HomeMy WebLinkAboutORDINANCES-1982-114-O-828/17/82 i i 114-0-82 AN ORDINANCE • Adopting by Reference the Food & Drug Administation's- "The Vending of Food and Beverages Code", 1978, and Amending Title 3, Chapter 8, Section 10-3 of the Code ! of the City of Evanston i WHEREAS, the City Council of the City of Evanston considers it ! in the public interest to adopt "The Vending of Food and Beverages Sanitation Ordinance and Code", 1978 edition of the Food and Drug Administration, as its ; standard for regulating the sale of food and beverages through vending machines and the issuance of permits for such machines; and d. WHEREAS, the City Council of the City of Evanston has caused three (3) copies of the aforesaid Code to be kept on file in the Office of the City Clerk for public inspection for a period of more than thirty (30) days prior to the adoption of this Ordinance; • NO)W, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Title 3, Chapter 8, Sections 10-3(A) and (B) . of the Evanston City Code, 1979, as amended, be further amended to read as follows: i� 3-8-10-3: FOOD, BEVERAGE, CONFECTION -DISPENSING DEVICES (A) Adoption by Reference: Pursuant to the authority granted by Chapter 24, Section 1-2-4 of the Illinois Revised Statutes and pursuant to its home rule powers, the City of Evanston hereby adopts by reference and incorporates herein the Food and Drug Administration's unabridged form of"The Vending of Food and Beverages Sanitation Ordinance and Code 1978; regulating the sale of food and beverages through vend- ing machines; the requiring of permits for the installation and operation of vending machines; and the prohibiting of the sale of unsound or misbranded food or drink in the City of • Evanston, except that Sections 6-601 and 6-602 of said un- abridged ordinance and cod!_ shall be replaced by 3-8-10-3(C) below. 'I ! ;j t � I (B) Any reference in The Vending of Food and Beverages Sanitation Code to"Regulatory Authority" shall mean the Public i Heal-Lh Director of the City of Evanston. Any reference to "Municipality" shall mean the City of Evanston. (C) Penalties and Remedies: � I (1) Any person who violates or fails to perform any duty i imposed by this Ordinance shall be guilty of an offense punishable by a fine of not less than $25.00 nor more than $500.00. A separate offense shall be deemed committed for each day that a violation continues. i (2) The Public Health Director may seek to enjoin violations of this Ordinance. SECTION 2: It is the intention of the City Council that the provisions of this ordinance are severable and that j i the invalidity of any section or part of any section of this ordinance and the code hereby adopted shall not affect any other section or portion of I this ordinance.
