Rev. Stats., Chapter 111-1/2, Section 3401 and 3402); WHEREAS, the City of Evanston has adopted, pursuant to Chapter 24, Section 1-2-4 of the Illinois Revised Statutes, and pursuant to its home rule power the B.O.C.A Basic Building Code, Eighth Edition, 1981, with • exceptions and amendments; and WHEREAS, the City Council finds that it is in the best interest of the City of Evanston that single-family dwellings be exempted from the posting of building notice of violation requirements of the aforementioned state statute and the B.O.C.A. Basic Building Code. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS SECTION 1: That Title 4, Chapter 2, Section l(C) of the Evanston City Code be amended by the addition of the following provision: 117.2 NOTICE OF VIOLATION AND POSTING OF PREMISES: (A) The building official or his designee shall cause to be served personally or by certified mail a notice of violation or order on the person responsible for the erection, construction, alteration, extension, repair, removal, demolition, use or i • C7 occupancy of the building or structure in violation of the provisions of this code, or in violation of a detailed statement or a plan approved thereunder or in violation of a permit or certificate issued I under the provisions of this code; and such order shall direct the discontinuance of the illegal action or the abatement of the violation. Tenants of single-family rental units shall be served by regular mail or personal service a copy of the notice of violation sent to the owner of their rented property. Following initiation.of legal action to correct said violation the. building official shall cause a notice to be posted in a conspicuous place near the main entrance of such building. The notice shall be at least 9" in height and 14" in width and at the top thereto in large letters shall state "Notice of Violation." The text of the notice shall contain a reference to the provision of the building code violated and may contain such other information respecting the nature of the violation as the building official deems advisable. Single-family dwellings are exempt from the provisions of this subsection B. SECTION 2: All ordinances or parts of ordinances in conflict here- j with are hereby repealed.
