AN ORDINANCE
Amending Section 9-5-23 of the Evanston
City Code, 1979, as Amended, Relating to
Prohibited Noises
WHEREAS, the City Council of the City of Evanston believes that
time and permit restrictions upon the use of noise producing devices are
essential to preserve the peace and order of the community;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That Title 9, Chapter 5, Section 23(F) and (G) of
the Evanston City Code, 1979, as amended, be further
amended to add (F)3 and amend (G) to read as follows:
(F) Loudspeakers, Amplifiers, Paging Systems:
3. Restrictions Upon Hours of Permitted Use: No machine or
device specified in paragraphs (1) or (2) above shall be
operated between the hours of ten o'clock (10:00) P.M.
and seven o'clock (7:00) A.M. from Sunday evening through
Friday morning, and between eleven o'clock (11:00) P.M.
and seven o'clock (7:00) A.M. from Friday evening through
Sunday morning and on those evenings preceding national
holidays and legal school holidays enumerated in Chapter
122, Section 24-2 of Illinois Revised Statutes, in such a
manner as to be plainly audible at a distance of fifty feet
(50') from the location of such set, instrument or device.
(G) Radios, Phonographs
1. Time and Use Restrictions: The playing, using, operating
or permitting to be played, used or operated, any radio
receiving set, musical instrument, phonograph, televi.sion
receiving set or other machine or device for the producing
or reproducing of sound in such a manner as to disturb
the peace, quiet and comfort of the neighboring inhabitants
or with louder volume than is necessary for the convenient
hearing of the persons who are in the room, chamber, vehicle
:r or outdoor area within the City limits in which or where
such machine or device is played, used or operated and who
are voluntary listeners thereto. The operation of any such
set, instrument, phonograph, machine or device between the
hours of ten o'clock (10:00) P.M. and seven o'clock (7:00)
A.M. from Sunday evening through Friday morning, and between
eleven o'clock (11:00) P.M. and seven o'clock (7:00) A.M.
from Friday evening through Sunday morning and on those
evenings preceding national holidays and legal school holi-
days enumerated in Chapter 122, Section.24-2 of Illinois
Revised Statutes, in such a manner as to be.pl�inly audible
at a distance of fifty feet (50')-from the location of such
set, instrument or device, shall be prima facie evidence of
a violation of this section.
2. Permit Required: Any person, group, association, organiza-

tion, business or other similar entity desiring to use in
an outdoor area any machine or device specified in this
section for producing or reproducing sound must first
obtain a.permit for said use. Application for such permit
shall be made to the Office of the City Manager on a form
provided by that office. Violation of this section shall
subject the unauthorized user to a fine of not less than
• $50.00 nor more than $500.00.

SECTION 2: This ordinance shall be in full force and effect
from and after its passage, approval and publication i
in the manner provided by law.
SECTION 3: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
