HomeMy WebLinkAboutORDINANCES-1981-116-O-81019 12/.3/81 12/3/81 12/9/81 E 116-0-81 AN ORDINANCE .Granting a Variation from the Permitted Use Regulation to the Catholic Bishop of Chicago for a Storage Building at 516-26 South Blvd. (Calvary Cemetery) WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on September 15, 1981, upon application of the Catholic Bishop of Chicago for a variation from the permitted use regulations of the Zoning Or- dinance for construction of a soil storage building at 516-26 South Blvd. which will not be accessory to a permitted use on said property, which is located in a C2 commercial district; said hearing having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and I WHEREAS, the Zoning Board of Appeals recommended that the applica- tion for said variation be denied; and • ,; WHEREAS, a meeting of the Planning and Development Committee was held on November 16, 1981 to consider the Zoning Board of Appeal's recompienda- tion of denial and to review the record of the hearing, and representatives from the Catholic Bishop of Chicago appeared before the Committee and presented arguments on behalf of said applicants; and WHEREAS, the Planning and Development Committee has considered the information presented and reviewed the report and recommendation of the Zoning Board of Appeals and has made the following special findings of fact: (1) That Calvary Cemetery desires to provide storage for otherwise loose topsoil, sand and gravel used in its burial process; (2) That without proper storage in a closed structure, these materials are exposed to weather conditions such as freezing and become unusable, and in their loose, uncontained state are a blight upon the neighborhood; (3) Problems exist in locating adequate space on the cemetery • �i property itself which'is not already occupied by gravesites or sold for future gravesites; (4) That adequate space exists on the subject property which is across from and north of Calvary Cemetery and which is located in a C-2 commercial zone, is presently used as an equipment and storage yard accessory to Calvary Cemetery and is improved with a garage for storage of vehicles used in the operation of the Cemetery; I 116-0-81 i (5) That construction of an enclosure for the soil and other materials will benefit the community and otherwise promote the general welfare by removing the loose materials and there -by enhancing the appearance of the area; (6) That construction of the storage enclosure, 12 ft. high, with • I lineal dimensions of 24 ft. x 36 ft., will not be detrimental to the public welfare nor depreciate the value of neighboring property, but will instead increase the value by enclosing the materials presently stored in the open; (7) That denial of said variation would create a particular hardship II for the Catholic Bishop in its operation of Calvary Cemetery; i (8) That this variation would extend a present legal non -conforming j use; (9) That the plight of the owner is due to unique circumstances in that the subject property is located in a C-2 commerical zone while the Cemetery itself is within an R-1 zone as legally re- quired, thereby creating a hardship not applicable generally to other property in the area; (10) That the property cannot yield a reasonable return if,used strictly in accordance with the provisions of the Zoning Ordinance since it will serve no useful purpose for the Catholic Bishop; (11) That the variation, if granted, will not alter the essential character of the locality because the cemetery has long been an established_ and benign use, and the variation will improve the operation of said use; and WHEREAS, the Planning and Development Committee has recommended approval of the Catholic Bishop of Chicago's application for a variation and the City Council deems the granting of said variation to be in the best interest of the City of Evanston, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION.l: That the application of the Catholic Bishop of Chicago I for a variation to permit construction of a storage building 12 ft. in height with lineal dimensions of 24 feet by 36 feet on the property located at 516-26 South Blvd. and legally described as follows: Lots 5 and 6 in Block 10 in Keeny and Rinn's Addition to Evanston, in the S.E. 1/4 of Section 19, Township 41 North, Range 14 E. of the 3rd Principal Meridian, in Cook County, Illinois, is granted, subject to the condition that the structure will be removed I by the Catholic Bishop at such time as burials are no longer made in Calvary Cemetery, to compliance with all other provisions of the Zoning Ordinance, other applicable laws and to the condition that the construction be substantially in accordance with the plans submitted by the applicant.
