AN ORDINANCE Amending the Evanston City Code to Provide Definitions for Residential Care Homes and for Group Care Homes in the Zoning Ordinance and Listing Residential Districts in which Those Homes are an Allowed Special Use BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 6-2-4: DEFINITIONS, of the City Code of the City of Evanston, 1979, as amended, be and hereby is further amended by adding after GROSS FLOOR AREA and before GUEST, PERMANENT the definition -of GROUP CARE HOME to read as follows: GROUP CARE HOME: A residential facility housing from nine (9) to fifteen (15) persons, including any resident supervisory personnel, residing together in a family environment, each of whom is capable of independent living with support services, but who need a substitute home and are developmentally disabled, mentally ill, impaired by chronic illness and/or mobility limitations associated with the aging process, or are between nine (9) and eighteen (18) years of age and are unable to live with their parents or guardians. Excluded from this definition are homes any residents of which are currently addicted to or recovering from addiction to alcohol or narcotic drugs or are criminal offenders serving on work release or probationary programs. All Group Care Homes shall be licensed pursuant to the provisions of Section 8-19 of the • Evanston City Code. and by adding after RESEARCH LABORATORY and before RESTAURANT the definition of RESIDENTIAL CARE HOME to read as follows:_ RESIDENTIAL A residential facility housing four CARE HOME: (4) to eight (8) persons, including any resident supervisory personnel, residing together in a family • environment, each of whom is capable of independent living with support services, but who need a substitute 59-0-82 home and are developmentally disabled, mentally ill, impaired by chronic illness and/or mobility limitations associated with the aging process, or are between nine (9) and eighteen (18) years of age and are unable to live with their. parents or guardians. Excluded from this definition are homes ` any residents of which are currently addicted to or recovering from addiction to alcohol or narcotic drugs or are criminal offenders serving on work release or probationary programs. All Residential Care Homes shall be licensed pursuant to the provisions of Section 8-19 of the Evanston City Code. SECTION 2: That Section 6-5-2(B) of the City Code of the City of Evanston, 1979, as amended, be and hereby is further amended by adding the following: 16. Residential care homes. SECTION 3: That Section 6-5-4(B) of the City Code of the City of Evanston, 1979, as amended, be and is hereby further amended to read: (B) SPECIAL USES: Group Care Homes and special uses allowed in the R2 District, except that the number of off-street parking spaces required for churches may be modified in R3, pursuant to the special use procedures. (Ords. 158-0-66, 88-0-76). SECTION 4: That Section 6-5-5(B) of the City Code of the City of Evanston, 1979, as amended be and is hereby•further amended to read:. 1'5. Group Care Homes. 16. Residential Care Homes. SECTION 5: That Section 6-5-6(B) of the City Code of the City of Evanston, 1979, as amended, be and is further amended by adding the following: • 8. Group Care Homes. 9. Residential Care Homes. -2- a 12/14/83 12/15/83 59-0-83 SECTION 6: That Section 6-5-7(B) of the City Code of the City of Evanston, 1979, as amended, be and is further amended by adding the following:- • 23. Group Care Homes. 24. Residential Care Homes. SECTION 7: That Section 6-12-7 of the City Code of the City of Evanston, 1979, as amended, be and is further amended by adding the following: (E) TIME PERIOD FOR COUNCIL ACTION FOR A SPECIAL USE FOR RESIDENTIAL OR GROUP CARE HOMES: No more than ninety (90) days shall elapse between the .date of receipt by the City of Evanston of a properly completed application for a special use for a Residential or Group Care Home and submission of a report and recommendation to City Council. The City Council, during this ninety (90) day time period may extend this .time limitation as it deems proper. SECTION 8: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 9: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
