HomeMy WebLinkAboutORDINANCES-1983-071-O-83" 1 6/22/83 7/5/83 9/28/83 10/20/83 i 10/31/83 71-0-83 AN ORDINANCE • ( Amending Sections 6-3-6-l(B), 6-7-2-1(C), 6-7-2-2P, 6-9-2-2.(C), and 6-9-2-2 of the Zoning Ordinance Concerning the Location of Off -Street Parking in Business Districts WHEREAS, the Evanston Zoning Amendment Committee conducted public hearings on April 21, 1983; May 5, 1983; May ;19, 1983; June 2, 1983 and June 16, 1983 to consider amending Section 6-3-6-1: "YARD" and 6-7-2-1(C): "PERMITTED USES AS TO GROUND FLOOR LOCATION; ALL BUSINESS DISTRICTS" and any related provisions, to clarify the authorized location of off-street ,parking in all business districts and to consider making i off-street parking a permitted or a special use in any front yard in some or all business districts, said public hearing having been conducted pursuant to notice and publication thereof, in the manner_ prescribed by law; and • WHEREAS, based upon the evidence presented, findings ,of fact, existing conditions, conservation of property values, land the direction of building development to the best advantage Iof the entire City, the Zoning Amendment Committee has i recommended that certain amendments are clearly favored by a `preponderance of the evidence and are required for the public (good, and the Planning and Development Committee has analyzed and revised subject recommendations; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF ITHE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: f• SECTION 1: That Section 6-3-6-1(B) of the City Code :r of the City of Evanston, 1979, as amended, is hereby further amended to read as follows: (B) In any yard except a required yard: 1. Fences not exceeding eight feet (8') in height, arbors and trellises; and 71-0-83 2. In all Business Districts, open accessory off-street parking spaces located between the front lot line and the principal building are a special use. Special attention should be given to the potential impact of the proposed parking,on • pedestrian and vehicular traffic, especially in regard to uses which generate or depend on pedestrian traffics such as residential areas, schools, churches, hospitals or nursing homes, when applying the special use standards. (See also Sections 6-7-2-1, 6-7-2-2 and 6-9-2-2.) Installation of appropriate landscaping and screening (not limited to that otherwise required) in order to reduce or eliminate the disadvantages of .front -yard parking, improve the visual appearance, and create some of the amenities that would otherwise be provided by a landscaped yard, shall be a condition to approval. SECTION 2: That Section 6-7-2-1(C) of the City Code of the City of Evanston, 1979, as amended, is hereby further amended to read as follows: (C) Permitted Uses Restricted as to Ground .Level Location on Site: All Business Districts: The following uses are also permitted, provided they are not located at ground level (established grade level) on site within twenty-five feet (25') of any front lot lines: 1. Art museums. 2. Employment agencies. • 3. Food lockers. 4. Job printing, blue printing and photocopying where part of a permitted business and not occupying more than fifteen percent (150) of the total floor area. 5. Laboratories - medical, dental and research. 6. Locksmith shops. 7. Meeting halls. 8. Orthopedic and medical supply stores, but not in- cludina the assembly or manufacture of such articles. 9. Physical culture and health services, gymnasiums, reducing salons, masseurs, and public baths. 10. Radio and television, broadcasting studios. 11. Restricted production and repair limited to the fol- lowing: art needlework, clothing, custom manu- facturing and alterations for retail sale on the premises of jewelry, clocks and watches. 12. Schools - music, dance or business. 13. Wholesale establishments where storage of mer- chandise is limited to samples only. 14. Accessory uses to those permitted in this Section 6-7-2 includingassembly, y, repair_ and storage which is clearly incidental to the conduct of a permitted use. However, in the Business Districts only, accessory parking for permitted uses in this Section 6-7-2 may be located within twenty-five • feet (25') of any front lot line, provided that such parking is approved as a special use (see also Sections 6-3-6-1(B), 6-7-2-2 and 6-9-2-2(C). -2- 71-0-83 SECTION 3: That Section 6-7-2-2P of the City Code of Evanston, 1979, as amended, is further amended to read as follows: P • Parking areas in Business Districts located within twenty-five feet (2"5') of the front lot line (see also Sections 6-7-2-1(C), 6-9-2-2(C), and 6-3-6-1(B). Parking lots and storage garages for motor vehicles under one and one-half (1-1/2) ton capacity. (For restrictions on location, see also Sections 6-3-6 and 6-9-2-2(C)). Planned developments in B2, B3, B4 and B5 Districts only. Public utility uses (other than business offices and telephone pay booths which are permitted), including: a. Electric substations, b. Railroad rights of way and stations, • C. Telephone exchanges, microwave relay towers and telephone transmission equipment buildings, d. Transit and transportation facilities, including shelters, terminals, parking areas and service buildings. SECTION 4: That Section 6-9-2-2(C) of the City Code" • of the City of Evanston, 1979, as amended, is further amended to read as follows: (C) Where parking spaces are located in a parking lot where allowed by this ordinance, the following restrictions shall apply: 1. In Rl, R2, R3, R4, R5 and R5A Districts, the surfaced area of all parking spaces shall be not less than fifteen feet (15') from every street lot line nor less than the established front yard setback line of any adjoining lot, whichever is greater, and may be placed only at a location where parking spaces are a permitted yard obstruction. 2. In all Business Districts all parking areas (except access drives) shall be not less than twenty-five feet"(25') from any front lot line, except that parking within twenty-five (25') may be allowed as a special use. Parking spaces may be located only where allowed by the yard obstruction regulations (see Sections 6-3-6, 6-7-2-1 and 6-7-2-2). 3. In R6, R7, Ul, U2, U3, U4," Ml, M2, M3 and M4 Districts, the surfaced area of all parking spaces shall be not less than fifteen feet (15') from every • street lot line and may be placed only at a location where parking spaces are a permitted yard obstruction (see Section 6-3-6). -3- 71-0-83 SECTION 5: That Section 6-9-2-2 of the City Code of the City of Evanston, 1979, as amended, is further amended by adding a new paragraph D to read • as follows: (D) The location of parking spaces is also subject to other restriction, including but not limited to Sections 6-3-6, 6-7-1(C) and the yard regulations for these various districts. SECTION 6: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
