as defined in this Ordinance, there -10- 23-0-81 • • • shall be a minimum distance of twenty feet (20') between principal buildings. 4. Buffer Yard, U2 District: All lots within a U2 District abutting or directly across a street or alley from any residence district shall provide a buffer yard of not less than twenty seven feet (27') in depth, to be subject to the restrictions applicable to front yards, !; including but not limited to Sections 6-3-6-1 and 6-3-6-2(C). (J) OFF-STREET LOADING: Loading berths in accordance with the provisions set forth in Section 6-9-1. (K) OFF-STREET PARKING: Parking spaces in accordance with the provisions set forth in Section 6-9-2; except that parking spaces or lots which are accessory to uses operated by a college or university, may be located within the University Districts, without restrictions as to the distance limitations set forth in Section 6-9; provided however i� that in a U1 District, required parking for dwelling units or other ! living accommodations is prohibited. (L) OCCUPANCY OF DWELLING UNITS; U3 DISTRICTS: Occupancy of dwelling units shall be in accordance with Section 6-3-8, except that the floor area requirements of Section 6-3-8(C) shall be reduced by one- third (1/3) when applied to multiple -family dwellings used or intended for use solely for housing college, university and theological school students, staff members and their dependents. (Ord. 115-0-67) 6-6-4: U4 UNIVERSITY HOUSING DISTRICT: (Ord. 115-0-67) (A) STATEMENT OF PURPOSE: The U4 University District is intended primarily as a residence district but also permits restricted and compatible uses. (B) PERMITTED USES: 1. Multiple -family dwellings used and intended for use solely for housing college, university and theological.school students, staff members and their dependents. Accessory uses to the above permitted uses ircluding parking lots for passenger automobiles and parking structures primarily for use • by students, employees and persons visiting a permitted building. (Ord. 115-0-67) n U 3. Signs, as regulated in Section 6-6-2-2. (C) SPECIAL USES: + 1. Child care institutions, as defined herein. (Ord. 23-0-74) 2. Churches 3. Community centers and recreational buildings operated by not - for -profit -organizations. i' 4. Dormitories limited to occupancy by graduate students only. (Ord. 145-0-67) 5. Food cooperatives in legally established churches, not -for - profit recreational buildings and community centers. (Ord. 3-0-77) 6. Multiple -family dwellings other than those used and intended for use solely for housing college, university and theological school students, staff members and their dependents. (Ord. 115-0-67) 7. (Ord. 115-0-67) 1 See Section 6-12-8-2 -12- • • 23-0-81 (D) LOT AREA: Multiple -family dwellings used or intended for use solely for housing college, university and theological school students, staff members and their dependents, not less than one acre minimum lot area and further provided that the density of dwelling units on the site shall not exceed one dwelling unit for each two hundred thirty (230) square feet of lot area. (Ord. 115-0-67) i (E) FLOOR AREA RATIO: Not to exceed 3.0. (Ord. 115-C-67) (F) BUILDING HEIGHT: 1. Not to exceed eighty five feet (85'), except planned develop- ments. (Ord. 115-0-67) 2. As part of an approved planned development, structures may be erected to heights of not more than the average width of the lot, provided that the maximum height of any structure so allowed shall I . not exceed one hundred thirty feet (130'). (Ord. 115-0-67) (G) LOT COVERAGE; BUILDING: Not more than fifty percent (50%). (Ord. 115-0-67) (H) LOT COVERAGE; GROSS: Not more than sixty five percent (65%). (Ord. 115-0-67) (I) YARDS: 1. Yard (setback) Adjacent to Street: Not less than thirty feet (30'). (Ord. 115-0-67) 2. Yard (setback) Adjacent to Property Zoned Residential: Not less than thirty feet (30'). (Ord. 115-0-67) 3. Other Yards (setback): Not less than fifteen feet (1.5'); pro- vided that where there is more than one principal building on a lot, there shall be a minimum distance of twenty feet ;20') between principal buildings. (Ord. 115-0-67) -13- 4/21/81 23-0-81 (J) OFF-STREET LOADING AND PARKING: As required by the provisions set forth in Section.6-9. (Ord. 115-0-67) • ,'(K) OCCUPANCY OF DWELLING UNITS: Occupancy of dwelling units shall be in accordance with the provisions set forth in Section 6-3-8, except that the floor area requirements of Section 6-3-8(C) sha"1 be reduced by one-third (1/3) when applied to multiple -family dwe'lings used or intended for use solely for housing college, university and theological school students, staff members and their dependents. (Ord. 115-9-67) 6-6-5: U5 UNIVERSITY ATHLETIC FACILITIES DISTRICT (A) STATEMENT OF PURPOSE: The U5 University Athletic Facilities District is intended to permit the utilization of university facilities within the district in a manner that is compatible with the surrounding i� development, which is predominantly residential. i i. (B) PERMITTED USES: • 1. Existing structures and existing facilities may be used as: a. Stadium and field house. b. Ice rinks. c. Playing fields. d. Tennis courts. e. Parking spaces and lots. 2. Existing and newly constructed structures and facilities shall be used solely for: a. Intramural and intercollegiate sports and athletic events and practice therefor. b. Local, regional and state elementary and high school athletic events and practice therefor. C. Band playing and practice in connection with the above • events. d. Commencement, convocation and graduation exercises. -14- 4/21/81 23-0-81 e. University -sponsored lectures, speakers, musical performances and other cultural events held within an enclosed building provided that attendance is limited to 10,000 or less. f. Luncheons and dinners in dining room facilities -in a stadium provided that attendance is limited to the seating capacity of the facilities. g. Accessory uses to the above permitted uses, including admini- strative and faculty offices, classrooms, auditoriums, athletic facilities; and parking spaces. . h. Off-street parking for hospital employees and for university students, and employees. 3. The foregoing permitted uses do not include (a) professional athletics, sports, games and events or commercial activities and (b) the sale of alcoholic beverages. j 4. Signs, as regulated in Section 6-6-2-2. 5. Construction of a structure or the expansion or addition to an existing structure is a special use, as set forth hereafter in Section 6-6-5-(C)2. SPECIAL USES: 1. The following may be allowed as special uses in all existing and newly constructed facilities: a. Community events of a non-profit nature intended primarily for residents of the City of Evanston. b. Lectures, speakers, musical performances and other cultural and athletic events not classified as permitted uses. 2. All new construction or additions to existing structures may be allowed only as an approved special use. 3. The foregoing special uses shall exclude (a) professional athletics, sports, games and events or other commercial activities and (b) the sale of alcoholic beverages. -15- 23-0-81 4. Planned Developments. i (D) FLOOR AREA RATIO: Not to exceed 1.5. i it (E) BUILDING HEIGHT: Not to exceed thirty five feet (35') except that a i college, university or theological school building may be erected to ' a height of fifty feet (50') provided that required side or rear yards adjacent. to or across a street or alley from a R1, R2, or R3 District shall be increased in width or depth by two feet (2') for each additional foot of building height above thirty five feet (35'). (F) FRONT, SIDE AND REAR YARDS: 1. Front Yard: Not less than twenty seven feet (27') in depth, except as provided in Section 6-3-6-2(C). j 2. Side Yards: i. i a. A side yard shall be provided along each side lot line not less than fifteen .feet (15') in width. In lieu of such side yards where there is more than one pri.ncipal building on a lot, as defined in this Ordinance, there shall be a minimum distance of twenty feet (20') between principal buildings, provided that the required side yard is maintained adjacent to or across a street or alley from a residence district. b. A side yard abutting a street, not to be less than twenty feet (20') in width. Rear Yards: Not less than thirty feet (30') in depth, or in lieu of such a rear yard, where there is more than one principal building s on a lot, as defined in this Ordinance, there shall be a minimum dis- -16- • • • 23-0-81 tance of twenty feet (20') between principal buildings, provided that the required rear yard is maintained adjacent to or across a street or alley from a residence district. (G) LOADING BERTHS: In accordance with provisions set forth in Section 6-9 of this Ordinance.' (H) OFF-STREET PARKING: 1. The number of off-street parking spaces existing in U5 at the time of this Ordinance shall not be decreased unless the uses are changed, in which case Section 6-9 shall be controlling. 2. Parking spaces in the U5 may be used as additional off-street parking spaces by others when there are no events being held in the stadium or field house. 3. The requirements that all open parking spaces: shall be improved . i' with a compacted macadam base or equal, not less than four inch (4") thick, may be waived by the City Engineer, if in his judgment the absorptive capacity of the present surface prevents the overloading of the sewer system that could occur if the entire lot were to be' paved and drained in accordance with the requirements of Section 6-9. 6-6-6: U6 UNIVERSITY LAKEFRONT CAMPUS DISTRICT: (A) STATEMENT OF PURPOSE: The U6 University Lakefront Campus District is designed and intended primarily as the major central campus area. Therefore, a broad range of uses are permitted if such uses are com- patible with the lakefront to the east, residentially zoned districts to the north and south and the U2 University District buffer to the west. (B) PERMITTED USES: 1. Colleges, universities and theological schools including admini- strative and faculty offices, classrooms, laboratcries, chapels, audi- -17- • • r1 LJ 23-0-81 toriums, lecture halls, libraries, student and faculty centers, athletic facilities, dormitories, fraternities ano sororities, but not including colleges or trade schools operated for profit. 2. Child day care and night time homes, as defined herein. 3. Community events.. s 4. University sponsored lectures, speakers, musical performances and other cultural events and amateur athletic events. 5. Single family and multiple -family dwellings owned or operated by a college, university or theological school for housing students or staff members. 6. Off-street parking spaces and structures for passenger automobiles accessory to uses permitted and located in the U2. U3, U4, U5 or U6 Districts. 7. Parks and playgrounds. 8. Playfields accessory to permitted uses. 9. The sale and use of alcoholic beverages with�n the terms of an approved liquor licenses. 10. Signs, as regulated in Section 6-6-2-2. (C) SPECIAL USES: 1. Art galleries, libraries and museums which are not part of an institution permitted in this District. 2. Boarding and rooming houses owned by a college, university or theological school. 3. Food cooperatives in legally established churches, not -for - profit recreational buildings and community centers, schools and private clubs. (Ord. 3-0-77) 6. Institutional headquarters for educational, fraternal, pro- fessional or religious non-profit organizations. 7. Private clubs. 8. Public utility uses, including outside telephone pay booths and public transportation facilities such as shelters., terminals, parking areas, service buildings and turn-arounds. 9. Schools -nursery, elementary and high. (D) LOT AREA: As required in the U3 District. (E) FLOOR AREA RATIO: As required in the U3 District. (F) BUILDING HEIGHT: Not to exceed eighty five feet (85'). (G) YARDS: As required in the U3 University District, and provided further that any lot contiguous to or abutting Sheridan Road shall be deemed to front on Sheridan, and a front yard depth of no less than fifty feet (50') shall be provided. (H) OFF-STREET LOADING: Loading berths in accordance with the provisions set forth in Section 6-9-1. (I) OFF-STREET PARKING: Parking spaces in accordance with the provisions set forth in Section 6-9-2; except that accessory parking spaces for a college or university, which do not provide required parking for living accommodations may be located within the U5 District without restrictions as to the distance limitations set forth in Section 6-9. Parking spaces for all other uses, including living accommodations, must be provided within the distance limitations set forth in Section 6-9. (J) OCCUPANCY OF DWELLING UNITS: As required in the U3 District. -19- 23-0-81 SECTION 2: That the Zoning District map be amended to: (A) Re -zone the property located within the area bordered by Ashland Avenue on the west, Isabella Street on the north, •Asbury Avenue on the east and Central Street on the south, which is presently zoned U2 University District, to U5 University Athletic Facilities District; and (B) Re -Zone the property located within the area i bordered on the north by Lincoln Street, on the I east by Lake Michigan, and on the south and west by Sheridan, which is presently zoned U3 University District to U6 University District. SECTION 3: That Section 6-4-1(B) of the Evanston City Code, 1979, as amended, be and hereby is further amended i i to read as follows: (B) University Districts U1 University • U2 University U3 University U4 University Housing U5 University Athletic Facilities U6 University Lakefront Campus SECTION 4: It is hereby declared to be the intention of the City Council that the several provisions of this Ordinance are separable, in accordance with the following: (A) If any court of competent jurisdiction shall adjudge any provision of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance not specifically included in said judgment; and (B) If any court of competent jurisdiction shall adjudge in valid the application of any provision of this Ordinance to a particular property, building or other structure, such judgment shall not affect the application of said pro- vision to any other property, building or structure not specifically included in said judgment.
