HomeMy WebLinkAboutORDINANCES-1982-110-O-8210/19/82 11/3/82 11/11/82 1/19/83 3/8/83 110-0-82 AN ORDINANCE Amending Title 8, Chapter 7 of the Evanston City Code, 1979, Relating to Sanitation of Retail Food Stores WHEREAS, the City Council of the City of Evanston considers it =i in the public interest to adopt the ''Retail Food Store Sanitation Code" ii 1982 edition of the Food and Drug Administration, as its standard for regula- ting the inspection and sale through retail food stores; the issuance, sus- pension and revocation of permits to operate retail food stores and the pro- i hibiting of the sale of unsound or mislabeled food or drink; and �I WHEREAS, the City Council of the City of Evanston has caused II three (3) copies of the aforesaid Code to be kept on file in the office of • the City Clerk for public inspection for a period of more than thirty (30) ii days prior to the adoption of this Ordinance: i NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ij EVANSTON, COOK COUNTY, ILLINOIS: i� is SECTION 1: Title 8, Chapter 7 of the Evanston City Code of 1979, as amended, is hereby further amended so that Chapter 7 shall read in its entirety as follows: I! CHAPTER 7 . I Retail Food Store Sanitation r SECTION 8-7-1: Adoption by Reference I 8-7-2: License Required; Application I8-7-3: License Fees; Term 8-7-4: Penalties and Remedies • 8-7-1: Adoption by Reference: !j (A) Pursuant to the authority granted by Chapter 24, Section 1-2-4 of the Illinois Revised Statutes and pursuant to its home rule powers, the City of Evanston hereby adopts li by reference and incorporates herein the 1982 edition of !i the "Retail Food Store Sanitation Code", as promulgated by the Food and Drug Administration, regulating the inspec- tion and sale of food through retail food stores; regulat- ing the issuance, suspension, and revocation of permits to operate a retail food store; and prohibiting the sale of ,1 • 10/19/82 11/3/82 11/11/82 1/19/83 3/8/83 unsound food and drink. (B) Any reference in the Retail- Food Store Sanitation Code to any "Regulatory Authority" shall mean the Public Health Director of the City of Evanston. Any reference to "Municipality" shall mean the City of Evanston. 8-7-2: License Required; Application It shall be unlawful for any person to operate a retail food store within the City without first having obtained a license for that purpose, as provided herein. Any person desiring to keep or maintain any retail food store, as defined in this Chapter, shall make written application for a license, setting forth the location and description of the premises where such retail food store is to be conducted. Before such license is issued, the following investigations and inspections shall be made: (A) The Public Health Director shall cause to be made an inspection of the premises described in such application to determine whether said premises are in compliance with the requirements of this -Chapter. 1 (B) The Building and Zoning Director shall ascertain that the premises may be used for the purpose in conformity with the • ; zoning regulations and other ordinances of the City applic- able thereto. Such application shall be transmitted to the City Collector together with the recommendations of the above officers for the issuance of said license, and upon payment of a license fee, said license shall be issued in accordance with such f application and recommendations.. (Ord. 98-0-61) 8-7-3: License Fees; Term: (A) Fees: The annual license fees for each retail food store herein regulated shall be as follows: $30.00 plus $4.50 ` for each employee in excess of two who works at least thirty-two (32) hours per week; $15.00 for each delivery vehicle operated by such establishment in excess of one. Maximum license fee shall not exceed a total of $500.00. +i (B) Term of Licenses: All licenses provided for in this Chapter shall expire on December 31 following the date of issuance. It shall be unlawful to transfer any such is license from one person to another. (Ord. 126-0-80) 1i 8-7-4: Penalties.and Remedies: i (A) Any person who violates or fails to perform any duty imposed by this ordinance shall be guilty of an offense }! punishable by a fine of not less than $25.00 nor more • i; than $500.00. U is • 10/19/82 11/3/82 11/11/82 1/19/83 3/8/83 110-0-82 (B) The Public Health Director may seek to enjoin violations of this Ordinance. j SECTION 2: It is the intention of the City Council that the pro- visions of this ordinance are severable and that the linvalidity of any section or part of any section of this ordinance and the code hereby adopted shall not affect any other section or portion of this ordinance. SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
