AN ORDINANCE
Vacating a Portion of Elmwood Avenue
Commencing at a Point 141 Feet North of the
North Line of Mulford Avenue and Continuing for 200 Feet
BE IT ORDAINED BY THE CITY COUNCIL OF TFtE CITY OF EVANSTON, COOK
COUNTY, ILLINOIS:
SECTION 1: Vacating that portion of Elmwood Avenue and public alley
adjacent thereto and continuing east and legally
described as:
That part of Elmwood Avenue lying North of aline that is
drawn from the Southeast Corner of Lot g in Block 3, to
the Southwest corner of Lot 20 in Block 2, and lying
South of the North line extended of' the 13 feet wide
dedicated Public Alley, Document No. 3977242, and
recorded on January 11, 1907, and also that part of
said 13 feet dedicated Alley lying East bf the East
line of said Elmwood Avenue and lying West of the East
line of Lot 27 in said Block 2, extended North; all in
V. M. Williams Addition to Evanston, a S:ubdivision< of
Lot 4 in County Clerk's Division of Unsubdivided Lands
in the Northwest Quarter of Section 30, Township 41.
". North, Range 14 East of the Third Princi pal Meridian
in Cook County, Illinois,
as indicated by the words "hereby vacated" on the Plat of Vacation attached to
and incorporated into this ordinance, be and the same are hereby vacated and
closed, inasmuch as the corporate authorities of the City of Evanston have
determined that the public interest will be served by the aforesaid vacation.
SECTION 2: The adjoining property owner, St. Francis Hospital,
which shall receive the: benei-its of this vacation, shall
pay to the City of Evanston the sum of Sixty-eight Thousand Two Hundred and

Fifty Dollars ($68,250.00) and be subject to the following condition as

i consideration for said vacation: F
that if at any time in the future, St. Francis Hospital
t shall elect to develop the site (i.e., construct a,
building) of the present Elmwood Avenue, the land shall
be reappraised as a buildable site, cognizance taken of
its value for assemblage, and the difference between
that value and the sale price shall be paid to the City-

SECTION 3: The City of Evanston hereby reserves to itself and to

all public utilities owning public service facilities
1` such rights of way, license and easement rights to equipment resentl f

j installed and located on those portions of the public way hereby closed. and
l reserves the right of ingress and egress for the maintenance, renewal and
reconstruction thereof, and further reserves the right of ingress and egress

for Fire Department, Police and all other life safety facilities.
SECTION 4: The adjoining property owner, St. Francis Hospital,
shall be responsible for the maintenance, repair and
renewal of the nine inch (9") water line and six inch (6") sewer line located

on subject property.

�I SECTION 5: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
J. SECTION 6: This ordinance shall be in full force and effect from !

and after its passage, approval and publication in the -
manner provided by law.
