AN ORDINANCE
Authorizing the Lease of Municipally Owned
Real Property Commonly Known as 709 Chicago Avenue
WHEREAS, the City of Evanston owns the following described real
i
property:
Lots 9 and 10 in Block 2 in Kedzie and Keeney's
addition to Evanston, being a subdivision of the
South 1/2 of the North 1/2 of the Southeast 1/4
of Section 19, lying East of Green Bay Road, in
I Township 41 North , Range 14, East of the Third
Principal Meridian, in Cook County, Illinois.

Commonly known as 709 Chicago Avenue, Where property is located in the
City of Evanston, Illinois; and

WHEREAS, the City Council of the City of Evanston has determined
i� that it is no longer necessary, or appropriate, or in the best interest of
If
II the City of Evanston that it retain use of said real estate, and that said
f
it real estate is not required for the use of or q profitable to, the City of
Evanston; and
li WHEREAS, Dominick's Finer Foods, Inc., a Delaware corporation, has
I
proposed to lease property at 709 Chicago Avenue; and
!) WHEREAS, the City Council of the City of Evanston has determined
I+ that the best interest of the City of Evanston would be served by the
• I
leasing of said property to g p p y qualified parties who will develop that
j property; and

WHEREAS pursuant to Title 1 Chapter 17 Section 4 of the City Code
of the City of Evanston, notice has been given of the proposal to lease
! such real estate, said notice having been published on the 25th day of
1 March, 1982, and for two successive weeks in the EVANSTON REVIEW, a newspaper

published and circulated in the City,of Evanston; and

!� WHEREAS, the City Council finds and determines that the best

interest of the City of Evanston and its residents will be served by the

• II execution of the lease;

ii NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
li EVANSTON, COOK COUNTY, ILLINOIS:

SECTION 1: The City Manager is hereby authorized and directed
to sign, and the City Clerk is hereby authorized and
I
directed to attest on behalf of the City of Evanston a lease by and between
the City of Evanston, Illinois as lessor and Dominick's Finer Foods, Inc.
!I as lessee for the property located at 709 Chicago Avenue, Evanston, Illinois,
I if and known as Parking Lot No. 2 and described as follows: I

Lots 9 and 10 in Block 2 in Kedzie and Keeney's
addition to Evanston, being a subdivision of the j
South 1/2 of the North 1/2 of the Southeast 1/4 I
of Section 19, lying East of Green Bay Road, in
!� Township 41 North, Range 14, East of the Third J
Principal Meridian, in Cook County, Illinois;
for a five (5) year term commencing May 1, 1982, containing a renewal option
for five (5) successive five (5) year periods. The annual rental fee set
! by said lessee shall be Five Thousand Dollars ($5,000.00), with a rental
I` increase .of u to twenty percent (20% for'each renewal p y p ) period.

i i SECTION 2: The lease shall further provide that Dominick's Finer '
;i Foods, Inc. may sublease the premises to McCarville I
j Chevrolet, Inc. or The Lowell Land Company or its assignee for use as a i
3 11 car lot or open sales lot. All lessees and sublessees shall be required
i
to indemnify and hold harmless the City and to pay all costs related to

the property including real estate taxes and utilities.

' SECTION 3: That the City Manager is further authorized and directed
to sign and the City Clerk is authorized and directed to I
attest on the behalf of the City of Evanston an Agreement by and between the
I
�+ City of Evanston and McCarville Chevrolet, Inc., and a letter of understanding I

�I f ! with the Lowell Land Company pursuant to and in accordance with the terms

of the Dominick's lease.

I, SECTION 4: That the City Manager is hereby authorized to negotiate
�i
any additional conditions on the lease of the aforesaid
i� property as may be determined to be in the best interest of the City and
that said lease shall not be executed until such time as evidence is
provided that the proposed redevelopment project currently planned by
Dominick's. Finer Foods, Inc. on Chicago Avenue from South Boulevard to
Keeney Street has been determined feasible and shall be implemented within
twelve (12) months of the passage of this ordinance.

SECTION 5: This ordinance shall be in full force and effect
from and after its passage and approval in the
manner provided by law.
