HomeMy WebLinkAboutORDINANCES-1983-101-O-839/21/83 101-0-83 AN ORDINANCE • Amending Section 6-9-2-1 of the Evanston City Code, 1979, As Amended, To Permit Rental of Additional Parking Space • WHEREAS, the Zoning Amendment Committee conducted public hearings on July 21, 1983; August 4, 1983; August 18, 1983; September 1, 1983; and September 18, 1983; upon reference by the Evanston City Council, to consider. amending the Evanston Zoning Ordinance so as to permit rental of required or additional on -site parking spaces to other private individuals or institutions during periods when said parking is not being used by the primary parking generator, said -public hearings having been conducted pursuant to notice and publication thereof in the manner prescribed by law; and WHEREAS, based upon the evidence presented, consideration of existing conditions, conservation of property values, and the direction of building development to the best advantage of the entire City, the Evanston Zoning Amendment Committee has recommended that said amendments be adopted. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 6-9-2-1 of the Evanston City Code, 1979, as amended, is hereby further amended to read as follows: 6-9-2-1: USE: Required off-street parking spaces accessory to uses listed in this Section shall be solely for the parking of passenger automobiles of occupants, patrons, employees or for vehicles used in a permitted home occupation. Each required space shall be kept available at all times for parking of one automobile. No required parking space shall be rented, leased or used for any purpose other than for which said space is required. Parking lots in residence and university districts shall be used only for the parking of passenger automobiles. In residence and university districts, not more than one truck with a gross weight of eight thousand (8,000) pounds or less, or one trailer with a gross weight of five thousand (5,000) pounds or less, and not more than one self-propelled mobile camping unit, boat and/or boat trailer may be parked in a building or in a rear yard, but not in a front or'side yard or in any court area which opens toward a public street. Exception When Required Parking Is Not Being Used: Required off-street parking which serves use which only operates weekdays during the day or evenings, weekends, and holidays may be rented on not longer than a month -to - month basis to other private individuals or institutions during those hours when there is no demand for said parking by the use which generated the parking requirement. r 9/2A/83 J 101-0-83 i Certification by the Traffic Engineer and the zoning j enforcing officer that the rental arrangement conforms to the Zoning Ordinance must be obtained prior to using required parking spaces for any such other use, and any • changes in said arrangement must also be certified. The Traffic Engineer and the Zoning Officer may impose any II conditions reasonably required to ensure that parking spaces are available when required for the generating use. Typical weekday daytime uses may include: banks, business offices, retail stores, personal service shops, and wholesale uses. Typical weekday evening, weekend and holiday uses may include: auditoriums incidental to schools, churches, dance halls, bowling alleys, and some amusement establishments. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed. i SECTION 3: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
