AN ORDINANCE
Amending the Evanston Zoning Ordinance
by Rezoning Certain Properties on
Noyes Court in Evanston
WHEREAS, the Evanston Zoning.Amendment Committee conducted public
hearings on January 5, 1982, February 4, 1982, and March 4, 1982, upon both
the petition of Northwestern University and the Housing Authority of the
County of Cook for reclassification of properties commonly known as 2241-2321
Noyes Court and 2246-2316 Noyes Court, Evanston, Illinois from C2 Commercial
and B2 Business District to R6 General Residence District to permit con-
struction of federally assisted housing for the elderly, and also upon the
` reference from the Evanston City Council to rezone to R1 through R7
Residence District or Bl through B5 Business District the properties with
frontage on Noyes Court which are presently zoned C2 Commercial District and
B2 Business District and commonly known as 1) 817 to 821 Noyes Street (north-
east corner of Noyes Court and Noyes Street), 2) 2241 to 2321 Noyes Court
(east side), 3) 825-27 Noyes Street (northwest corner of Noyes Court and
Noyes Street), and 4) 2246 to 2316 Noyes Court (west side), said public
hearing having been conducted pursuant to notice and publication thereof in
the manner prescribed by law; and ,
WHEREAS, said reclassification and rezoning of 22417-2321 and 2246-
2316 Noyes Court pursuant to the petition of Northwestern University and the
Housing Authority of Cook County is conditioned upon the issuance by the
Zoning Board of Appeals of a special use permit to construct 100 units of
federally assisted housing for the elderly on the premises, the actual convey-
ance of said premises to the Cook County Housing Authority and the vacation
of portions of Noyes Court and the adjacent east -west alley, delineated on a
plat of vacation dated April 8, 1982, and the development of the 2241-2321 and
2246-2316 Noyes Court properties in substantial conformance with referenced
site plans and elevation drawings, prepared by Lowenberg and Lowenberg, dated.:.
February 1, 1982, revised March 2, 1982, and signed March 4, 1982 by David
• S. Mann; and
WHEREAS, the Zoning Board,of Appeals has recommended that the
application for said special use be granted; and said recommendation has been '
incorporated into City of Evanston Ordinance 42-0-82.; and

WHEREAS, the Zoning Amendment Committee has recommended, based
j upon evidence presented at the public hearings, consideration of existing
iI conditions, conservation of property values, and the direction of building
1; development tdthe best advantage of the entire City, that the Evanston
Zoning Ordinance and Map be amended consistent with conditions contained
within this Ordinance and set forth in City of Evanston Ordinance 42-0-82;
f NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF j

SECTION 1: That the .Evanston Zoning Ordinance adopted November 21,
I'
1 1960, as amended, be and hereby is further amended by
reclassifying and rezoning certain properties in the Noyes Court Area as
follows:

(A) Reclassify from C2 Commercial District to R6 General Residence
District the properties commonly known as 2241-2321 Noyes Court
and 2246-2316 Noyes Court (and the east.half of the abutting 100-
foot-wide railroad right-of-way). Said properties are legally
described as follows:
Lots 6, 7, 8, and 9 and 10 in Block 3 in Owners
" Resubdivision of Blocks 2, 5 and 6 in Orrington
Addition to Evanston in the South West 1/4 of
• Section 7, Township 41 North, Range 14 East of
the Third Principal Meridian, in Cook County,
Illinois.
Lots 5, 6 and 7 of Block 2 of Owners Resubdivision
of Blocks 2, 5 and 6 of Orrington addition to
Evanston, in the South West 1/4 of Section 7, Township
41 North, Range 14 East of the Third Principal Meridian
(including that portion heretofore conveyed to the
Chicago, Milwaukee, St. Paul and Pacific Railroad,
being a 40-foot strip, the Easterly line of which is
a line drawn parallel to and 40 feet from the Westerly
line of said lots) also including that portion of the
abutting Chicago, Evanston and Lake Superior Railroad
right-of-way, between the Westerly line. of said Lots
5, 6 and 7 (on the East) and a line drawn parallel to
and 10 feet due West of said Westerly Lot Lines (on the
West) in Cook County, Illinois.
The North 196.8 feet (except the East 26 feet ten inches
of the South 30 feet thereof) of Lot 11 in Block 3 in
Owners Resubdivision of Blocks 2, 5, and 6 in Orrington's
Addition to Evanston in the South West 1/4 of Section 7,
Township 41 North, Range 14 East of the Third Principal
Meridian, in Cook County, Illinois.
(B) Reclassify from C2 Commercial District to B2 Business District the
property commonly known as 825-27 Noyes Street (and the east half
of the abutting 100 foot wide railroad right-of-way). Said property

Lot 8 of Block 2 of Owners Resubdivision'of Blocks 2,
5 and 6 of Orrington Addition to Evanston, in the
Southwest 1/4 of Section 7, Township 41 North, Range
14 East of the Third Principal Merician (including
that portion heretofore conveyed to the Chicago,
Milwaukee, St. Paul and Pacific Railroad, being a
40-foot strip, the Easterly line .of which is a line
drawn parallel to and 40 feet from the Westerly -line
of said Lots) and also including that portion of the
abutting Chicago, Evanston and Lake Superior Railroad
right-of-way, between the Westerly line of said Lots
5, 6 and 7 (on the East) and a line drawn parallel
to and 10 feet due West of said Westerly Lot Lines
(on the West) in Cook County, Illinois.
SECTION 2: Said reclassification under Section l(A) above shall
be and is conditioned upon the actual conveyance of
said premises to the Cook County Housing Authority and the granting of a
special use permit for the construction of housing for the elderly by the
Zoning Board of Appeals as incorporated into Ordinance 42-0-82 and the
development of the site described in Section 1(A) above in substantial confori
mance to site plans and elevation drawings of Loewenberg and Loewenberg 1
dated February 1, 1982, revised March 2, 1982, and signed March 4, 1982, by
David S. Mann.

SECTION 3: The official district.map of the Evanston Zoning
Ordinance, as amended, shall be further amended, in
accordance with the reclassification set forth in this Ordinance and
reflected on the "Zoning Classification" map, attached to and made a part
of this Ordinance as Exhibit "A".
SECTION 4: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 5: This ordinance shall be in full force and effect from
and after its passage, approval, and publication in
