Amending Title 8, Chapter 9 of the Evanston City
Code, 1979, Relating to Food Delivery Vehicles
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK

FOOD DELIVERY
VEHICLE: Includes all wagons, motor vehicles and

vehicles propelled by human power for
the storage or transportation of food,

food products, milk and beverages intended

for human consumption, including all vehicles;
operated in connection with the wholesale
distribution of meats, vegetables and all r

food products

8-9-2:
Inspection: All food delivery vehicles shall be kept in a
clean and sanitary condition. It shall be the duty of the
Public
Health Director to make or cause to be made such inspections
as may
be necessary to insure all food delivery vehicles transport-
ing food
or beverages are kept in a clean and sanitary condition.
During
transportation, food shall meet the applicable requirements

of the
Retail Food Store Code (Title 8, Chapter 7).

License Required; Application: It shall be unlawful for

any person to operate within the City a "food delivery
vehicle"
as defined herein, without first having obtained a license !
for that
purpose.

Any person
desiring to operate any food delivery vehicle shall
!;

make written application to the City Collector for a license,
'
setting
forth a description of said vehicle and its intended
uses.
Before such license is issued: the Public Health Director

shall cause to be made an inspection of the vehicle described
to determine the fitness and suitability of such vehicle for
its intended use.
8-9-4: License Fee; Term:
(A) Fee: The annual license fee for the operation of a food
delivery vehicle, excepting delivery vehicles operated by
a retail food store within the City, shall be $33.00.
(B) Term of License: All licenses shall expire on December 31
following the date of issuance. It shall be unlawful to
transfer any such license from one person to another.
8-9-5: Penalties and Remedies:
(A) Any person who violates or fails to perform any duty imposed
by this Ordinance shall be guilty of an offense punishable by
a fine of not less than $25.00 nor more than $500.00. A separate
offense shall be deemed.committed for each day that a violation
continues.
(B) The Public Health Director may seek to enjoin violations of this
Ordinance.
SECTION 2: It is the intention of the City Council that the pro-
visions of this ordinance are severable and that the
invalidity of'any section or part of any section of this ordinance and the
code hereby adopted shall not affect any other section or portion of this
ordinance.
SECTION 3: This ordinance shall be in full force and effect
from and after its passage, approval and publication
in the manner provided by law.
!` SECTION 4: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
