• !� Granting a Variation from
�! Accessory Building and Use
Regulations at 1569-71 Sherman Avenue

WHEREAS, the Evanston Zoning Board of Appeals conducted a public
(hearing on August 16, 1983 upon the application of Quinlan & Tyson, Inc.
�as beneficiary of Colonial Bank & Trust Co., Trust 430, for variation from
I
!the accessory building and use regulations of the City of Evanston Zoning
Ordinance to permit retention of an accessory building which is one (1)
!!foot from the nearest wall of the principal building, located at 1569-71
j�
!!Sherman Avenue, Evanston, Illinois, in a B5 Business District, said hearing
Ii
1:having been conducted pursuant to notice and publication thereof in the
jlmanner prescribed by law; and
�! WHEREAS, the Zoning Board of Appeals at said August 16, 1983
�i
hearing, based upon analysis and review of the application and other evidence
presented, has recommended that the application for said variation be
jI granted; and
I
j; WHEREAS, the City Council finds that:

!' This property is located in a B5 Business District, commonly
i
known
bias 1569-71 Sherman Avenue, Evanston, Illinois and legally described as:
I
!I Lot 10 (except the southerly 8 inches thereof) in Block 27
in the Village of Evanston, in the SW v of Section 18, Township
�I 41 North, Range 14, East of the Third Principal Meridian, in
Cook County, Illinois.
The applicant proposes to retain an accessory building which
li
is one
(1•) foot from the.nearest wall of the principal building, whereas a ten
(10)
;I (foot separation is required by Section 6-3-4(B) of the Zoning Ordinance
I
of the
City of Evanston; and
i
WHEREAS, the City Council, after application of variation
I
Ilstandards of the Zoning Ordinance of the City of Evanston, further finds
that:
jl A. Unique circumstances exist in this case which are not appli-
cable generally to other property within the same zoning
• jl classification.

B. There are practical difficulties and particular hardships in
carrying out the strict letter of the regulations in this
case.
C. The proposed variation will not alter the essential character
of the locality and is in harmony with the general purpose
and intent of the ordinance.
D. Conditions and restrictions should be imposed on the premises to
be benefitted by this variation in order to implement the
general purpose and intent of the ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
i OF EVANSTON, CCOK COUNTY, ILLINOIS:

SECTION 1: That the application of Quinlan & Tyson, Inc. as

beneficiary of Colonial Bank & Trust Co., Trust 430,
li for variation from the accessory building and use regulations of the City
i
li of Evanston Zoning Ordinance to permit retention of an accessory building
�i which is one (1) foot from the nearest wall of the principal building,
!� located at 1509-71 Sherman Avenue, Evanston, Illinois, and legally described
I
i as follows:
I
Lot 10 (except the southerly 8 inches thereof) in Block 27
in the Village of Evanston, in the SW 4 of Section 18, Township
�I 41 North, Range 14, East of the Third Principal Meridian, in
i Cook County, Illinois
!I is granted, subject to compliance with all other provisions of the Zoning
j
i; Ordinance, other applicable laws and the following conditions:
That said building shall be removed from the premises when
I Quinlan & Tyson, Inc. no longer has an ownership or beneficial
interest in the property, or said building is no longer used
for sign storage, whichever first occurs.

ij SECTION 2: The Director of Building and Zoning is hereby
j
directed to issue such permit pursuant to the terms
of this ordinance.'.
i
SECTION 3: This ordinance shall be in full force and effect
from and after its passage and approval in the
manner provided by law.
