HomeMy WebLinkAboutORDINANCES-1983-119-O-8310 • • 11/2/83 11/3/83 11/16/83 12/1/83 12/13/83 i 119-0-83 AN ORDINANCE Authorizing the Sale of f Alcoholic Liquor in B4 and B5 Districts i BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: i SECTION 1: That Section 3-5-1 of the Evanston City Code, 1979, as i amended, be further amended by adding thereto the definition of the following: 3-5-1: I ORIGINAL PACKAGES: Any bottle, flask, jug, can, cask, barrel, keg, hogshead or other receptacle or container, whatsoever, i used, corked or capped, sealed and labeled by the manufacturer of alcholic liquor, to contain and to convey any alcoholic liquor. PACKAGE STORE: - A place of business in which the premises are used primarily or exclusively for the retail sale of alcoholic liquor in original package for consumption off the premises where sold. SECTION 2: That Section 3-5-6 of the Evanston City Code, 1979, as amended, be further amended by adding thereto Section 'i 3-5-6(H) which reads as follows: 3-5-6(H): Class (H) licenses which shall authorize in B4 and B5 zoning districts the retail sale of alcoholic liquor in original packages to persons of at least 21 years of age for consumption off the premises. The applicant for a Class (H) license shall pay a first year license fee of $25,000.00. Thereafter, the annual fee for a Class (H) license shall be $2,500.00. No more than such license(s) shall be in force at any one time. Each Class (H) license shall be subject to the following conditions. 1. It shall be unlawful for a Class (H) licensee to sell a single container of beer unless the volume of the container is.equal to or greater than 32 ounces. 2. It shall be unlawful for a Class (H) licensee to sell a single container of wine unless the container is greater than 16 ounces. 3. It shall be unlawful for a Class (H) licensee to sell a single . container of alcoholic liquor, except beer and wine which are regulated by (1) and (2) supra, unless the container is greater than 16 ounces. 4. It shall be unlawful for the holder of a Class (H) license to offer for sale at retail any alcoholic liquor in original packages for consumption off the premises where sold before the hour of 11:00.a.m. or after the hour of 10:00 p.m. on Monday through Saturday; and before the hour of 12:00 noon and after the hour of 10:00 p.m..on Sunday. It shall be unlawful for anyone under 21 years of age to offer for sale at retail any alcoholic liquor. • SECTION 3: Should any section, paragraph, sentence, clause, phrase or word of the amendment be declared invalid or uncon- stitutional by a court of competent jurisdiction, such invalidity or uncon- stitutionality shall not affect the validity of any of the remaining words, phrases, clauses, sentences, paragraphs or sections of this amendment • SECTION 4: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 5: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law.
