HomeMy WebLinkAboutORDINANCES-1982-071-O-826/ 1 j /82 • L J 11 71-0-82 AN ORDINANCE Granting a Special Use at 222 Chicago Avenue WHEREAS, the Evanston Zoning Board of Appeals conducted a public hearing on May 18, 1982 and again on June 15, 1982 upon the application of Patrick J. Gaynor and Rose Gaynor for a special use to permit construction of an equipment building and a radio tower not exceeding 100 feet in height a at 222 Chicago Avenue, Evanston, Illinois, property located in a M3 Manu- facturing District; said hearings having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, the Zoning Board of Appeals has recommended that the application for said variation and said special use be granted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF i EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the application of Patrick J. Gaynor and Rose ,i Gaynor for a special use to permit construction of a radio tower not exceeding 100 feet in height and an accessory equipment building on the property located at 222 Chicago Avenue, Evanston, Illinois and legally described as follows: Parcel 1: A part of the S 1/2 of the NE 1/4 of Section'30, Township 41 North, Range 14, East of the Third Principal Meridian, described as follows: Beginning at a point in the Southwesterly line of Chicago Avenue (now Clark Street) as originally located, 885 feet Northwesterly (measured along said Southwesterly street line and said street line produced) from its intersection with the South line of the NE 1/4 of said Section; thence continuing Northwesterly along said Street line and said street line produced (being the.Westerly line of original Chicago Avenue) to the South line of Mulford Street; thence West on the South line of Mulford'Street to the Easterly line of the right of way of the Chicago and Northwestern Railroad; thence Southeasterly along said Easterly line -of said right of way to the Northerly line of the land conveyed to the Chicago North Shore and Northern Railroad by special warranty deed dated June 25, 1924, and recorded July 9, 1924, as Document 8501712; thence Easterly 55.83 feet to the place of beginning (except therefrom that part thereof conveyed to Chicago, Milwaukee and St. Paul Railway Company by warranty deed recorded January 18, 1909, as Document 4316127, described as follows: Beginning at the intersection of the South line of Mulford i Avenue and the West side line of Chicago Avenue in the City of Evanston; thence Southeasterly along the West line of Chicago Avenue, 186 feet to a point; thence West at right angles 53.5 feet to the Easterly right of way line of the Chicago and North Western Railroad; thence North- 4 7/14/82 is westerly along the right of way line of said Railroad 200 feet to the South line of Mulford Avenue; thence East along said South line of Mulford Avenue, being on a line parallel to and 66 feet South of the North line of said S 1/2 of the NE 1/4 of Section 30, 51.5 feet to the place of beginning, in Cook County, Illinois. Parcel 2: A piece or parcel of land situated in the NE 1/4 of Section 30, Township 41 North, Range 14, East of the Third Principal Meridian, bounded and described as follows: Beginning at a point in the Southwesterly line of Chicago Avenue, 865 feet North- westerly, measured along said Southwesterly street line and said street line produced from its intersection with the South line of the NE 1/4 of Section 30; thence continuing Northwesterly along said street line, 20 feet to a point; thence Southwesterly at right angles to the last described course, 55.83 feet, more or less, to an inter- section with the Northeasterly line of right of way of the Chicago and North Western Railway Company; thence Southeasterly along said Northeasterly right of way line, 20 feet to a point; thenoe North- easterrly to the point of beginning, situated in the City of Evanston, County of Cook and State of Illinois. is granted subject to compliance with all other provisions of.the Zoning j i Ordinance, other applicable. laws, and the condition that it be constructed in substantial conformity to the plans submitted and identified as Board's Exhibit 1, except that the location of either the proposed radio tower and/or equipment building may be moved to another legal location on the lot if.. I required to accommodate expansion of the CTA Yards. ;I SECTION 2: The Director of Building and Zoning is hereby directed to issue such permit pursuant to the, terms of this ordinance. SECTION.3: This ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law.
