HomeMy WebLinkAboutORDINANCES-1983-070-O-83• E 6/20/83 7/5/83 7/8/83 70-0-83 AN ORDINANCE Amending City Code, Chapter 6, Plumbing Code, Section 4-6-1, Subsection D Pertaining to a Requirement for the Disconnection of Building Downspouts from the City s Combined Sewer System 1 WHEREAS, there are residences located in the City of Evanston !;equipped with downspouts which are connected to the City's combined sewer system; and WHEREAS, such connection of downspouts causes a substantial amount i, of water to flow into the City's sewer system during periods of heavy rain with resultant flooding in the basements and lower levels of buildings in the City of Evanston; and WHEREAS, the Mayor and the City Council of the City of Evanston have ''been advised by the Flood and Pollution Control Commission of the City that p downspout disconnection will help to diminish the City's flooding problem by decreasing the amount of water flowing into the City's sewer system during periods of heavy rain. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Section 4-6-1(D) of the Evanston City Code, 1979, as amended, be further amended by adding the following: P.801.1 All buildings in Zoning Districts R1, R2, R3 and all single family and two family dwelling units in other zoning districts are prohibited from discharging roof top storm water directly into the Evanston combined sewer system by means of downspouts from building gutters. Storm water from building gutters shall be discharged to the front or rear of the property in a manner which shall not damage the same or adjoining properties, or become a nuisance to occupants of same. P.801.2 All roofs from buildings not specifically prohibited in P.801.1, paved areas, yards, courts and courtyards may be drained directly into the Evanston storm sewer system. A surface means may also be utilized to dispose of storm water provided a plan therefor is approved by the Director of Public Works or his desig- nated representative. Cleanouts shall be installed in all storm drainage systems and shall comply with the provisions of this Code on drainage pipe cleanouts. 6/20/83 7/5/83 7/8/83 • P.801.3 Exceptions to the requirements of Section P.801.1 and P.801.2 shall be made in those cases where, in the opinion of the Director of Public Works or his authorized agent, such disconnection will create an associated storm water hazard to the building or part thereof or to a neighboring building. The City Manager shall have the authority to promulgate rules and regulations setting forth the procedure for such an exception. SECTION 2: Any person who violates any provision of this ordinance shall be subject to a maximum penalty of $100.00 per is jjday for each day of violation. SECTION 3: The modifications to existing buildings required by I this ordinance shall be completed by May 1, 1984. SECTION 4: All ordinances or parts of ordinances in conflict here- with are hereby repealed. SECTION 5: This ordinance shall be in full force and effect on May 1, 1984, except for cases where an authorized ij variance has been granted.
