AN ORDINANCE
is Granting a Variation and Special Use
at 1107-17 Howard Street
WHEREAS, the Evanston Zoning Board of Appeal's conducted a public
hearing on May 17, 1983 and again on July 13, 1983 upon the application of
McDonald's Corporation (owner in part and lessee in part) and Rose M. Dwork
as sole beneficiary under the Exchange National Bank of Chicago, Trust 8578
(owner in part) for: (1) a variation from the yard obstruction regulations
of the Zoning Ordinance to permit installation of sixteen off-street parking
spaces in the front yard; and (2) a special use to permit construction of a
drive-in restaurant at 1107-17 Howard Street; said hearing having been conducted
pursuant to notice and publication thereof in the manner prescribed by law;. and

WHEREAS, the Zoning Board of Appeals has recommended that the
application for said variation and said special use be granted;
. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the application of McDonald°s Corporation and Rose
M. Dwork as sole beneficiary under the Exchange National
Bank of Chicago, Trust 8578 for (1) a variation from the yard obstruction
regulations of the Zoning Ordinance to permit installation of sixteen off-street
parking space in the front yard; and (2) a special use to permit construction
of a drive-in restaurant on property located at 1107-17 Toward Street and
legally described as:
Lots 4, 5, 6, 7, 8, 9, 10, 11 and 12 in Talman and
Thiele's Howard Street Subdivision of Lot 1 in Reis'
Subdivision of Lots 3, 4 and 5 of the Subdivision of
Lot 9 (except the.North 24.0 feet) of County Clerk's
Division of unsubdivided land in the Northwest 1/4
and of Lot 13 of County Clerk's Division of part of
the Southwest fractional 1/4 of Section 30, Township
41 North, Range 14 East of the Third Principal Meridian,
in Cook County, Illinois
• is granted, subject to compliance with all other provisions of the Zoning
Ordinance, other applicable laws, and the following conditions:

(a)
That the applicant shall take all necessary steps to
prevent vehicles entering or leaving the facility's
premises from stacking, double parking;,, or obstructing
the public right of way (street, parkw-ay, or sidewalk)
including, but not limited to, the hiring of a security
•
guard, an off -duty policeman or reimbuxrsing the City,
for the costs of stationing a police oiFficer at the.
premises to direct traffic. In the event traffic
problems arise the applicant agrees to; permit the
installation of traffic signs prohibit.iing left turns
to vehicles entering or leaving the premises; '
(b)
Within five (5) days of receipt of wri-ten notice of
violation of the provisions of this ordiinance, appli-
cant shall initiate whatever steps it dieems effective
to alleviate promptly any traffic prob-T-em and to that
end applicant agrees to consult with thie City's Traffic
Engineer;.and
(c)
That a covenant in recordable form be eixecuted by the
applicant subscribing to the aforememt:f,oned terms and
conditions.
SECTION 2: The Director of Building & Zontnq is hereby directed to

issue such permit pursuant to the terms of this ordinance.
SECTION 3: All ordinances or part of ordinam ces in conflict
herewith are hereby repealed..
SECTION 4: This ordinance shall be in full,' IFForce and effect from
• and after its passage and approv++eil in the manner
provided by the law.
